TEMPORARY CERTIFICATE OF OCCUPANCY
ESCROW AGREEMENT

AGREEMENT made this�day of , 20 1�by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and Gonyea Homes ("Owners").
Recitals
1. Construction of the new residence located at 140 Kintyre Lane the ("Subject Property"),
legally described as Lot 2, Block 2, Kintyre Two in Orono, Hennepin County Minnesota, is
the subject of building permit application number 2015-00950 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements,final grading, and
vegetation establishment. An as-built survey cannot be accurately conducted at this time.
3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners
so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit a10,000 with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of$500,
or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with
expenses the Owners would be responsible for under a building permit application. The escrow will also
guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work
is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the
work(including planning, engineering, or legal consultant review) associated with building permit#2015-
00950 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in tum send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the
Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have been
successfully completed and whether it is appropriate to return the funds. Owner may also request the
release of the funds, and such funds shall be released upon City Staff receiving the appropriate verification
that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. if the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose of
inspecting and completing any exterior improvements, final grading, establishment of vegetation and the
restoration of the subject property should the Owners not complete the work by the specified dates.

Our engineer has approved the survey dated 8-20-2015, but please note, if during construction it appears the retaining
wall will be over 4 feet in height an engineered design must be submitted and approved prior to its construction.
Also,we have recently changed our survey requirements, copy attached. One of the new requirements is to show the
point or spot where the top of the foundation elevation reference elevation point is being measured from;we expect
this to be consistent with the measurement on the foundation as-built. Please show the measurement point on the
survey and drop off or mail two full-size copies of the survey so we can finalize our review and issue the building
permit. This same location should be referenced on the foundation as-built.

After we spoke I had our engineer review the survey dated 8-20-2015 and noted one of the retaining walls on the north
side of the house still measures 4.3 feet in height. I have left a message for David at Sathre-Bergquist to call me and
have copied him on this email also. Engineering is needed for retaining walls over 4 feet in height. Please don't
hesitate to contact me if you have any questions. After the survey is updated we will need two,full-size copies to
review.

On July 28, 2015 the City received a building permit application for a new single family home at 140 Kintyre Lane. As
you know on August 13, 2015 an unresolved development issue was finalized. Staff conducted a preliminary review
based on the information provided and recommends the following items be submitted or revised in order for your
application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The City Engineer has reviewed the revised survey dated 8-20-2015. Please provide two
copies of an updated survey addressing the comment below.
a. The northwest retaining wall is shown at 4.3 feet in height. Walls over 4 feet require an engineered
designed plan signed off by a licensed engineer. Please provide.
2. Landscape Plan. Before we will issue the building permit we need a landscape plan for the property. The name
of the landscaper performing the work must be shown on the landscape plan. Copy of Ordinance 146, Third
Series is enclosed.
3. Separate City Permits Required for:
a. Septic
The above information is required in order for the plan review to continue. Please feel free to contact me at

You asked me to comment on the tall wall framing at the stairwell. Frame the tall wall at the stairwell with 2X6#2 SPF at
16"OC. Use a minimum of(2)2x6#2 SPF between each window at the upper IeveL You may support the headers above
those windows with inverted flange hangers installed to the sides of the double studs. Use Simpson Part#MUSC28 or
HUSC28(or equal) for double 2X10 header.
You also asked that I review the tall wall at the sport court.Frame these walls with(2)2X6s#2 SPF @ 12"centers.

An inspector should conduct a site visit and confirm the following:
1. The survey accurately depicts conditions on the ground.
2. The site is stabilized to the point the any remaining erosion control can be removed.

The Zoning Permit Application for landscaping/minor land alteration permit has not been issued. The proposed
landscaping appears to be complete per the as-built survey submitted. Mike should stop by the office so we can issue
the permit. Please note, because the work was completed without an issued permit, an after-the-fact, double fee will
be applied to this permit.
Please confirm all disturbed areas have been established with vegetation before I send an inspector to the site.
