�'��., WHEREAS, the City of Orono is a municipal corporation organiz
,�;; and existing under the laws of the State of Minnesota; and
~�; WHEREAS, the City Council of the City of Orono has adopted
�. +_:.� subdivision regulations for the orderly, economic and safe develop
�` `:�� of land within the city; and

. n '�� WHEREAS, the City Council has considered the application for
�" a subdivision plat by Crosstown Associates, the subdivider; and
WHEREAS, the subdivider has completed all requirements of the
"`:-��:="' platting regulations of the City, including:

� �.,,�,. Execution of a developer' s agreement with the City.-
�`�'� Creation of a homeowner' s association acceptable to the City.

�"`` � cA Dedication of required drainage and utility easements.

�'"`�"' Dedication of public streets and roads.
��° , Dedication of access easements underlying Outlot G. �
' �'" Dedication of open space and flowage conservation easements .-�

�`� �'� NOW, THEREFORE, BE IT RESOLVED, that the City Council of the

. 1. The aforesaid plat shall be filed with the Hennepin County
Recorder' s Office on or before August 30� 1978, together with
� �:�;� a certified original copy of this Resolution, drainage and
� � utility easement document, underlying access easement document
'- for Outlot G, and open space and flowage conservation easememt
,� � for Outlots B and C.

� �,r 2. The completion of all requirements of the Developer' s Agreemer
� between Crosstown Associates and the City of Orono.

�.��'�,� 3. Outstanding water and sewer special assessments will be evenly

�.v;-:�;T ' divided between the five lots in blocks 1 and 2.

� '�''�`�' 4. Building permits will not be issued for lots 1 and 2, block 1

° ��;� , � and lots 1, 2 and 3, block 2 until the City Engineer issues a
" �� certificate of substantial completion for the road improvement
to Outlot G and the sewer and water extentions to these lots.

� - ?;�� S. The City of Orono hereby finds that lots 1 and 2, block 1
' � � and lots 1, 2 and 3, block 2 are not riparian to Lake Minnetor
;;, .-, The approval granted by this Resolution shall expire if the plat
°�`�' has not been filed by the date specified above. In that event, it
�':�-�=�- will be necessary to file a new application with the City of Orono
:�=�::�> for subdivision review.
