HomeMy WebLinkAboutresolution of HOA , �--__�___S RESOLUTION OF KELLY COVE HOMEOWI�7ER5 ASSOCIATION The following resolution was adopted by all of the members of the Kelly Cove Homeowners Association: RESOLVEn, that Michael McEnany be, and the same hereby is, authorized to apply for a building permit from the City of Orono " for the construction of a detached garage in accordance with the variance, and all the conditions attached thereto, granted to Kelly Cove Homeowners Association for the construction of said detached garage; FURTHER RESOLVED, that the owners of the residential units located at 2499 Kelly Avenue and 2501 Kelly Avenue pay for the construction of the garage, and said owners shall not permit the filing of a mortgage on the common property owned by the Kelly Cove Homeowners Association, and, if any mechanic lien or any other encumbrance is placed upon the property by anyone as a result of the construction or maintenance of the detached garage, that the owners of the residential units located at 2499 Kelly Avenue and 2501 Kelly Avenue shall place in escrow an amount sufficient to cover such mechanic liens or other encumbrances in order that such liens or encumbrances do not appear as a cloud on the title of the property owned by the Kelly Cove Homeowners Association; RESOLVED FURTHER, that the detached garage shall be constructed in accordance with the variance granted by the City of Orono, shall be painted in the same color as the residential buildings located on the premises, and the trim and doors on the detached garage shall be painted in the same color as the trim and , . . the 800rs on the residential buildinge ; RESOLVED FURTHER, that a lease ahall be entered into between the Kelly Cove Homeowners Association anci the owner of the residential units located at 2499 Kelly Avenue an8 the owner of the unit located at 2501 Kelly Avenue; that the lease shall be for a term of twenty (20) yeare; that the lease shall require a monthly payment for the use of one garage for each of the above f�entified residential units at the costs of Fifteen and no/100 ($15) Dollars per month per unit; that the owners of t'he property located at 2499 Kelly Avenue and 2501 Kelly Avenue shall, pursuant to the terms of the lease, pay all taxes levie8 against the property owned by the Homeowners Association; and the lease between Kelly Cove Homeowners Association and the owners of the above identified residential units shall provide that the owners of those units shall maintain the detached garage in good condition at all times and shall be responsible for all repairs; Further resolved that the entire Association shall have the use of that portion of the garage for storage , which would be identified as the one- half of the two and one-half car garage .
