General Instructions:
1. You may be required to obtain other permits, i.e.: well abandonment, sewer, etc.
2. Work must not begin unless the permit card is available on the job site.

In return for issuance of said Demolition Permit, the undersigned owner hereby agrees to:
1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which
structures are to be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion control measures in
accordance with Chapter 79, Construction Site Runoff Control.
3. Submit a copy of permit approval from the Minnehaha Creek Watershed District (MCWD). The
City will not issue a demolition permit without a copy of the permit(s) from the MCWD or
documentation stating permit(s) are not required.� l�^�Zn

4. Submit a $2,500 escrow and an escrow agreement signed by the property owner.
5. Keep all structure(s) enclosed and/or secured until such time as demolition is complete.
6. Keep all demolition debris off adjoining property and/or the public rights-of way unless specific
prior approval is obtained in writing for temporary use thereof.
7. Completely remove foundation(s) from the ground.
8. Completely dispose of all demolition debris off site in accordance with all applicable PCA
requirements.
9. Abandon water wells in accordance with State Health Department regulations.
10. Call for an inspection when ail debris has been removed, before backfilling.
11. Within 5 working days of superstructure removal, a final inspection shall be requested. The site
shall be left clean and clear of all debris, with any excavation filled with earth level with the
adjacent ground elevation (except when such excavation is to be used as part of a new building
and such new building is actually under construction).
12.Abandon septic systems per Minnesota Rules Chapter 7080. All septic tanks must be pumped,
crushed and filled with native soils. An inspection is required after the tanks are pumped and
before the tanks are crushed and filled.
13.The undersigned owner shall and hereby does indemnify and hold harmless the City of Orono,
its agents, employees and assigns from and against all claims, damages, losses or expenses,
including attorney fees, against the City, its agents, employees and assigns arising out of or
resulting from the demolition described herein as performed by the property owner, his
employees, agents, subcontractors or assigns.

,�� � a a � � To the property owner: Demolition of the principal dwelling structure on a property may

currently associated with the principal structure (setbacks, hardcover, size of building, etc) with its removal.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot area or width
standards) may, with few exceptions, require variance approval by the City Council, and such approval is neither
automatic nor guaranteed but requires that a practical difficulty be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including setbacks, and
building footprint, hardcover (impervious surface), & height limitations, etc.
• Where municipal sewer is not available, provision of two (2) conforming on-site septic treatment sites is mandatory
for a new dwelling.
• Unless specifically approved by the City, all seasonal and permanent docks must be removed at the time of
principal dwelling demolition. They may not be re-installed until a new principal dwelling has reached the
framing stage.

Darrell Potocnik (AI 2219), a representative of Angstrorn Analytical, Inc., visited the above referenced
property on December 30, 2013 for the purpose of condwcting an asbestos demolition inspection. We are
prepared to state that of the suspect materials tested none were found to be asbestos contafning
matecials per applicalble definitions. ,
No samples other than from the fabric of the building that is planned for demolition were taken or analyaed
and this report only relates only to 2605 Kelly Ave. Forty-two samples of suspect building materials
were collected and analyzed in our laboratory by Polarized Lighf Microscopy. Please see attached notes.
During the course of fhe survey the following hazardous materials were noted:
2 thermostats 4 refrigerators/coolers
2 fluorescent bulbs 1 stove
2 AC units 1 dishwasher
1 water heater 1 furnace
1 alarm system
All friable and catego.ry II non-frlable materials need to bE removed, per applicable regulations, prior to
any demolition efforts. Category I non-friable materials are allowed #o be left in place for the demolition.
However, the landfill must be made aware that the demolition debris will contain (minimal amounts of)
category I non-friable asbestos containing material and is subject to the MPCA's rules and regulations
pertinent to the demolition efforts (notifications, etc.): This survey should not be interpreted as a bidding
document or as an asbestos project design. It is incumbent upon the contractor to verify quantities.
Quantification of rnaterials identified in this inspection report are approximations and based on observed
quanfiifies. Additional amounts of material may be present under floor, abave ceilings and inside wall
cavities and not fully quantified. For example, thermal system insulation indentified in a basement
may also exist inside wall cavities.

METHOD AND DEFIMTIONS
The submitted samples were analyzed using the EPA Interim Method #600/M4-82-030 (polarized light microscopy tivith
optional dispersion stninirt�. The method deftnes an asbestos-containing ntaterial as one that contains greater than 1%
asbestos by weigh�and nsbestos is defined ns the fibrous forrrts of serpentine nncl certnin amphiboles. While the,fibrous and
non_fibrous forms of minerals are discernible macroscopically in hand specimens, the distinetion beriveen them is not clear
on a microscopic level, especially after processing or manufacturing. Fibrous amphiboles are generally those whose menn
aspect ratios(length over width) under the microscope are approximately>10; non-fibrous amphiboles are generally those
tivhose mean aspect ratios are approximately <6. During analysis, morphology and an estimate of inean aspect ratio are
used to crssign a given mineral fiber poparlation to fibrous of non fibroa�s categories. That non-fcbrous c�mphiboles are not
reported as asbestos is cortsistent with mineralogical definitions but does not imply that non-fibrous c�mphiboles nre not
hazcrxdous. Airborne concentrations of them mcry be regulated by OSHA under certain circumstc�nces. The type of dispersion
staining used is generally phase contrast,although central stop dispersion staining may also be aised.
PERCENTAGE REPORTING
The percentc�ge of each fiber type present was determined using volume percents estimnted from stereoscopic examinRtion,
projected area percents from mounted slide�zamination nnd percents from comparison to weight percent standards. Such
estimations are suitable for most samples, but do hnve large error ranges. Errors are estimnted to be 100 relative percent
uncertainty for percentage estimates under 10%rc�nging down to as little as 10 relative percent uneertainty for percentage
estimates greater than SO%. Friable samples which have been estimc�ted by the above methods to contain less than 10%
asbestos can be point-counted, nccording to the EPA Interim Method, cts required by 1VESHAPS. In low percentage samples,
point counting may produce false negntives or positives, due to the small number of points counted.For samples consisting
of more than one apparent type of material or layer, the percentage of each fiber type in each type of material or Ic�yer is
determined and reported separately; an overall avernge for the sample of each fiber type is then calculated. The reported
I friability of n sample refers to that friability observed in the condifion c�nalyzed (broken, crushecf, etc), and is not to be
substituted for an on-site assessment of friability. Ench Angstrom�4nalytical Lab report relates only to the sample tested and
� may not, due to the sampling process, be representative of the material sampled. For datst sc�mpling no percentage or rating
is given. The results can only be expressed in positive or negative terms. In our analysis a positive result, meaning asbestos
was detected in the dust, is listed ns present. A negative result,meaning no asbestos was detected in the dust is listed as none
detected or ND. If r�t so»se point, additional copies of these results are requested a$S0.00 ad�rtinistr�ation charge will be

These documents were originally sent to Elizabeth Sedgewich at Bechler Landscape as she submitted an application for
the demolition permit for this address. We have not heard from Elizabeth since September... I assume you are the new
applicant for this permit? Please clarify.
If you are to be the applicant and contractor for this project we need you to complete a new Demo Permit application
form (attached). Please attach a site plan indicating the location of your erosion control measures. As you are aware,

AGREEMENT madethis 2.�A��day of o�-r,..�a-+-� , 20� by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Scott&Jill Wine("Own rs").
Recitals
1. A building permit application has been filed for a new principal structure located at 2605 Kelly
Avenue the ("Subject Property°), legally described as Lot 5, Block 5 of Townsite of Langdon Park, Hennepin County,
Minnesota,including the adjoining vacated 34 feet of Kelly Avenue.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the Gity has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-00029 8 demolition peRnit
#2013-00974 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order urrtil the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Minnesota municipal corporation("City")and Scott&Jill ne("Owners").
Recitals
1. An appfication for a demolition permit has been flled for the prinapal stnacture {ocated at
2605 Kelly Avenue ("Subject Property") legatly described as Lot 5, Block 5 of Townsite of Langdon Park, Hennepin
County, Minnesota,inctuding the adjoining vacated 34 feet of Kelly Avenue.
2. In oonjunction with the demolit+on,erosion contro{ measures are required as shown on aitached Exhibit
•A°
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCR�IN FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall depo5it$2,500 with the City. All aocrued interest, if any,shall be paid to the City to reimburse the City
for its cost in administering ti�e escrow account.
2. PURPOSE OF ESCR�W. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs (induding planning, engineering,or legal consultant reviewj the City has incurred to assure that the
erosion cor�trol measures are installed and maintained so the property complies with the provisions of Orono City Code
Chapter 79. The financial security may also be used by the City to eliminate arry hazardous conditions associated with
the work and to repair any damage to public property or infrastructure that is caused by the work. If compliance with
the approved Land Disturbancs Permit is not accomplished within the allowable time period, the City may bring the
project into compliance by use of the security.
3. RIGHT OF ENTRY. The Owners hereby grant the City,its agents,employees,officers and contractors
the right to enter the property to perform all work and inspections deemed appropriate by the City in conjunction with the
required erosion control measures, induding but not limited to constre�cting or completing any and all of the agreed upon
improvements should the Owners'contractor not complete those improvements by the date specified herein.
3. MONTHLY BILLING. As the City reoeives consultaM bills for incurred costs,the City wilf in tum send
a bill to the Owners. Owners shall be responsible for payment to the Ciry within 30 days of the Owners'receipt of laill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the everrt#hat the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoioed pursuarrt to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the Ciiy for eligible expenses#he Ci#y has incurred.
5. CLOSING ESCROW. Any remaining amount af the financial security deposited with the City for
faithful perFormance of the plans and specifications and any related remedial work will be released after the comple�ion
and inspection of al�such measures and the establishment of final stabilization for the Subject Property.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, ar if the eligible expenses
incurred by the City exceed the amourrt in escrow, the City shall have the right to certify the unpaid balance to the
subject ursuant to Minn. Stat.§§415.01 and 366.012.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for onty the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 1 SO days at any time after work has commenced.
The applicant is responsible for assuring all required inspections aze
requested in conformance with the State Building Code.This permit may be
revoked at any time for due cause.
