CITY OF ORONO
Regular r�ieeting of the City Council, 7:30 P.I�1.
April 8, 1974
� The City Council met on the above date with
� the following members present: T�ayor Searles,
Councilmen Butler, �•iassengale, Paurus, and
?aelsh.

Butler moved, Welsh seconded, that the t�IINUTES
l�iinutes of the Re,gular I�teeting of March 25,
� 1974, be approved. Motion, Ayes (5) - Nays (0) .
T�iayor Searles opened the Public Hearing PUBLIC HEARING
concerning the water project in the Hackberry Hackberry Hill Water
Hill area at 7: 40 P.t�. The City Administrator
� presented the Notice of Public Hearing, the
Affidavit of Publication, and the Certificate
of Ilailing to affected property owners. After
all members present were afforded an opportunity
to be heard, the hearing was closed at 8:40 P.M.
Paurus moved, Butler seconded, that the VARIANCE
variance for John Anderson, 4191 North Shore 4191 North Shore Drive
�rive, be referred to the Planning Commission.

Paurus moved, Butler seconded, that the VARIANCE
� variance for Frederick Riebel, 440 Stubbs 440 Stubbs Bay Road

Paurus moved, Butler seconded, that the STREET VACATION
�equest for a street vacation for Dale Matson, 2200 Bayview Place
� 2200 Bayview Place, be referred to the
Planning Commission. Mo�ion, Ayes (5) -

Paurus moved, Butler seconded, that the SUBDIVISION
request for a subdivision for Hugh Harrison, Long Lake Boulevard
Long Lake Boulevard, be referred to the

Butler moved, Paurus secondec�, to approve BUILDING PERMiITS
the building permit applications for Mr. Lot 1, Block 2
� Van Ee4khout, for Lot 1, Block 2, and Lot 2, Lot 2, Block 2
Block �. It is the Council' s feeling that Webber Hills
r, these two building permit issuances were not
inconsistent with the comprehensive plan and
that an exception to the moratorium will in no
way conflict �aith the overall objectives and
• planning directives of the City. P�2otion,

Butler moved, Welsh seconded, to approve BUILDING PERMIT
�Zre Van Eeckhout' s building permit for Lot 10, Lot 10, Block 2
lock 2, in accordance with the diagram in Webber Hills
♦ which Mr. Van Eeckhout and Skip McCombs drew
up and agreed upon during the Council meeting
and also with the condition that additional
information as required by Mr. McCombs will
also be approved by him before the building
� permit �aill be issued. It was again felt
that the issuance of this building permit
S is not inconsistent with the comprehensive
plan directives and intent of the City and
! an exception to the moratorium be granted.

� The City Council discussed the issue of Ski SKI TONKA
Tonka and directed the Zoning Administrator
to complete his report on various aspects which
are of concern to the Council. The Council,
therefore, directed that this item be tabled
until the reports from Mr. Ivlarston are ready
' to be submitted to the Council.
The Council directed that a special Council SPECIAL P�S��TING
•*►eeting be held Monday, April 15, 1974 at Rezoning
e30 P.I�-Z. in the City offices for the purpose
of discussing the rezoning proposals which
have been forwarded from the Planning Commission
which are in conjunction with the City' s
Comprehensive Land Use Plan.

5earles moved, Butler seconded, to state SPECIAL MEETING
�that it is the sense of the Council that I.D.S. Proposal
� conceptual approval for the I.D.S. proposal
will be given as described in draft No. 4
and as described in the amended and corrected
iYlinutes of the Planning Commission with all
conditions being subject to final Council
approval. It is to be understood that no
rights are being conferred to I.D.S. as a
result of the Council sense of conceptua�
approval being done. It is further the
« desire of the Council to call a special
Council meeting on Saturday, April 13,
1974 at 2:00 P.I�Y. to be held in the City
Council Chambers to further discuss the
� conditions witri I.D.S. T�lotion, Ayes (5) -

` The City Council instructed the City PROPOSED RESTAURANT
' Administrator to table the Roelofs & Zean- 3282 North Shore Drive
chock proposed restaurant proposal, 3282 Nprth
� Shore Drive, until such time as the zoning
issues of the City have been answered and
� the City Council feels that it is in a
�position then to take action on this request.
� The City Council instructed the City NORTH STAR T•iARINA
Administrator to forward to the Planning
Commission the North Star i�arina request
� to attempt to resolve the issues of land
storage vs. water slips. In adciit;ion, the
�r City Administrator is to write a letter to
� the L.M.C.D. requesting that the L.ifI.C.D.
review the application in light of the same
� matter. The Administrator will then put the
Vorth Star Marina application back on the
s Council agenda after the staff has received
the reports from the Planning Commission
S and the L.M.C.D. The Council further
directed the City Attorney to review P�iika
� Scheller' s inspection report of the North
Star r4arina facilities. The City Attorney
at this time, reminded the Council that there
were three issues to be decided: 1. the
seawall and dredging; 2. concerns water slips
themselves; 3. the issue of land storage.
The City Council at this time instructed the CASCO POINT PARK D�F,
City Attorney to tile the Casco Point park
deed.

Resolution #536, a resolution concerning Ring Routes

� The City Council instructed the City RELATE
�Administrator to refer the Relate request
back to the Human Rights Commission in view
• of the fact that an orqanizational split has
occurred within Relate.

� Paurus moved, Welsh seconded, to approve JOINT DOCR LICENSE
� the Foxhill application for slips. The Foxhill Association
Council will approve eiqht slips for this
� year only and it is the Council's desire
that the Foxhill Association will present
• on a yearly basis the number of actual boats
that they have to be put into the water and
� that the lice�se wi1Z grant the number of
� slips each year to correspond only to the
number of actual boats in existence. The
� Council further stipulates that the maximum
number of boat slips that will ever be
� authorized will be sixteen. These stipulations
are to be considered permanent. Motion,

Resolution �537, A resolution supporting C. C. Ludwig Award
�Victoria Joyner for the C. C. Ludwig

• Butler moved, Welsh seconded, to approve RESOLUTION #538
� Resolution �538, a resolution ordering in Sewer Project 73-1
the Sanitary Sewer Project 73-1. Motion,
� Ayes (5) - Nays (0) .

Paurus moved, Butler seconded, to approve 1974 STREET PROGRAM
• the 1974 Street Sealing Program and directing
the Superintendent of Streets to draw up
� the bids and go forward with the project.

� T�Ir. John Eidem, the Orono Liquor Store Manager, LIQUOR STORE MANAGER
� appeared before the Council to provide them
with additional information on the liquor
• store op�rations.

� Paurus moved, Butler seconded, to appoint A4r. POLICE TRAINING
Jerry Ross as the official agplicant for the ACTIVITIES
�City of Orono to apply for reimbursement funds
oncerned with police training activities.

The City Attorney had no comments at this time CITY ATTORNEY REPORT
- -egarding the Ledstrom lawsuit or the new
� election laws.
� The City Engineer made a report concerning NORTH�?ESTERI�1 BELL �ELE.
� Northwestern Bell Telephone permit and no Permit
Council action was required.

• The City Engineer gave additional information �iETRO IDITERCEPTOR
concerning the T`Zetropolitan Interceptor
� Sewer line and the streets that it will be
� crossing in the City of Orono.

Paurus moved, Butler seconded, to approve
• the dog kennel license for Charles Hays, KENNEL LICENSE
3515 Sixth Avenue North, subject to the 3515 Sixth Avenue North
� limitations of only allowing five dogs at
