Dear Christine,
As requested, we have completed an engineering review of the documents submitted for the above
referenced project. Our current review is based on the following submittal items:
• Certificate of Survey prepared by Sathre-Bergquist, dated 6/25/14
• Building Plans prepared by Gonyea Homes, dated 6/30/14
• Grading Plans prepared by Gronberg &Associates, dated 6/23/10
We offer the following observations, comments, and recommendations for your consideration:
l. Additional grading detail should be provided on the northwest corner of the house to ensure runoff is
not directed into the building. Contours should be revised to provide swales that are a minimum 0.5'
below the grade at the house. Additional spot elevations may be necessary to provide sufficient
detail.
2. Retaining walls 4' or greater in height are proposed. Any walls 4' or greater in height must be
designed by a licensed Professional Engineer, and plans submitted to the City for review and
approval. Multiple walls less than double the height of the bottom wall apart shall be considered one
wall.
3. Silt fence should be indicated on the plan down gradient from all proposed work.
4. The septic sites should be indicated on the plan, and protection fencing should be installed around the
sites to ensure they are adequately protected during construction.
5. The silt fence and septic site protection fencing should be installed and inspected by the City prior to
any land disturbing activities. The Contractor must provide a minimum 24 hour notice prior to
inspection.
6. A financial security of$2,500 from the Applicant is recommended for erosion control and
engineering oversight. The financial security is intended to provide protection in the event that it
becomes necessary for the City to install or maintain erosion and sediment control within the project
area and covers the cost of vegetation re-establishment if the applicant is unable to follow through
with the conditions of approval.
7. The applicant will be required to obtain Minnehaha Creek Watershed District(MCWD) approval and
permitting for their Erosion Control Rule. A copy of any approvals or permits required should be
submitted prior to any work.

Per your request,I examined the main level garage(right)elevation of the address above for compliance with the Minnesota
State Building Code(2006 IRC)bracing requirements. Your plan notes that you will be sheathing the entire exterior of the
building with OSB (method 3)permitting the use of R602.10.5 Continuous wood structural panel sheathing. Please note
IRC Figure R602.10.5 Typical Exterior Corner Nailing....Stud to Stud Nailing required for the continuous method. The
continuous method permits effective wall lengths as short as 30"for a 10' ceiling adjacent to a window opening. .
The attached sheet,BP-1,indicates the location of braced wall segments for the garage elevation of the main level of this
house and the location of portal frames. See details S 1.
A basic assumption of IRC bracing is that the rest of the structure is properly constructed and connected per the appropriate

ESCROW AGREEMENT

AGREEMENT made this��day of�� , 20� by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City°)and Gonyea Homes ("Owners").
Recitals
1. Construction of the new residence located at 125 Kintyre Lane, the ("Subject Property"),
legally described as Lot 3, Block 1, Kintyre Two, in Orono, Hennepin County
Minnesota, is the subject of building permit application #2014-00685 has been
completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2014-00685 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have
been successfully completed and whether it is appropriate to return the funds. Owner may also request
the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

BUILDING PERMIT ESCROW AGREEMENT
" ' Orono Building Permit#2014-00685
AGREEMENT made this b day of , 20 � , by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Gonyea Ho s("Owners").
Recitals
1. A building permit application has been filed for a new single family residence located at
125 Kintyre Lane the ("Subject Property"), legally described as Lot 3, Block 1, Kintyre Two, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The City will commence its �eview of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2013-00582 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
