Regular Meeting of the Orono Council, 7: 30 P.M.
� April 22, 1975
The Orono Council met on the above date
with the following members presents Mayor
• Searles, Councilmen Paurus and Welsh.
. Councilmen Butler and Massengale absent.
� Paurus moved, Welsh seconded, that the MINUTES
� �Iinutes of the Regular Meeting of April 8,
1975, be approved. Motion, Ayes (3) - Nays (0) .

� The Mayor announced at 7:33 P,rs, that this PUBLIC HEARING
• was the time and place for the scheduled Highwood Water Petition
public hearing on the Highwood water petition.
� The Village Administrator presented the Public
Hearing Notice as follows: Notice is hereby
� given that the City Council of Orono will meet
in the Council chambers of the City Hall at
� 7e30 P.M. on April 22, 1975 to consider the
� making of an improvement on County Road #19,
North Arm Drive, North Shore Drive and Highwood
� Road, by constructing and extending a watermain
with hydrants to serve the abutting property,
ypursuant to Minn. Statutes, Secs. 429.011 to
429. 11I (Laws 1953, Ch. 398, as amended) . The
� area propased to be assessed for such improvement
is the property abutting on such roadse The
r estimated cost of such improvement is $57,750.00.
� Such persons as desire to be heard with reference
� to the proposed improvement will be heard at
this meeting.
• .
The village Administrator also presented the
� Affidavit of Publication and the Certificate
• of Mailing.
� The Orono Engineer presented projector slides
to the public hearing showing engineering
� estimated costs on a front foot basis, a unit
basis, an estimated 50' and 100' lot assessment
� cost and an overall assessed estimated cost of
$57,750 for the total project.
� After hearing from twenty residents from the
Highwood area presenting their views in regard
� to the water petition, the Mayor announced that
the hearing was closed at 7:59 PoM. and announced
that the Highwood water petition will be entered
�on the May 13, 1975 agenda for Council consideration.

� The antenna ordinanc� was discussed generally ANTENNA ORDINANCE
� by the Village Council and members of the
attending public. P�lr. Russell Lund, P�Ir.
George Johnson, Peter Clark, Herman Renner
and a represei�tative for Gayles Marina discussed
� their view points. Councilman Gary Welsh
presented additions and ommissions to the
• ordinance for Council review. The Mayor
instructed the Administrator to - agenda
� this matter for May 13, 1975 when all Council
� members would be present.
� T�Ir. Brad Van Nest discussed the concern of the RIPARIAN RIGHTS
Planning Commission and the need to address
itself to Riparian Rights, outlot requirements
• and lot requirements related to depth and width
for dock requirements. The Planning Commission
� �aill st�dy these needs and refer to the Council
at a later date for policy direction.
Searles moved, ti9elsh seconded, that the VARIANCE
� request for a lot area and width variance 1240 5pruce Place
for Cleon Hildens, 1240 Spruce Place, be
referred to the Planning Commission, 1�qotion,

� Mr. Podany appeared before the Council and VARIANCE
� presented a new proposal for an addition to 3285 Carman Road
his residence. Since this proposal had not
• been previously submitted or reviewed,
� Searles moved, Paurus seconded, to refer the
� new proposal to the Planning Commission.

variance for Roger Kraines, 4485 Forest 4485 Forest Lake
• Lake Landing, conditioned on combining Landing

Paurus moved, Welsh seconded, to approve V.ARIANCE
a variance from lakeshore and hardcover 1635 Bohn's Point Road
* setback for a 9° X 28' addition, conditioned
on 1) Will not increase hardcover area;
� 2) Since the existing structure is located
within the 75' setback the variance will
� allow only 4° of the 9 ' addition to extend
into the 75' lake setback requiremento The
balance of 5' shall be outside of the setback
requirement; 3) The addition is to the rear
of the existing house; 4) Applicant must
tear out existing blacktop. Motion, Ayes (3) -

A status report by Mr. Henry Muhich concerning HERRICK CIRCLE
Herrick Circle. A policy statement by the
Council stated that the developer, if the
� development is approved, shall construct and
provide utilities that are designed to serve
the developed area only, would be served by
the City of Wayzata only, and would not be
sized for any future growth or reserve capacity,
would be consistent with the Village Comprehensive
Land Use Plan, and with all costs being borne
by the developer.
Welsh moved, Paurus seconded, to deny a variance VARIANCE
� and refer to the Planning Commission when all 1465 Long Lake Boulevard
pertinent data is complete, based on: 1) Staff
reports that proposal plans do not meet Village
code standards; 2) Percolation test holes
were not properly sized; 3) Septic system
design does not meet engineer' s requirements;
4) Bank slopes do not meet engineering require-
ments; 5) All requirements are complete and
submitted by a certified engineer; 6) Required
� setbacks from proposed house and disposal system
are not clearly defined. Motion, Ayes (3) -
Nays (0) .
� Paurus moved, Welsh seconded, to approve a VARIANCE
variance for Kermit LaQuey, 190 Cygnet Place, 190 Cygnet Place
for lot area and width requirement subject to:
1) Approval of onsite septic design; 2) Proof
of date of transfer of ownership from Mr. Provo
to Mr. LaQuey. Motion, Ayes (3) - Nays (0) .
Paurus moved, Welsh seconded, to accept and BID AWARD
award the tabluation of bidders for street 1975 Road Materials &
materials and equipment for 1975 as presented Equipment
and recommended by the Village Administrator.
Motion, Ayes (3) - Nays (0) .
Welsh moved, Paurus seconded, that $12 ,970. 23 TRANSFER
be transferred from Federal Revenue Sharing to Federal Revenue Sharing
cover the expenses of remodeling the Tronrud
and Police buildings. Motion, Ayes (3) - Nays (0) .
Welsh moved, Paurus seconded, to approve the SALARY ADJUSTMENTS
Village Administrator' s recommendation and adjust Shirley Nelson
* the salary of Shirley Nelson from $9 ,000 to Charlotte Knutson
$8, 000 per year and Charlotte Knutson' s salary
from $7,530 to $8 , 000 per year, effective
April 21, 1975. Motion, Ayes (3) - Nays (0) .
Paurus moved, Welsh seconded, to eliminate the ELIMINATE POSITION
position of assistant treasurer for an indefinite Assistant Treasurer
period. Motion, Ayes (3) - Nays (0) .

recommendation of the Village Administrata� James �ric�on
terminating the employment of r�ir. James Erl,�sdh,
effective April 22, 1975. He shall receive hi.�
hourly rate for 16 hours (April 21, 1975 and
April 22, 1975) and 84 hours vacation due with
final total monies due amounting to $512.00.

Searles moved, Welsh seconded, to adopt the PERSONNEL POLICY
' Administrative Organization Policy as submitted
by the Village Administrator, and incorporating
the proper chain of command. It is the purpose
of this personnel policy to establish procedures
for all departments, staff, managers, directors
and administrators, which will serve as a guide-
yline to administrative action concerning personnel
matters and does provide all employees and the
public a statement of a personnel program for
Orono. Motion, Ayes (3) - Nays (0) .
Mayor Searles announced to the public that on WORK SESSION
Nzay 8, 1975 at 3:00 P.M. , the Council and the May 8, 1975
marina licensing committee will hold a work
session to review marina licenses for the 1975
season.
Reports concerning the Casco Point Deed and CASCO POINT DEED
Crystal Bay Lake Access were deterred until CRYSTAL BAY LAKE ACCESS
the meeting of May 13, 1975.
Searles moved, Paurus seconded, to adopt RESOLUTION #593
Resolution #593, a resolution directing staff Smith's Bay Access
to restrict use of lake access on Smith's Bay.

The Village Council instructed the legal �J1�CA�ED PROPERTY
department to address itself to the
ordinances and the Council Policy Statement
that all lots sha].1 be combined when a
property is vacated.

Resolution #597 approving the conditional Robert Day
use permit for Robert Day for an addition
onto an existing residence for security and
safety requirements. Motion, Ayes (3) -

The legal department reported on the status JOHN MORRISON COMPLAINT
of Nir. John M. Morrison's complaint relating 801 Tonkawa Road
to trees planted on Hennepin County right-of-
way which were removed during the sanitary
sewer ?3-1 project. The Village Council
instructed the legal department to submit a
resolution for Council review and approval
at their next meeting, May 13, 1975.
A progress report was presented concerning the LAND VACATION
Charles Spear land vacation. Charles Spear
Searles moved, Welsh seconded, to instruct SUMMONS
the legal department to defend the Village of Sabes & Hork
Orono as required in the plaintiffs' Henry Sabes
and Larry Hork summons served April 10, 1975.
