State Building Code. This permit is for only the work described and dces
not grant permission for additional or related work which requires sepazate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if conswction authorized is not

Regarding items 2 and 4: In discussing this just now with Tom Dietrich of MCWD,the MCWD escrow will not cover the
same items we intend to have covered with our$20,000 escrow,such as cleanup of any messes or if the job stops and
we have to take some restoration action.
However,assuming the remediation work is covered under the LOC,we would release the escrow upon receipt of the
LOC.

Subject: Lakeview- Remediation & Demolition
Pat/Chase/Bruce—
Your request for proceeding with mercury contamination remediation and demolition of existing buildings prior to final
plat approval has been reviewed by the City Attorney and City Engineer. Our conclusion is that this would be acceptable
as long as no earthwork be commenced that would constitute site improvements. To that end,we would establish the
following conditions of approval:
1. Obtain a City demolition permit for the buildings. Permit fee plus$2,500 escrow required.
2. Obtain a City land alteration permit for the mercury clean-up. Permit fee plus$20,000 escrow required.
Escrows subject to our standard escrow agreement.
- The MCWD is requiring us to provide an escrow agreement to meet their requirements for erosion
control measures. Is this escrow really necessary?Just seems like we are counting for it in two places.
3. We will not require that the Development Agreement be signed prior to issuing these two permits.
4. We will not require the Letter of Credit to be submitted for this site cleanup work.
- If final LOC is in place,could you waive the above land alteration escrow?
5. Must submit copy of issued MCWD erosion control permits.

. ' � � 6. Perimeter erosion control must be installed by the Contractor and inspected by the City prior to any land
disturbance. Contractor must provide minimum 24 hour notice prior to work.
- Are you wanting the entire perimeter of the site to be protected ?This seems a bit excessive as a
majority of the perimeter will be undisturbed as it is conservation area.
7. Protection fencing must be installed around bioretention areas prior to land disturbance.
8. Provide City with copies of any other agency permits required for the remediation, and provide information
as to disposal site. Our intent is to have a clear understanding of all aspects so that we are in a position to
answer questions from the public if asked.
9. Preconstruction meeting required to review on-site and off-site haul routes,site access points, etc. (provide
a map)and to confirm for all parties the location and positive protection of septic sites and other areas where
vehicle traffic must be avoided.
10. The Contractor and City Engineer to review pavement on any City streets along haul route together to
confirm existing condition and document with pictures. The Applicant to be responsible for any repairs
necessary due to adverse impacts caused by hauling.
11. Developer to notify neighboring property owners prior to commencement of remediation activity and
provide developer's contact information to address any related concerns during remediation.
