the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this�day of f�3 , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation("City")and 'Sksa���/.tic �prnc✓' ("Owners").

1. A building pertnit application has been filed for a building permit for a new home located at 75
Leaf Street, the ("Subject Property"), legally described as Lot 1 Block 3 Graham Hilf Preserve, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$2,500 with the City. All accnaed interest, if any,shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW.The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consuftant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guaraMee
reimbursement Eo the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work(including planning,
engineering, or legal consultant review) associated with building permit #2012-00070 if compliance with the
approved building permit is not accompfished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs,the City will in turn
send a bill to the Owners_ Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above,shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the Ciiy for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesfing the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners,or if the eligible expenses
incu e City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subj ct pro y inn.Stat.§§415.01 and 366.012.

Dear Melanie:
We have reviewed the plans for the proposed new home construction at 75 Leaf Street. The site plans are
dated 2-1-12 and 1-17-12. We have the following comments with regards to engineering matters:
• The proposed tiered retaining walls on the west side of the house are in eight feet high. Engineered
design and details should be submitted for review and approval for all retaining walls over four in
height, and for all tiered walls with a separation of less than two times the wall height.
• We recommend that the house plan set site plan and certificate of survey grading plan provide a
coordinated driveway plan at Leaf Street. The plans should not contain retaining walls with the right
of way and provide additional information on drainage and a culvert.
• The city should assume that the overall wetland buffer requirements from the Graham Hill Preserve
Plat have not been completed. In general, work on this property would include invasive species
removal, native seeding, maintenance, and signing of the buffer areas.
• This project will disturb more than 100 CY of material. Sediment and erosion control information
meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000
sediment and erosion control financial security should be required of the owner for this permit.

We have reviewed the plans for the proposed new home construction at 75 Leaf Street. The site plans is
dated 2-15-12. We have the following comments with regards to engineering matters:
• The proposed retaining wall is shown as 4.O feet in height. If field changes increase the height,
engineering design and details must be submitted for review.
• Existing drainage patterns along Leaf Street must be maintained at the driveway connection. We
recommend public works inspect the driveway installation prior to final surfacing.
• The plan is acceptable from an engineering standpoint.
• This project will disturb more than 100 CY of material. Sediment and erosion control information
meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000
sediment and erosion control financial security should be required of the owner for this permit.

ORONO, a Minnesota municipal corporation ("City") and Jason &Julie Kapsner("Owners").
Recitals � I
1. Construction of the new residence located at 75 Leaf Street, (the "Subject Property"),
legally described as Lot 1 Block 3 Graham Hill Preserve in Orono, Hennepin County
Minnesota, is the subject of building permit application number 2012-00070 has been
completed.
2. Extenuating circumstances currently prohibit completion of exterior improvements, final
grading, and vegetation establishment. An as-built survey cannot be accurately
conducted at fihis time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an:�s-built survey
to the Ciry.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the eserow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs.the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible fo� under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the Gity has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
� Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2012-00070 if compliance with the approved building permit is not
accomplished.

3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owner.s. Owners shall be responsible for payment to the City within 30 days of I
the Owners' receipt of bill. �
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City r�ay�draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred. � �
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to j
the Owners when the review has been completed and written notification is received from the Owners
requesting the funds.

employees, officers and contractors, the right to enter upon the subject property for the specific purpose ;
