Melanie,
Here is the updated survey with our new heights. I had our surveyor go through and check to make sure it all
works. We basically dropped the house into the ground like you suggested but we needed to bring up the front wall of
our foundation to the same height as the main level to make the driveway work. If you need more info than this for our
approval just let me know. We are in the process of making the change to our plans right now. I just didn't want to start
that until we knew the heights worked for you.

OK, so, you're dropping everything 2.8 feet resulting in a TOF at 1029.5...? If so you are looking at the first floor to be
1031.5 or 1031.2. Right?
What is your perimeter measurement for house (in the ground) at the 1025.5 contour? By my calculation your perimeter
is 256.5 feet so you need at least more than 128.25 to be within the 1025.5 contour or higher (the street side). Does
your measurement work? (I can't print to scale to measure).

From what I calculated, we have to be at a 1025.5 contour from our point of ineasure. I put were I thought was the
starting point of that in red. So our top of foundation would be 1029.5. I haven't made any other changes to the cert yet,
just want to see if this will work. Let me know if you have any questions.

We have conducted the zoning review of the proposed home. The lower level of the home does not meet the City Code
definition of a basementand therefore is a considered story;it appears that proposed home has 3 defined stories which
exceeds the 2-�/z story limitation.
Attached is our information sheet on Building Height which further explains how we calculate the number of stories for a
home with a basement or crawlspace. According to our review, the first floor elevation (FFE) is proposed at 1034.1'..
The existing contour of elevation 1028.1'(1034.1' minus 6' per our code = 1028.1') is our point of ineasurement for the
more than 50% determination. By our calculation the perimeter of the home is 256.5 linear feet (50% of that number is
128.25 linear feet). As measured it appears the portion of the home meeting the basement definition is only 110.5'which
is approximately 18 linear feet short. The first floor will need to be adjusted/lowered 1-2 feet in my estimation to make
the calculation work. One other option is to excavate storage space under the garage...
I will be in a meeting for the next 45 minutes or so but would be happy to discuss a solution when I am finished.

Basement means that portion of a building that is partly or completely below the existing ground level. A basement
shall be considered as a story for purposes of determining the number of stories in a building, when the finished surface of
the floor above the basement is more than six feet above the existing ground level for more than 50 percent of the
basemenYs perimeter. The perimeter of the basement does not include portions of the house or garage that do not have a
lower level but are merely"unexcavated". Artificially raising the grade adjacent to the foundation of a structure (by filling or
by a combination of filling and retaining walls) above the surrounding natural terrain shall not be allowed as a method for
converting a defined story to a defined basement, regardless of any other benefits to the property of such action. Finished
grade that increases more than one foot from existing ground level shall be considered as artificially raising the grade.
However, artificially raising the grade when such action merely restores a previously excavated site to its original natural
grade may used as a method for converting a defined story to a defined basement.
Building height means the vertical distance between the highest adjoining ground level at the building or ten feet above
the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or
the uppermost point on a round or other arch-type roof, or the median height of the highest gable of a pitched or hipped
roof. Topographic changes which elevate the adjoining ground level above the existing terrain shall not be considered in
determining building height. For a pitched or hipped roof situation, regardless whether the highest living space in a
building is a half-story or full story, if the highest living space contains windows (excluding skylights)the upper measuring
point for defining building height shall be the median height of the top of the highest window and the highest peak of the
roof.
Story means that portion of a building included between the upper surface of a floor and the upper surface of the floor or
roof next above. It is measured as the vertical distance from top to top of two successive tiers of beams or finished floor
surfaces and, for the topmost story, from the top of the floor finish to the top of the ceiling joists or, where there is not a
ceiling, to the top of the roof rafters. A story that meets the definition of a "basement" shall be considered as a basement
and not as a story for purposes of determining the number of stories in a building.

REQUIREMENTS OF THE CODE.
NOTES
1. THE FOOTING BOULDERS ARE TO BE BURIED INTO VIRGIN MATERIAL OR ENGINEERED FILL AS SHOWN IN
THE WALL SECTIONS ALONG THE ENTIRE LENGTH OF THE WALL.
2. GRADE AT BASE OF WALL SHALL BE IN ACCORDANCE WITH THE CERTIFICATE OF SURVEY PRODUCED BY

TEMPORARY CERTIFICATE OF OCCUPANCY
ESCROW AGREEMENT

AGREEMENT made this�day of r , 20� by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and Gon Homes("Owners").
Recitals
1. Construction of the new residence located at 180 Kintyre Lane the ("Subject Property"),
legally described as Lot 1, Block 2, Kintyre Two, Hennepin County Minnesota, is the
subject of building permit application number 2013-00582 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2013-00582 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when the review has been completed and wr'itten notification is received from the Owners
requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.

7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete he work by the specified dates.

3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
