� discussed with the City Council the status of the 3510 Ivy Place
Tyler property, 3510 Ivy Place, which had recently
� been conveyed to purchase�, Mr. & r2rs. Chuck
Faber. The tollowing letter was submitted as
• informationa
� 'Ddhile following the customary procedures of
� instructing the property owners of removing debris,
we learned a new party was �onsidering the purchase
� of the above property. After an extensive research,
we discovered the Fabers had already agreed to
� terms to purchase the proper��. I informed them
the debris would have �o be removed from the
• property. They requested I �nstruct the present
! owner (Tyler) which we did by letter.
� I also informed the Fabers that this property was
zoned single family residential. i=Tr. Faber
� expressed no interest of double occupancy of_
the rnain structure. He did,_ however, request the
• accessory structure be used for residence of the
current occupant until their new home under
� construction would be completed. I suggested he
� set a date and make this request in writing with
a condition that an application for a conditional
� use permit be made. I informed him the application
could be made for either second residence o�-
� guest house but indica�ecl the difficulty in
obtaining approval for a second residence on one
• parcel.
� T�trs. Faber came to my office on June 3, 1975. She
� picked up a conditional use permit application and
promised to return the application shortly along
� with a letter requesting temporary occupancy of
the second structure for a limited time only, The
� present occupan�t would move into a new home
currently under constructiono Completion is due
• sometime this fall. '
� The Council instructed Mr. Muhich to proceed with
� obtaining a reply from l��ir. & r1rs. Faber as soon
as possible,

Commission has reviewed the Hennepin County
� Transportation Study and have arrived at the
following conclusionso

Preservation of Lake Minnetonka is the primary
underlying goal of our recently adopted Comprehensive
Guide Plan. As a result, the Village ot Orono has
� established land use policies that are intended to
' protect Lake T�innetonka from the adverse effects
of poor quality storm water runoff. Diverting
� heavy commuting and comi:lercial traffic from using

� reported to the City Council that a c')uit Claim J,P. Riedel & Company
Deed from the City of Orono to the J,P, Riedel
• and Company for a certain portion of vacated Lake
View Avenue �nd two Quit Claim Deeds from J,P,
� Riedel and Company to the City of Orono granting
� the City a service easement over the property has
been completed and signed by the T�ayor and City
� Administrator that effectuates the terms and
conditions as set forth by the Council June 24,
� 1975 and meetings prior to that date. The City
Council instructed the staff to file necessary
� documents with the County Auditor.

• reported to the City Council that the Planning DEPARTMENT
� Commission has studied the relocation of the Public
Works Department and has considered all the properties
� listed in T�Iro Charles Kallestad's, subcommittee chair-
rnan, report which statess
i Public Works Relocation Recommendations:
� SIZEo The City Administration Office has come up
with a recommendation of approximately 10 to 15
� acres allowing for present needs as well as future
growth planso This area takes into consideration
storage of sand, rock and other materials to be
stored outside in addition to several buildings
to house road and construction equipmento Possible
� future addition of a City Fire Department would be
allowable within this acreage size.
� LOCATIONe Location should be away from residential
� property and ideally located within or near Industrial
or Ligh Industrial zoning, This would be in keeping
• with a logical land use within zoning areas.
� FRENCH LAKE SITEe Presently sand, rock and other
materials are stored at the French Lake sitee This
r site consists of approximately 40 acres of which
12 acres are usable and the remainder is in water
� or lowlands. Approxmiately 6 acres of the 12 usable
e are wooded and hilly and 2 acres of the 12 acres
belong to the Metro Sewer Board. The t-Tetro Sewer
� also owns the approximately 20 acres settling pond.
These pro�,erties will eventually revert to the City
� when the sewer is phased out which could be from
2 to 5 years. The French Lake property is situated
� in the midcile of residential propertye
� P�SSIBLE SITES: I,. The Eisinger property abuts
Highway 12 on the south about 1 mile west of Old
� Crystal Bay Road, Mr. Eisinger has wanted to fill
the area for a dump for sometime but has not been
able to. The area consists of about 28 acres but
� would need filling, Access is good both from Highway
12 and County Road 6. Drawback is filling might
� cut off water passage from Lake Classen to TZinnetonka.

20 acres on the southeast corner of Old Crystal
� Bay Road and [r�atertown Road, The land is flat
and level but would require some filling. Access
� is good both on Old Crystal Bay Road and F]atertown
Road but the property is located on residential
� property next to other residential property,
• �o Gagne property is located in the northeast
� corner of Highway #12 and Old Crystal Bay Road and
runs east about one-half mile. It is currently
� zoned industrial, however, the access would be
across Highway #12 which would be undesirable.
� Otherwise, it would be excellente
� 5o The Robb property consists of 15 acres of
flat, level, solid land located in the southwest
� corner of Highway #12 and Old Crystal Bay Roado
� The site has ideal access from Highway #12 and Old
Crystal Bay Road and is located south of Highway #12
� to eliminate frequent crossings of the highway,
The land is currently zonec� residential and is
� situated adjacent to industrial zoning. The site
would require no preparation and could be used
• as iso Recommended highly.
� The Planning Commission does consider the Robb
� property as being best suited to accommodate the
Public Works Department. Mayor Searles instructed
� -��1e staff to prepare a recommendation for Council
review July 28, 1975.

� reported to the City Council that the Planning GUIDELINES
Commission was in full concurrance that all of Lake
� P�iinnetanka, including Forest Lake, should be
classified as a recreational area as proposed by
� the City Council to the Department of Natural Resources
in reference to these proposed shoreline guidelines.

discussed the status of the Pdorth Shore PZarina Building Permit

level and shorelines. The resolution declaring
� conditions for the North Shore P�iarina operation
shall contain this data.

Messrso Ray & Paul Kempf representing North NORTH STAR MARINA
� Star Marina, appeared �iefbre the Council to
discuss their marina license for 1975. The
� single dock license usage on Cr�stal Bay was
� discussed as was the intent of the resolution
approving the marina license, It was expressed
� by Councilman Paurus that the marinas in general
were very receptive to the new proposals
� establishing green areas and replanting areas
adjacent to Lake I�Iinnetonka that had previously
� been destroyed. It was noted that five of the
eight marinas had conformed to the regulations
� as requested.

• R2r. Paul Kempf asked why the City Council was
concerned with the dock usage across from the
� North Star Marina located on Crystal Bay
stating that the boat docked at this location
� is used for commercial p�irposes, customers
board and unboard there in conjunction with the
marina operation and felt that the boat, which
is used for charter and rental, conforms with
the intended use of the �rea. Mayor Searles
• repeated the Minutes of May 24, 1971 stating
the conditions subject to the approval of single
� docic usage,

of the North Star Marina for a single dock
� license on CY�ystal Bay be approved because of
� the unique positioning of the property, the
hardship due to the height restriction of the
� bridges having access to AZaxwell Bay, and
because of the prior license authorization for
� a service dock on the Crystal Bay side of the
roadway, and in recognition of the claim to
• riparian ownership of the shoreline of Crystal Bay.
� Tnat the dock be restricted to the use of one
� watercraft and the licensee by accepting the
permit acknowledges that the use cannot be
� extended beyond one watercraft and that the
watercraft be for the sole and private use
• of the owner of the land and his guests or
family and such use may not be commercial
� or quasi-commercial in nature. That tne dock
• rnay not be used as a service dock or as an
access dock for customers visiting the
� business premises, or other uses not personal
�to the ownero
That the licensee agrees that future zoning or
� shoreline use regulation may require the removal

the license application for the Wayzata Yacht �icense
Club to construct a dock at Morse Island Park,
Big Island, subject to staff review concerning
possible conditional uses in previous years.

After discussing concerns with fire hazards RESOLUTION #626
and overall uses of Big Island, Wayzata Yacht Club
� Butler moved, Paurus seconded, to adopt Conditional Use
Resolution #626 granting a conditional use
permit to the Wayzata Yacht Club to locate a
dock, picnic, playground and beach area on
Big Island subject to the following conditionso
la The use of the area shall be limited to
members of the �layzata Yacht Club and their
guests.
2, No structures may be built on the site
except for a dock and a small portable chemical
i sanitary facility.
3o Trash and refuse shall be removed from the
site daily by person or persons who brought
same to the site. No trash may be allowed to
accumulate on the site.
4. There may be no removal of vegetation from
the site.
5� There may be no permanent mooring or docking
of any type of boats at the site, with the
exception of the owner who may dock his boat
subject to other applicable regulations.
6o Any dock constructed or maintained on the
site shall conform to the Lake Minnetonka
Conservation District Guidelines and the
applicable ordinances of the City; the dock is
limited to 100 feet in length.
7. There may be no mooring buoys placed on the
lake adjacent to the site.
8. The applicant acknowledges the fact that
it has no vested rights to these permits in
the future and that the City may refuse to
grant similar permits for next year.
9. The City may revoke the permits if at any
time the appiicant or anyone uses this site
contrary to the applicable municipal ordinances
and the provisions of this resolution.
10, The applicant shall remove all structures
�nd the dock from the site by December 1, 1975
nless the applicant has �een granted permission
to maintain the dock and structures after
December 1, 1975,
11. The permits granted in this resolution shall
expire January 1, 1976.

properties in Orono that might be projected

1. That the property is a sma11, separate parcel,
a not contiguous to any other lands subject to future
subdivision, separated from such lands by a nature
trail and a golf course.
i 2o That the property is also adjacent to the
dense uses of the Wayzata Club house, road access
and parking area.
S 3, That the property is on a street leading
directly onto U.S. #12, with no intervening
, residences, cross roads, underpasses or other
traffic impediments.
4. That private sewage disposal arrangements
* appear to be available to this property, through
the Wayzata public sewage system, for the applied
for uses only, without committing other properties
to a similar usee
� 5. That there are no projected public improvements,
, projects �r highw�ys involving this land,
� 6, That t$e avaiLability of sewer, proximity to
adequate t�ansportation and other cited factors
�are consistent with the Comprehensive Plan.
After hearing comments from the residents in the
area,
Searles moved, Butler seconded, to adopt RESOLUTION #627
Resolution #627 to rezone the Herrick Circle Herrick Circle
property, 440 Old Long Lake Road, from RR-1B
(two acres} to R-lA (one acre) and granted
conceptual approval for PRD and a conditional
use permit for allowing six homes and instructed
� City staff to commence drafting a contractual
rezoning agreement conditioned ono
lo That all considerations and alternatives have
been explored,
� 2e That the applicant withdraw their original
rezoning request proposal of the Herrick property
from RR-1B (two acres) to R-1B (one-half acre)
and submitting a new proposal to request
rezoning from RR-1B (two acres) to R-lA (one
acre) allowing six single living units on this
six-plus acre parcel.
3, That the policy statement contained in the
April 22, 1975 Council Minutes, thata

shall construct and provide utilities that are
designed to serve the developed area only, would
be served by the City of Wayzata only, and would
not be sized for any future growth or reserve
capacity, would be consistent with the Village

revisions in the Orono Orchard Road Bridge to
� the City of Orono for approvalo
• This plan was very nearly the same plan submitted
in November of 1974. At that time, I met on the
� site with Gerald Philson of the Department of
� Natural Resources and it was determined that
to provide adequate sight distance on the
� street, it would be necessary to shorten the
west bent of the bridge by 6 feet, as well as,
to remove the east bent as proposed.
At that time, you indicated that the Department
of Natural Resources did not have funds in the
� 1975 budget for this extra work and that Orono
� could either pay the additional cost (approximately
$5,000) or wait and have the bridge constructed

these areas and a realistic approach in handling
