Summary
Orono Denta.l Care has requested a sign permit to allow a wall sign on the southeast wall of the
Orono Professional Properties building (per the applicant, the plans which indicate the northwest
elevation are incorrect).The proposed sign will be in addition to the existing 12' 8"monument sign
which was approved by Council in March of this year. The Development Agreement provides that
minor amendments to the approved plan may be referred to the Development Review Committee,
which consists of the Planning Director,Public Services Director and the City Planner. Because this
is a newly proposed sign, which was not included within the original PUD agreement, Council
review is required.
The permit application is for a 7' 11"wide,6'tall internally illtuninated wall sign. The applicant has
submitted a color rendering for review. The wall sign along with the existing ground sign will total
less than the maximum sign square footage for the B-6 District, which is based on frontage.
Options
1. Refer this to the Development Review Committee for final action; or
2. Refer this to Development Review Committee for a recommendation,with Council to take
final action; or
3. Advise applicant to make a formal request for PUD amendment, for Planning Commission
and Council review; or
4. Approve the sign permit as proposed.
Staff Recommendation
, Staff recommends the Council approve the sign permit as proposed and direct staff to amend the
appropriate attachments to the Development Agreement to reflect this change.

78-1466(8) Temporarysigns.
a. There shall be no more than four temporary business signs issued per calendaz year,and for a period of not more than ten days per
time or of the duration of the event promoted by the sign message,whichever is less.The sign(including banners or balloons),sign supports or
portable stand shall be removed from public view at the end of the period.Total azea of the sign shall not exceed 32 square feet per surface(64
square feet tota]signage allowed for two-sided portable sign).Advertising balloons are not subject to area restrictions but must meet all
applicable federal and state standazds.
b. There shall be no more than one temporary sign in any required yard area,and,if separate multiple signs are proposed,the total area
of the signs shall not exceed 32 square feet.Temporary business signs require a building permit from the city.No such pemut shal)be issued by
the city if a conditional use permit under section 78-1467(1)c has been issued to a residential property.No temporary sign shall be allowed in
residential zones unless pettnitted as election or sale signs under this section.Multitenant buildings shall be considered as a single property for
purposes of subsection(8)of this section;and the use of the single temporary business sign by tenants on the properiy s6a11 be the responsibility
of the property owner or designated manager,who shall endorse in writing all applications for sign pemvts.
c. The owner or manager of the sign and the owner of the property shall be equally responsible for the proper location,maintenance and
removal of the sign.All temporary signs shall be located on a property so that they do not impede safety by obstructing vision of pedestrians or
motor vehicle operators.
Sec.78-1468.Signs in B and I districts.
Within the B and I districts,nameplate signs and business signs are permitted subject to the following regulations:
(1) B-1,B-2 and B-4:size.Within the B-1,B-2 and B11 districts,the aggregate square footage of sign space per lot shall not
exceed the sum of one square foot for each front foot of building,plus one square foot for each front foot of lot not occupied by a building.No
individual sign shall exceed 50 square feet.
(2) B-3:size.Within the B-3 dishtict,the aggregate square footage of sign space per lot shall not exceed the sum of four square
feet per front foot of building,plus one square foot per front foot of property not occupied by a building.No individual sign surface shall exceed
]00 square feet.
(3) I:size.Within any I district,the aggregate square footage of sign space per lot shal]not exceed the sum of four square feet
per front foot of building,plus one square foot per front foot of property not occupied by a building.No individual sign surface shall exceed 100
square feet.
(4) B-1,B-2 and B-4:height.Within the B-1,B-2 and B-4 districts,no sign shall extend in height more than two feet above the
highest outside wall or parapet of any principal building,nor shall any sign be located closer than ten feet from any property]ine;except that any
sign over ten square feet may project two feet into any required yard area from the principal building.
(5) B-3 and I:height.Within any B-3 or l district,no sign shall extend in height more than six feet in height above the highest
outside wall or parapet of any principa]building.No sign shall be located closer than ten feet from any property line,except that any sign
exceeding ten square feet may project only two feet into the yard area from any building.
(Code 1984,§10.61(3))

permit. A double fee will be charged for any sign erected prior to obtaining a permit. Incomplete
applications will not be processed.

� PARKWAY—PUD AMENDMENT FOR WALL SIGN
Gaffron stated Orono Dental Care is requesting a sign permit to allow a wall sign on the
southeast wall of the Orono Professional Properties building in addition to the existing
12' 8"monument sign which was previously approved by the Council. Orono Dental Care
is requesting a 7' 11"wide, 6' tall internally illuminated wall sign. Gaffron noted the
wall sign, along with the existing monument sign,will total less than the ma�cimum sign square
footage allowed for this property in the B-6 District. Staff recommends approval of the PUD
amendment.
Dr. Karl Berg noted the sign would be located on the southeast side of the building rather than
the northwest side as originally proposed.
Murphy stated he was recently in this area during the nighttime hours and had noticed that the
night lights on this building are white in color. Murphy commented that the majority of the
night lights currently in the City are amber lights,which in his opinion are aesthetically more
pleasing than the white lights. Murphy inquired what the rationale is for having amber lights
versus white lights, and suggested the City look at requiring the night lights throughout the City
be more uniform.
McMillan commented she prefers white lights and questioned whether the lighting at this
site should be pointed more downward rather than outward.
Berg stated he has questioned the architect concerning the lighting on the building and was
informed that they do comply with the City's lighting regulations.
City Administrator Moorse noted the City would soon be installing a number of lights along
Kelley Parkway and that a quick review of this situation would be necessary if any changes
are to be made to the color of the lights. Moorse indicated he is unaware of what color lighting
has been chosen along Kelley Parkway and would check on the situation.
Roland Jurgens,Planning Commission,stated there are two types of night lights available,
a mercury vapor light and a high pressure sodium light. Jurgens stated the high pressure
sodium lights,which are amber in color, are more efficient.

Berg stated it is his understanding the lights need to have a certain number of lumens in order to light
up the sidewalk. Berg indicated to his knowledge the lighting complies with City codes.
Berg inquired whether additional signage could be mounted on this building in the future.
Gaffron stated the property is allowed one square foot of signage per foot of frontage
and that currently this property has approximately one-third of the signage allowed under City
code. Gaffron noted any additional signage would need to be approved by the City.
Moorse recommended that consideration be given to standardizing all of the signs on this
building for aesthetic reasons should additional signage be added.

road right-of-way. Gaffron indicated the applicant's description of the property goes to the center
of the roadway and the description of the property to the west goes to the section line north of
the road. Gaffron noted the survey does not reflect the right-of-way. Gaffron stated the numbers in
the Planner's report are the gross acreages, including the road, and that the lot sizes for both 925 and
965 are less than two acres. Gaffron stated these lots were already substandard sized lots prior to the
lot line rearrangement.

Summary:
McCarthy Construction has requested a sign permit for the dental office at 2765 Kelley Parkway to
allow a larger sign than was previously approved.
In November 2002 Council approved the Development Agreement which referred to sign plans
iiidicating a two-faced monument sign 13'4"wide and 12'high,with 68 s.f.of signage per face,each
sign face being 8' wide and 8'6"high.
The plans submitted for the building permit in June 2003 indicated a sign 13' wide but 12'8"high.
Staff accepted this because the magnitude of the change was minor and the square footage of signage
remained at 68 s.f. per face, 8' wide and 8'6"high.
The current signage request now has the sign 13' wide but 13'8"high,rnore than 1-1/2 feet higher
than originally approved. The faces are now 7'2" wide by 10' high, or a total square footage of
71.25 s.f. per face. The added height is of greater concern to staff than the minor addition of square
footage to the faces.
One apparent reason for the added height is that the individual pillazs were not built according to the
plan;they are each slightly larger in girth,reducing the width available for signage to 7'2"rather than
8'. The added height proposed apparently makes up for this loss of width.
A reason for the added height cited by the applicant is that the owners want the sign to be visible
over the berm at the corner.
The underside of the eaves of the building are at a height of 12' above grade. The 13'8" height
raises the top of the sign to a level about even with the top of the facia.

Staff Recommendation
The height of the sign is an issue because it sets the tone for all other signage along Kelley Parkway.
Monument signs are by design intended to be low to the ground,as opposed to pylon signs which aze
by nature raised to a height for greater visibility. A monument at 12' or 12'8"is already pushing the
limit,in staff's opinion,especially for an office use. If this was retail,there would be a greater need
for highly visible signage. •
The Development Agreement provides that minor amendments to the approved plan may be referred
to the Development Review Committee, which consists of the Planning Director, Public Services
D'uector and the City Planner.

1. Indicate to the applicant that the sign may not exceed the 12'8" height approved with the
building permit.

Summary:
McCarthy Construction has requested a sign permit for the dental office at 2765 Kelley Parkway to
allow a larger sign than was previously approved.
In November 2002 Council approved the Development Agreement which referred to sign plans
indicating a two-faced monument sign 13'4"wide and 12' high,with 68 s.f.of signage per face,each
sign face being 8' wide and 8'6"high.
The plans submitted for the building permit in June 2003 indicated a sign 13' wide but 12'8"high.
Staff accepted this because the magnitude of the change was minor and the square footage of signage
remained at 68 s.f. per face, 8' wide and 8'6"high.
The current signage request now has the sign 13' wide but 13'8"high, more than 1-1/2 feet higher
than originally approved. The faces are now 7'2" wide by 10' high, or a total square footage of
71.25 s.f.per face. The added height is of greater concern to staff than the minor addition of square
footage to the faces.
One apparent reason for the added height is that the individual pillars were not built according to the
plan;they are each slightly larger in girth,reducing the width available for signage to 7'2"rather than
8'. The added height proposed apparently makes up for this loss of width.
A reason for the added height cited by the applicant is that the owners want the sign to be visible
over the berm at the corner.
The underside of the eaves of the building are at a height of 12' above grade. The 13'8" height
raises the top of the sign to a level about even with the top of the facia.

Staff Recommendation
The height of the sign is an issue because it sets the tone for all other signage along Kelley Parkway.
Monument signs are by design intended to be low to the ground,as opposed to pylon signs which are
by nature raised to a height for greater visibility.A monument at 12' or 12'8"is already pushing the
limit,in staff's opinion,especially for an office use. If this was retail,there would be a greater need
for highly visible signage.
The Development Agreement provides that minor amendments to the approved plan may be referred
to the Development Review Committee, which consists of the Planning Director, Public Services
Director and the City Planner.
COUNCIL ACTION REQUESTED
Options for Action
1. Indicate to the applicant that the sign may not exceed the 12'8" height approved with the
building permit.
2. Refer this to the Development Review Committee for final action.
3. Refer this to Development Review Committee for a recommendation,with Council to take
final action.
4. Advise applicant to make a formal request for PUD amendment, for Planning Commission
and Council review.
5. Conclude that the sign dimensions as proposed on the sign permit application are acceptable.

a. There shall be no more than four temporary business signs issued per calendar year,and for a period of not more than ten days per
time or of the duration of the event promoted by the sign message,whichever is less.The sign(including banners or balloons),sign supports or
portable stand shall be removed from public view at the end of the period.Total area of�e sign shall not exceed 32 squaze feet per surface(64
squaze feet total signage allowed for two-sided portable sign).Advertising balloons are not subject to area restrictions but must meet all
applicable federal and state standards.

removal of the sign.All temporary signs shall be located on a properiy so that they do not impede safety by obstructing vision of pedestrians or
motor vehicle operators.

NOW,TAEREFORE,BE IT RESOLVED that based on the findings ofResolution
No. 4680, the City Council of the City of Orono does hereby grant General Development Plan
Approval for Planned Unit Development No. 3, subject to the following conditions:
1. General Development Plan Approval is granted subject to conditions established
within Resolution 4860 and subject to the conditions established within the
Planned Unit Development No. 3 Agreement and other pertinent documents.
2. Upon the final approval and ezecution of this resolution and the Planned Unit
Development No.3 Agreement,the City Council shall formally approve an ordinance
amending the official zoning map of the City to rezone the Property and the Adj acent
Parcel from RR-1B Sinale Family Rural Residential District to B-6 Highway
Commercia?District Planned Unit Development(B-6 PUD),and amending the Orono
Zoning Code by adding language establishing Planned Unit Development No. 3
(PUD-3) to include the property and the Adjacent Parcel.

78-1466(8) Temporary signs.
a. There shall be no more than four temporary business signs issued per calendaz year,and for a period of not more thari ten days per
time or of the duration of the event promoted by the sign message,whichever is less.The sign(including banners or balloons),sign supports or
portable stand shall be removed from public view at the end of the period.Total area of the sign shail not exceed 32 squaze feet per surface(64
square feet total signage al(owed for two-sided portable sign).Advertising balloons are not subject to azea restrictions but must meet all
applicable federal and state standards.
b. There shall be no more than one temporary sign in any required yard azea,and,if sepazate multiple signs are proposed,the totai azea
of the signs shall not exceed 32 square feet.Temporary business signs require a building permit from the city.No such permit shall be issued by
�`� the ciry if a conditional use permit under section 78-1467(1)c has been issued to a residential property.No temporary sign shall be allowed in
residential zones unless permitted as election or sale signs under this section.Multitenant buildings shall be considered as a single properiy for
purposes of subsection(8)of this section;and the use of the single temporary business sign by tenanu on the properiy shall be the responsibility
of the property owner or designated manager,who shall endorse in writing all applications for sign permiu.
c. The owner or manager of the sigo and the owner of the property shall be equally responsible for the proper location,maintenance and
removal of the sign.All temporary signs shall be located on a property so that they do not impede safety by obstructing vision of pedestrians or
motor vehicle operators.
Sec.78-1468.Signs in B and I districts.
Within the B and I districu,nameplate signs and business signs aze permitted subject to the following regulations:
� ' (1) B-1,B-2 and B-4:size.Within the B-1,B-2 and B-4 districts,the aggregate square footage of sign space per lot shall not
� exceed the sum of one square foot for each front foot of building,plus one square foot for each front foot of lot not occupied by a building.No
individual sign shali exceed 50 square feet. `' ,
� (2) B-3:size.Within the B-3 disuict,the aggregate square fo'otage of sign space per lnt shail not exceed the sum of four squaze
feet per front foot of building,plus one square foot per front foot of property not occupied by a building.No individual sign surface shall exceed
100 square feet.
(3) I:size.Within any I disVict,the aggregate squaze footage of sign space�per lot shall not exceed the sum of four squaze feet
per front foot of building,plus one square foot per front foot of property not occupied by a building.No individual sign surface shall exceed 100
square feet.
(4) B-1,B-2 and B-4:height.Within the B-1,B-2 and B-4 districts,no sign shall extend in height more than two feet above the
highest outside wall or parapet of any principal building,nor shall any sign be located closer than ten feet from any property line;except that any
sign over ten square feet may project two feet into any required yazd area from the principal building.
(5) B-3 and I:height.Within any B-3 or l district,no sign shall extend in height more than six feet in height above the highest
outside wall or parapet of any principal building.No sign shall be located closer than ten feet from any property line,except that any sign
exceeding ten square feet may project only two feet into the yard azea from any building.

Dr. Carl Berg was present.
McCarthy Construction has requested a sign permit for the dental office at 2765 Kelley
Parkway to allow a larger sign than was previously approved. Summary of the approval and

The staff's concern is the height of the sign because it sets the tone for all other signage
along Kelley Parkway. Monument signs are by design intended to be low to the ground, as
opposed to pylon signs, which are by nature raised to a height for greater visibility. A
monument at 12' or 12' 8" is already pushing the limit, in staff's opinion, especially for an
office use. If this were retail, there would be a greater need for high visible signage.
Staff also stated the Development Agreement provides for minor amendments to the
approved plan and may be referred to the Development Review Committee, which consists
of the Planning Director, Public Services Director and the City Planner.
Sansevere stated that the low sign that staff is recommending is fine but the high one is
above the roofline.
Mayor Peterson stated she couldn't endorse the variance. She said it is a destination point
and doesn't need a brightly lit sign.
Murphy inquired if his business is by word-of-mouth and Dr. Berg responded affirmatively.
White asked if the applicant is going to encase the steel posts with the nice pillar looking
facade as on the inside and the applicant responded affirmatively.
Applicant stated the City granted two signs. Tenant names can't be seen from the road on
the current height sign and he doesn't feel the sign he wishes to place is too high.
Murphy told the applicant he has resource against the developer/builder.
Mayor Peterson said the Wayzata Medical Building sign doesn't list all the doctors on it and
this is a medical facility.
Applicant Berg also has had great difficulty with the Kelly Avenue versus Kelley Parkway
address in dealing with the post office. They continually get the two addresses confused and
it just hasn't worked well.

Gaffron stated that the address could be addressed. Berg responded that he could speak with
his partners.
Gaffron stated in staff's opinion the sign at 12' or 12' 8" is pushing the limit, especially for
an office use.
White suggested making the Orono Professional Center in smaller letters or putting on a
lower sign and then the tenant names could be larger.
Sansevere stated the sign exceeded and interrupted the roofline and it would be more
visually pleasing if one-foot lower.
Murphy stated the Council has gone a long way on previous issues related to this project.
Applicant Berg also stated they went a long way.
Murphy moved and Mayor Peterson moved to deny the application based on staff's
recommendation that the sign not exceed the 12' 8" height approved with the building
permit. VOTE: Ayes 4; Nays 0.
11. #04-2974 RELIANCE DEVELOPMENT CORP.,HIGHWAY 12/WILLOW
DRIVE (OUTLOT A, STONEBAY)—COMPREHENSIVE PLAN AMENDMENT
Gaffron explained Planning Commission tabled this item on February 17 pending a joint
work session with the Long Lake Planning Commission,which was held on March 3. At
that work session,the commissions exchanged information about current and pending
activities along the Highway 12 corridor, and discussed whether rezoning of this site might
impact redevelopment efforts in Long Lake. Each commissioner in attendance drew his/her
own conclusions regarding that discussion.
On February 17, Planning Commission also established a list of acceptable uses for the
property if it is rezoned. The Planning Commission refined this on March 15.
Murphy inquired what the list of uses meant. Gaffron responded by saying that when the
property is rezoned there will be a list of allowed uses for this property and if any approved
uses on the list become a drive-thru there would be CUP on the permit.
On March 15, Planning Commission concentrated primarily on determining whether to
recommend that the Comprehensive Plan be amended to re-guide the site to allow primarily
retail uses, rather than the primarily office uses for which the site is currently guided.
