� Regular Meeting of the Orono Council, February 11, 1975 7:30 P.M.

• The Orono Council met on the above date with the following
members present: Action Ma.yor Massengale, Councilmembers
� Butler, Paurus, Welsh. Mayor Searles, Village Administrator
Benson, absent.
� Butler moved, Paurus seconded, the Minutes of the Regular DIINUTES
� b4eeting of January 28, 1975 with amendments be approved.

Paurus moved, Butler seconded, that the Mirnutes of the
• Regular Meeting of December 19, 1974, Work Session of
� December 13, 1974, Work Session of December 17, 1974,
Work Session of December 4, 1974, Work Session of
� December 18, 1974, Work Session of December 19, 1974
and Work Session of January 7, 1975, subject to changes
� as indicated by Attorney be approved. Motion, Ayes (4) ,

The reason why these minutes were not approved earlier
• was because of the snow and the volwne of these Minutes
to be checked with notes of these meetings. The changes
� are basically typographical and note taking errors.
� Discussion followed concerning the use of snowmobiles PARK COI�tISSION C�NTS
� on the Luce Line Trail. Luce Line Trail
� Welsh moved, Paurus secondeci that we designate the DNR
as proper authority to regulate the Luce Line Trail
� under local ordi.nance. Motion withdrawn with instruc-
tions to Village Attorney to review ordinance and
• statute and draft ordinance to cover.
• Park Corrunission presented Council with a snowmobile trail
� plan from #84 to the Luce Line east of Stubbs Bay Rd,
� Gretchen Ha.11owell presented Council with the Bike/Hike Bike/Iiike Trail System
Committee report, stati.ng they were informed by the
� Village Engineer that FAU funds could be applied for
which would finance 70o to Orono's 30$ of the cost of
� this trail system.
• Massengale suggested that Minutes be kept of these
� committee meetings and submitted to Council as an
information item.
� Butler stated that Hennepin County should be contacted
� for possible help in establishing these trails on
Tonkawa Road as this had previously been discussed
• with them.

� The proposed ordinance was presented to the Council. I-AlI�4AN RIQ-�'I'S COI�IISSION
� Butler expressed that she feels the name I-hunan Rights
should not be changed to I-1�mian Services. After con-
� siderable discussion, Paurus suggested tabling of the
proposed modification and presenting the ordinance to
i the I-Iuman Rights Corranission for their input.
� Butler moved, Paurus seconded, appointment and re- Appointments
appointment of the following to be members of the Orono
� Human Rights CoirIInission. Gail Breckwald, Ray Johnson,
' Donna Carlton, Doris Schroeder, Bernice Anderson, Betty
Phelan, Maura Zunt, Barbara DeCosse, Ma.ry Vogel, Julie
� Draar, Sandy Welsh, and a Mound school student. Motion,
Ayes (3) , Nay (0) . Abstain (1) , Welsh.

Brad Van Nest stated that the Planning C�ranission planned PLANNING CObMISSION COi�9�NTS
• to discuss the following items: (a) Licensing of building
contractors in Orono; (b) requirement to provide a cer-
� tified survey when applying for variance.
� Welsh moved, Butler seconded, that the variance request Martin Podany-Variance Rec�uest

� Muhich reported that the Marina. License Comonittee has ZONING � BUILDING AI�y.
held two meetings with five different marinas and with REpORT

Shore Drive marina have yet to be spoken to.

Van Nest pointed out that public access directly south Public Launching Area
� of Paul's Landing creates a hazard with people backing
� trailers onto Highway 15. Action should be taken to �
close this access to launching, Also directly south
� of Stubbs Bay h4arina is another problem launching area.
Massengale suggested Planning Commission and Park Com-
� mission ma.ke a recommendation.
• Mrs. Day presented Council with a rec{uest for a building Robert Day - Building Permit
permit to add on to their existing home, which is a Request
� legal non-conforming use in an industrial zone. Council 2685 Wayzata Blvd.
� directed City Attorney to investigate to see if there
is a possible legal way to grant this request. Action
� was tabled until next Council meeting.
� Discussion followed on granting a conditional use to Stubbs I3ay Marina.
Stubbs Bay Marina to have a "soup and sandwiches" food
• service not to include full course meals. Massengale
recmmnended tha.t a resolution be drawn up by staff and
� presented at the February 25 Council meeting indicating
� the conditions under which the conditional use permit
was granted, with findings stating why conditions at-
� tached are included in the conditional use.

• proposal, f�e was infonned that application for rezoning
to be made after Planning Commission and Council has
� established standards for new multiple zone as prescribed
in the Comprehensive Guide Plan and adopt a multiple
� ciwelling zone within the Zoning Cod.e. Planning Cmrnnission
to discuss a time table for these standards.
� Paurus suggested Council review what type of management
r and/or awnership �aould be established to insure welfare
of inhabitants.

Council reviewed our participation in the Southwest SOUTfi�NEST SANITARY SE�NER
• Sanitary Sewer District and the value for Orono. Massengale DISTRICT - APPOI.'�ITT�NT
. suggested we obtain a copy of their Charter or Bylaws for
Council informa.tion. Tabled until Ma.rch 11 meeting.

� City Attorney reported the Tyler's have listed this
property for sale. They admit there is no basis for T��R C�PLAINT STATCIS
� legal non-conforming use to use as a duplEx. The Jameson's �gl� I� P�CE
� stated they have entered into a rental agreement and will
be �noving A4arch 31. They will send our Attorney a copy
� of the rental agreement. The Tyler's will remove the car-
port on the small cottage. Status of cottage is uncertain
� at this point. Tt appears not to be a legal non-conforming
use.

� Council requested Dave Opheim, Chairman of the Park Com-
mission, be present at next Council meeting to discuss SKI TONKA STANS
� his activities regarding purchase of Ski Tonka.

� Brad Van Nest and Skip McCombs will meet with the Soil VILLAGE ENGINEER'S REPORT
Conservation Department regarding #1, map. Tabled until Comprehensive G�ide Plan

� Paunis moved, Butler seconded, that the Village Engineer Petition - Highwood Water
� be directed that upon legally submitted petition to go
ahead with feasibility study on Highwood Water Project.

� The Village Engineer discussed bike/hike trail and Bike/Hike Trails
explained the eligibility of the Village to receive
• FAU funds.
� The Council recommended a s�ep program over a period of

� c{ualify for funds, the trails �rnust be on both sides of
the road, 6' wide, hard covered, permitted to vary one
� block off the ma.in road.
� Paurus suggested that the Village Engineer proceed with
application for FAU funds, Park Commission Chairman to
• review with Council at rlarch I1 meeting.
� No action was taken on Long Lake Sewer � Water Petition Long Lake Sewer � Water

able.
� The Village Engineer repvrted that he was infornted there MSA Funds Report
� is no MSA money available for park and drive areas. Council
would like to have more research done in this matter.
