Re: Land Alteration at 2523 Kelly Avenue
Dear Mr. Sheridan:
Whenever construction or land alteration is done without permits in the City of Orono, the primary
goal of the City is to work with the property owner to move toward:
1. Obtaining the necessary after-the-fact pernuts.
2. Complying with Orono City Codes.
In a phone conversation on Thursday, April8th, you seemed to be moving in this direction. You
asked that we send you by mail the permit applications and applicable code sections so that process
could begin.
You, representing Mr. Hoyt, have now denied that any work was done on Mr. Hoyt's property and
are appazently treating this as a legal matter. We therefore assume that no cooperation to meet City
codes will be forthcoming, and we are forwarding this case to our prosecuting attorney to proceed
with a formal complaint.
Again, we would have preferred to work with your client rather than against him on this. We are
usually able to find a solution that satisfies both the homeowner and City code.

Re: Bradley A. Hoyt
Dear NIr. Potts:
Please prepare a formal complaint against Bradley A. Hoyt of 2523 Kelly Avenue in Orono. Mr.
Hoyt admits to building a retaining wall within 10' to 15' of the shoreline (see attached Exhibit A,
page 2, #8). This activity requires a conditional use permit in the City of Orono. Mr. Hoyt has
refused to file a conditional use permit application and has now served a summons to the City.
Other work in the 0-75' zone that has been done is the construction of a roadway cut into the bank
at the lakeshore and placing fill out into the lake to create a flat spot at the lakeshore where
previously the bank ended at his waterline (see E�ibit B-topo survey).
The above is a violation of Orono Municipal Code Section 10.03, Subdivisions 19 (C) and 21.
