Rabe, 4050 Dahl Road, appeared 4050 Dahl Road before the City Council objecting to the � proposed 73-1 sewer assessment for Mr. Rabe stating that Tir. Rabe sold his home last � year and that monies held in escrow for the sewer assessment were not sufficient to fund � the $6,357.36 assessment now being proposed and that Mr, Rabe, caho resides in Milford, � Iowa, had not received notification of the � impending assessment. + Niayor Searles noted that the Certificate of P�iailing showed that a notice of the Public � Hearing and proposed assessment had been mailed to the 4050 Dahl Road address and � '.-�at the Public Hearing notice had been � received by persons living at that ad3resso P�Zrs. Rlargaret Christensen, 51 Hackberry Hill, � asked the City Council if the City had � researched the possibility of delaying filing assessments and certifying the City � budget after the October 10, 1975 requirement, � l�2ayor 5earles requested the City Administrator OCTOBER 10 DEADLINE � to distribute a memorandum from Air. Bruce D. i�7alkerson, City Attorney, which stated that: - � "On September 9 , 1975, pursuant to direction r by the Citv Council, Bruce D. Malkerson telephoned George Hickey, Coordinator of Finance Division, � Hennepin County, telephone number 348-5076. Bruce Malkerson asked whether or not the City � of Orono would be able to file its assessment � roll and its budget on tax levies after October 10, 1975, because the City may not be � able to finalize its assessment roll prior to October 10, 1975. He indicated to me that he • would check with his staff and the county a:torney's office. P�irr, Hickey called Bruce Malkerson later � in the afternoon and stated that after reviewing � the request made by the City among his staff, it was their conclusion that the City of Orono � must file its assessment roll prior to October 10, � 19?5, just as the other 48 municipalities in the County must".do. He was of the opinion that the October 10 date was mandatory. He stated that in 1965, � the county allowe� the Park Board to file an assessment late only because there had been a large � storm that had destroyed hundreds of t�ees and the Park Board did submit a certification by October 10, and submitted a spreading of those figures shortly thereaftere He noted that last year because of • the Fiscal Desparities Act, the Auditor's OrL�ce � had a difficult time in preparing the tax statements but that did not necessarily mean that the County , allowed municipalities to submit assessments and other tax information after October 10 of that year. � He stated that he had spoken with �iJayr.e J�hnson, the Legal Auditor and Treasurer for the Caunty, • and P�Zro Johnson stated that althovgh h� �•�otl�_d like to be able to accommodate the City in rhi� matter, he � feels that to do so would set a precea�nt which • would allow other cities in the future to submit their data, after the October 10 deadlineo To allow ` cities to so submit data, would resul� in much additional work for the County and would probably � preclude the County being able to prep�re the tax statements on time. Motion, Ayes (5) - Nays (0) , • � Mr, Don Boynton and I�r, John Breitner, rilinnetonka ORONO-MINNETONKA BEACH Beach, Mayor and Councilman, appeared before the SEWER LINE r City Council informing them that the E.PeA. and � the Metro Transportation Committee have approved the Tdetro Waste Control Commission acquisition � of Orono's lift stations and trunk sewer facilities and other interceptors serving � r�innetonka Beach and that the Metro Council and the t�innesota Waste Control Commission expected • to act favorably by September 26, 1975 in full � acquisition of the utilities. � Mr. Skip McCombs, City Engineer, read into the record a letter received from the Minnesota * Waste Control Commission that stated: � "This letter is in response to your August 11, 1975 letter (which we received a copy of) addressed � to the Minnetonka Beach City Council regarding the use of the Orono Trunk Sewer Line by the City of Alinnetonka Beach. The requested acquisition of the subject trunk � sewer facility has been included with a group of other interceptor acquisition requests to be � reviEwed by a Metropolitan Council and Commission Task Force. It is expected that this review will '� be finished in the very near future. � Your letter indicates that the City of Orono will � not permit the discharge of sanitary sewage from the City of Minnetonka Beach until the subject a �runk sewer has been purchased by the Commission • because there is no agreement for such discharge between the two cities at this time. Because � this subject facility appears to meet the present Approved Interceptor Definition and Criteria it � is our judgment that the Task Force will recommend that it be acquired as a metropolitan interceptor. � This facility would permit sanitary sewer services for the City of Minnetonka Beach as approved in the Comprehensive Sewer Plan (CSP) for both cities. • In the interim period the Commission would be agreeabZe to enter into a rental agreement for service by Orono for Minnetonka Beach similar to agreements executed with other local government units. As an alternative, the City of Orono may want to consider entering into a sewer rental agreement with the City of I�tinnetonka � Beach for providing this sewer service until such time as the subject facility is acquired by the � Commission. This is not in conflict with the CSP. � � ORONO COUNCIL MEE2ING HELD SEPTEMBER 23, 1975 Page 10 � • As we review the request for acquisition of the ORONO-MINNETONKA BEACH subject trunk sewer as a metropolitan facility, SEWERS (Continued) � we request that the City of Orono permit the continued availability of sanitary sewer service � to the City of Minnetonka Beach in accordance with the approved CSP. A rental agreement with � the Commission or the City of Minnetonka Beach could be executed tn pxovide this interim need. • The total volume of this sewage flow will be deducted from the Orono sewage flow and assigned to Minnetonka Beach. If there is significant delay by the Metro Council to act on this � agreement, when the sewer lines in Minnetonka Beach are ready for domestic use, it is agreed • by the �epresentatives of Minnetonka Beach that they will enter into a rental agreement � with Orono for reimbursement until such time � that the interceptor purchase is completed.
