Dear Ms. Turner:
� This letter is intended to address the issues brought to light in the letter from John Smyth dated
5/9/08. The specific issues included: a request for a Management/Landscape Plan(See Attachment 1),
a new survey showing the buffer, and legal description for the upslope edge of the buffer (See
Attachment 2),Restrictions and Covenant for Wetland and Buffer(See Attachment 3),buffer markers,
and an explanation of treatment provided by the buffer.
The wetland buffer marker is described as the area between the wetland edge and below the
retaining wall. This boundary will be a sufficient boundary identifier for the land owner who will have
access to the buffer area. The wetland buffer has an average width greater than 27 feet across the width
of the property. This buffer when planted with a tall native wetland buffer mix will provide stellar
treatment of stormwater draining into the wetland once it has established. Until the buffer area is
established, erosion control methods and routine maintenance will shield the buffer area, and slow
stormwater draining into the basin. If you have any questions about this letter or its attachments,please

• Management/Landscape Plan
The existing site condition is an upland pond edge consisting of excavated soils. The soils are clay to
clay loam. It is a full sun area that is seasonally wet but probably hot and dry in the summer months.
METHODS:
A. Site Preparation:
1. In areas with actively growing vegetation apply Roundup Weatherm� or RodeoO
herbicide as per manufacturer's directions. Allow a minimum of 10 days before
disturbing the vegetation with other procedures.
2. Burn off the dead vegetation by implementing a controlled burn using appropriate
procedures, equipment and permits.
3. If dry or hardpacked soil conditions are present the site will be lightly harrowed or
raked to create a firm, smooth seedbed.
B. Native Prairie Seed and Seeding:
• l. Seeding dates shall be in the spring or summer before August 10`h or in the fall
between September 20`h and freeze-up.
2. All seed shall be applied by broadcasting.
3. A harrowing or raking shall follow all grass seeding.
4. The seed mixes shall consist of the following species and amounts:

MANAGEMENT AND MAINTENANCE:
Management (maintenance) plays a vital role in the eventual success of any native landscape
installation, especially during the establishment period.
During the first growing season the project area may need to be mowed to control annual weed
development. If a"closed"canopy of weed cover develops, it should be mowed to aid in the
growth of the prairie seedlings by reducing competition. Mowing may also be necessary if the
weeds are about to set seed. Optimum cutting height, depending on the wildflower species
present, is typically 4 to 6 inches. Mowing done by PRI will be billed separately unless they axe
included as part of the installation contract.
• In years following the first growing season, management services could include site monitoring,
burning, mowing, spot spraying, or hand weeding. These services should be contracted
separately from the installation contract. Please note that management services are typically
billed on a time and materials basis (a breakdown of cost ingredients would be available prior to
contract acceptance).

FOR WETLAND AND WETLAND BUFFER

The Grantors, in consideration of good and valuable considerarion paid by the City, the

boardwalks when allowed by City ordinance and under a valid City
permit.
B. Cutting, mowing or removing shrubs or other vegetation, and cutting,
destroying or removing trees greater than four inches in diameter, except
for tree disease control by or as directed by a governmental agency.

� 4. Grantors for themselves, their heirs, successors and assigns, further grant the City
the affirmative right, but not the obligation to do the follo�ving on the easement
premises:
A. Preserve, improve, and enhance the slope, trees, vegetation, and natural
habitat by altering, clearing, and removing trees or other vegetation, by
changing the contour of the land, and by planting trees or other vegetation.
B. Enter upon the easement premises at any time to enforce compliance with
the terms of this instrument.
5. Grantors reserve for themselves and for their heirs, successors and assigns and
their invitees, the right to enter upon the easement premises and to do and perform
on the easement premises such acts as are not inconsistent with the easement
rights granted to the City herein. Such uses shall be deemed to include, but not be
limited to planting of trees, flowers, and other vegetation consistent with a
conservation easement;walking along trails and paths; bird watching; the study of
nature; and all other acts of a sunilar nature or purpose.
6. Grantors hereby grant, gift, quit claim and convey to the city, a perpetual flowage
easement and nght and privilege to trespass with water over and upon any or all
of the Easement Premises.
7. Grantor(s) herein do hereby remiss, release, acquit and forever discharge, forever,
the City and any and all of its officers and employees of and from any and all
claims, demand or causes of action of any kind or nature whatsoever which may
arise or accrue by virtue of any flowage or trespass with water within terms of
• these agreements.
8. Grantor(s) do not intend that the public should have any interest in the above land
by virtue of this indenture or otherwise, except as hereinabove set forth.
