Searles , and Stubbs. Searles moved, Butterfield seconded, that P�iINUTES � . the Minutes of the Regular Meeting of August 25 , 1969 , be approved as written,_ rRotion , Ayes (5) - Nays (0) . Butterfield moved, Stubbs seconded, that RESOLUTION #292 Resolution #292 , A Resolution Authorizing Hennepin County Park Reserve District To Acquire Property jn The Village Of Orono, subject to adding the nrovision "The Park Reserve District shall not have the use of the right of eminent domain to acquire property for the park in the Village of . Orono" , be adopted. A�otion , Ayes (5) - � Nays (0) . Butterfield moved, Stubbs seconded, that PARK RESERVE DISTRICT the Administrator, Village Attorney, and Road Aqaintenance the representative from the Park Reserve District meet to solve the differences between the t�ao dxaft propos�d Agreements concerning road maintenance and weeds . Franzel moved, Butterfield seconded, to DIVISION modify and accept, when filed, a final 3560 Ivy Place plat sho��ring a 30 ' road easement, and a 20 ' open space easement , only £or the purpose of prohibiting building thereon , on the plat , together jaith a 100 ' turnaround. Motion, Ayes (5) - Nays (0) . Franzel moved, Butterfield seconded, that LAND FILL we notify T4r. Larson that the t.im�irig is 3505 tVayzata Boulevard premature and not quite right for a commercial zoning because of the lack of services available , such as seiaer and water, in the area. Also, that we ask for (1) a ' ' grade plan on the land fill ; tell him on zis application for commercial zoning we .aill (2) refund his money , but if he insists , we �aill go ahead caith a public hearing even thougli it is premature. Stubbs moved, Butterfield seconded, that STREET VACATION we grant a vacation of the right of way 3295• 3309 Crystal Bay Road betiaeen Crystal Bay Road and the railroad tracks with a utility easement to be retained and the sewer assessment be levied a�ainst the property. It is understood that the vacation is not to include any property between Lake ;�4inne- tonka and lF�t Crystal Bay Road. Motion , Ayes (S) - Nays (0) . Franzel moved, Butterfield seconded, that MARIyA LICENSE the rec{uest of Henry Ari�.erson, 3350 North 3350 North S?iore Drive Shore Drive , for a marina license , be approved for 1969 and teil tliem we will n�t issue a license for 1970 unless they comply �vith the side setback regulations of ten feet. Stubbs moved, Franzel seconded, that Orono ORONO-LONG LAKE CONTRACT pay an additional $1 ,25D to Long Lake on the Fire Contract for 1969--total , $3 , 750 ; and also, that lve send Long Lake the full cost of the proposed 1970 Police Bud�et , including P.E.R.A. , etc. and that we inform chem we feel that two times .. the rate for the seiaer and taater contract is adeQuate and this is all we will pay. Franzel moved, Butterfield seconded, that FEASIBILITY REPORT the Engineer be authorized to prepare an D4unicipal Water additional report on feasibility of municipal water in view of the areas desiring water, as shown by the straw poll, A4otian, Ayes (5) - Nays () . Butterfield moved, Franzel seconded, to PENALTY invoke the $50 per day penalty on P1eha1 Co. , P1eha1 Company beginning September 11 , 1969 , if the Old Crystal Bay Road project is nat entirely completed by that date. b4otion, Ayes (S) - Na�s (0) .
