A It is the assumption of the Village Council, PARTENS POINT ` Orr-Schelen-r�ayeron, consulting engineers, and Village staff that there are no suitable substitutes for any alternatives to relocate utilities to prevent condemnation procedures for Partens Point. Easements - 73-1 � + RESOLUTION #�568 • AUTHORIZING TAKING OF EASEP-4ENTS IN LAND BY EMINENT DOMAIN � FOR SANITARY SE?�IER PURPOSES SANITARY SE��R PROJECT 73-1 tr7HEREA5, the City Council has ordered preparation of a resolution � authorizing the taking of an easement in land by eminent domain and the City Engineer has recommended the acquisition of easements in land for a sanitary sewer purposes at the locations hereinafter specified, and it � appears to the Council that it is necessary that the City acquire such lands, therefore, � BE IT RESOLVED by the City Council of Orono: � 1. That it is hereby determined that the taking in easement • of the tracts and parcels of land set forth in pagagraph three (3) hereof is necessary for the public good in order that said tracts and parcels shall be devoted to sanitary sewer purposes. � � CZCi70 COUNCIL MEETING OF JANUARY 14, 1975 Page 5 2. That the City shall take by right of eminent domain for �sanitary sewer purposes an easement in the lands described in paragraph three (3) hereof, and the City Attorney be hereby authorized and directed to commence proceedings in the District Court of Hennepin County for appointment of Commissioners to determine the damages, if any sustained by the respective owners of the parcels affected by such taking, as authorized by law, and 3. That the lands referred to above are more particularly described as follows< DESCRIPTION OF EASEMENT: A 20 feet wide permanent easement for sanitary sewer and lift station purposes over, under, and across Lot 13 Partens Point First Division according to the plat on file in the Office of the Register of Deeds, Hennepin County, Minnesota. The center line of said easement is described as followsa Commencing at the southwest corner of said Lot 13, thence easterly along the southerly line thereof 173,0 feet to the point of beginning of the centerline to be described; thence northerly to a point on the northerly line of said Lot 13, said point being 154.0 feet easterly of the northwest corner of said Lot 13 as measured along the northerly line of said Lot 13 ar.d said center line there terminating excepting therefrom the permanent structures thereon, And also a permanent easement for sanitary sewer and lift station purposes over, under, and across the northerly 20 feet �f said Lot 13 excepting therefrom the permanent structures thereon. And also an 80 foot wide temporary easement for sanitary sewer and lift " � station purposes over, under, and across said Lot 13 lying 40 feet on each side of the above described center line excepting therefrom the permanent structures thereon. � And also a temporary easement over, under, and across the northerly 50 feet of said Lot 13 excepting therefrom the permanent structures thereon. Said temporary easement expires December 31, 1975. DESCRIPTION OF EASEMENTs A 20 foot wide permanent easement for sanitary sewer purposes over, under � and across Lot 12 Partens Point First Division according to the plat on file in the Office of the Register of Deeds, Hennepin County, P�Zinnesota. And also a temporary easement over, under, and across the southerly 15 feet of said Lot 12 excepting therefrom the permanet structures thereon. Said temporary easement expires December 31, 1975. Adopted by the City Council this 14th day of January, 1975, by a vote of 4 ayes and 0 nays. The legal department discussed the status REZONING of the rezoning. Marina licensing was deferred until January 28, PdARINA LICENSING 1975 when a I�Zarina Licensing and B-2 Inspection B-2 Inspection Committee Committee will be appointed. This committee . will be designated by resolution each year thereafter. The Village Attorney presented a status TRANSPORTATIOiV P�1AP report of the future official transportation map. The Orono Attorney presented a progress REZONING MAP report of the future official rezoning map. The Orono Council instructed the Orono WATER PETITION �ngineer to present to the Council on Highwood Road January 28, 1975 a report documenting the percentage of affected property owners that have petitioned for water in the Highwood Road area. Motion, Ayes (4) - Nays (0) . Butler moved, Searles seconded, that the BILLS All Fund Accounts 18068 through 18261 and Liquor Store Accounts 10417 through 10464, be paid.
