A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 78-420(b)
, FILE NO. 07-3321
WHEREAS, Keith Nord, a single person, (hereinafter"Owner") is the owner
of the property located at 1245 Lakeview Avenue within the City of Orono (hereinafter
�"City") and legally described as: Lots 17 and 18, Block l, Maxwell's Addition to Crystal Bay
Lake Minnetonka Hennepin County,Minnesota(hereinafter "the Property"); and
WHEREAS, Keith Nord has made application to the City for variances to
Municipal Zoning Code Section 78-420(b) to allow a second story addition with a 29.8 foot
front setback when a 50 foot setback is a required, a 22.4 foot setback from the east proprty
. line when a 50 foot setback is required and a 23.3 foot setback from the westerly property line
when a 30 foot setback is required; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on October 15, 2007, at which times all persons desiring to
be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
l, This application was reviewed as Zoning File #07-3321.
2. The Property is located in the RR-1B zoning district, where 2 acres is the
minimum lot area and 200 feet is the minimum lot width. The Property is
approximately 0.33 acre in azea and 100 feet in width.
3. The Planning Commission reviewed this application on October 15, 2007 and
on a vote of 5 - 0 recommended approval of the variance, based on the
following findings:
. a. A house cannot be built on the lot without setback variances.

, b. The addition is necessary to make reasonable use of the pmperty.
c. The addition wili be compatible with the neighborhood.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission,reports by City staff, comments
by the apglicant and the pubfic, and the effect of the proposed vaziance on the
health,safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiaz
to it and do not apply generaIly to other property in this zoning district; that
granting the variances would not adversely affect traffic conditians, iight, air
nor pose a fire hazard or other danger to neighboring property, would not
merCly serve as a convenience to thc Owner but are necessary to alleviate a
demonstrable hardship or difficulty; are necessary to preserve a substantial
pmperty right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIUNS,ORDER AND CONDITIONS
Based upon the above findings, the Omno City Council hereby grants a variance to Orona
Mtuiicipal Zoning Code Sectian �8-420(b) to allow a second story addition with a 29.8 foot
front setback �vhen a 50 foot setback is a required, a 22.4 foot setback from the east proprty
line when a 50 foot setback is required and a 23.3 foot setback from the westerly property line
when a 30 foot setback is required,subject to the fotlowing conditions:
, 1. Council appraval is based on the site and hoase plans submitted by the Qwner
and annotated by City staff, attached to this Resolution as Exhibits A. and B.
Any amendments to these plans may require further Planning Commission and
City Council review.
2. Authorities granted hy this resolution run with the PropeRy not with the
Owner, but aze permissive oniy and must be exercised by obtaining a building
permit for the new construction befare October 22, 20U8 or the variance will
' expire on that date.

3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
ternunate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of his heirs, successors and assigns, hereby agree
to the recording of this resalution in the chain of title of the property.
Adopted by the Orono City Council on this 22nd day of October, 2007.
