Permit Conditions Initials
Prior to the start of framing, a foundation as-built survey must be submitted �
and approved by the City or a stop work order will be issued.
Schedule a minimum of one hour for the framing inspection. �l

Erosion control mechanisms must be installed and inspected by the City
proper to any land disturbing activities. The contractor must provide a
minimum of a 24 hour notice prior to inspection.
Erosion control shall be installed and maintained throughout the entire
project and must remain until vegetation has been established.
Protect septic sites with snow fencing or metal stakes and caution tape.
No underground sewer within 20 feet of well.
Prior to the issuance of a Certificate of Occupancy an as-built survey must
be submitted and approved.
In the event of winter or other unfavorable weather conditions (which
prevent the completion of the exterior improvements and/or as-built
survey) a Temporary Certificate of Occupancy (TCO) may be necessary. A
TCO requires a $10,000 escrow.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading,
sidewalks, retaining walls, etc. not currently shown on the approved survey
and landscaping plan will require a separate Zoning Permit application to be
submitted and approved prior to the work commencing.
Any retaining walls that are over 4-feet in height or tiered walls not
separated by twice of the height of the lower wall require engineered plans
and a building permit to be submitted and approved rp ior to construction.

Our engineer has reviewed the survey dated 12-7-2015 and has the following comments:
1. The plan depicts two curb cuts for the driveways. City code only allows one (Section 18-136). Also, if a parcel of
land has frontage on both a cul-de-sac portion and a lead-in portion of the public road,the driveway shall be
constructed off the lead-in portion of the road and not the cul-de-sac. (Section 18-81)
2. The plan depicts retaining walls.The City Survey standards retaining walls require top of wall and bottom of wall
elevations to be called out(Survey requirement#23). Walls 4' or greater in height must be designed by a licensed
professional,and plans must be submitted to the City for review prior to the approval of the permit. Tiered walls
are considered one wall unless they are separated by at least twice the height of the higher wall are considered one
wall.
3. The erosion control plan is not depicted. Plans should include the locations of erosion control measures such as silt
fence, bio rolls, construction entrance and any other BMPs appropriate to the site. (Survey requirement#24) The
erosion control measures must be installed and inspected by a city inspector before any earthwork commences.The
applicant must provide a minimum 24 hour notice prior to inspection.
Please address the comments above and submit an updated survey for our review.

Our engineer has reviewed the survey dated 12-7-2015 and has the following comments:
1. The plan depicts two curb cuts for the driveways. City code only allows one(Section 18-136). Also, if a parcel of
land has frontage on both a cul-de-sac portion and a lead-in portion of the public road,the driveway shall be
constructed off the lead-in portion of the road and not the cul-de-sac. (Section 18-81)
2. The plan depicts retaining walls.The City Survey standards retaining walls require top of wall and bottom of wall
elevations to be called out(Survey requirement#23). Walls 4' or greater in height must be designed by a licensed
professional, and plans must be submitted to the City for review prior to the approval of the permit. Tiered walls
are considered one wall unless they are separated by at least twice the height of the higher wall are considered one
wall.

On November 19,2015 the City received a building permit application for a new single family home. Staff conducted a
preliminary review based on the information provided and recommends the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. A survey dated 11-17-15 was provided; however it does meet our survey standards,
specifically:
a. Please reference the top of foundation elevation. Also show the location on the perimeter of the
foundation where this elevation is in reference to. This same location should be referenced when
submitting the foundation as-built survey.
b. The survey does not show any proposed grading.
Please provide two copies of an updated, full size certificate of survey which meets all of the City's survey
standards(enclosed). Please note our engineer has not reviewed the survey,so additional comments may be
forthcoming.
2. Landscape Plan. Prior to the issuance of the building permit a landscape plan must be submitted showing all
the proposed exterior/landscaping improvements, i.e.patios,grading,sidewalks,retaining walls,etc. The plan
should include the name of the individual performing the work. The landscape plan should match what is
shown on the survey.
3. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek Watershed
District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-0590 regarding
your project. Please note,the City of Orono will not issue a building permit without a copy of the MCWD permit
or documentation stating the proposed project does not trigger any of their permitting requirements.
4. Separate City Permits Required for:
a. Septic

I confirmed today that there are no wetlands at 515 Kokesh Farm (other than the pond, which we will
not be regulating as a wetland since it was created in 2001 from upland).
So, you will not need to get a wetland delineation performed or provide wetland buffers when you
submit an MCWD permit application for the construction of a single family home on this site.

height must be designed by a licensed professional, and plans must be submitted to the City
for review prior to the construction. Tiered walls are considered one wall unless they are
separated by at least twice the height of the higher wall. Since these wall are already
constructed, if they exceed the parameter requiring and engineered plan the builder should
provide inspection reports signed by a licensed professional engineer.

TEMPORARY CERTIFICATE OF OCCUPANCY
ESCROW AGREEMENT
Orono Building Permit#2015-01489
AGREEMENT made this a' _day of � , 20�� by and befinreen the CITY OF
ORONO, a Minnesota municipal corporation ("City") an Mark&Anita Litecky("Owners").
Recitals
1. Construction of the new residence located at 515 Kokesh Farm Road the ("Subject
Property"), legally described as Lot 1, Block 1, Kokesh Farm in Orono, Hennepin County
Minnesota, is the subject of building permit application number 2015-01489 has been
completed.
2. Winter conditions currently prohibit completion of exterior improvements,final grading, and
vegetation establishment. An as-built survey cannot be accurately conducted at this time.
3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners
so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$10,000 with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning,engineering, in excess of$500,
or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with
expenses the Owners would be responsible for under a building permit application. The escrow will also
guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work
is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the
work(including planning, engineering, or legal consultant review) associated with building permit#2015-
01489 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the
Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have been
successfully completed and whether it is appropriate to retum the funds. Owner may also request the
release of the funds, and such funds shall be released upon City Staff receiving the appropriate verification
that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose of
inspecting and completing any exterior improvements, final grading, establishment of vegetation and the
restoration of the subject property should the Owners not complete the work by the specified dates.

BUILDING PERMIT ESCROW AGREEMENT

Recitals
1. A building permit application has been filed for New home located at
515 Kokesh Farm Road the {"Subject Property"), legally described as
Lot 1 Blk 1 KOKESH FARM
2. Owners request the City to review this application wliich requires City approval and may require
consultant legal and/ar engineering review.
3. The City will commence its review of the application and incur costs associated with said review only if
the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
