The following Council members were present: Mayor Searles, Paurus. The follow- • ing Planning Comnission members were present: Chairman Guthrie, Van Nest, Gasch. i � It was noted that this work session meeting had been announced at the regular meeting of the City Council held � on Dec�er 10, 1974. � The members present held a general discussion concerning B-2 Uses the proposed B-Z uses as set forth in section 6 of the � prnposed ordinance to amend the Zoning Code. Mayor Searles noted that the marina operators had requested that the • Camcil consider establishing various classes of marina operations and�;apply different regulations to each class. � One such class would be the limited service marina opera- � ' � tion which would include rentals, repairs, sale .of bait ' and tackle. The other class would be the full service � marina. operation which would include the sale of new and used boats year round, boat repairs, and restaurant activity. • There followed a general discussion concerning the purpose Chapter 30 of Zoning Code • and definition section of the Zoning Code. It was stressed � that the purpose and definition section should state clearly that these amendments among other things are � designed to protect the wet lands and marshes within Orono, the quality of water in La.ke Minnetonka and Long � Lake, and the quality of ground water supply in Orono. It is of paramount importance to prevent the destruction � of the natural enviromnental assets located within the City, assets which allow for the conti�nuation of an • adequate and clean ground water supply for the citizens of Orono. • � There followed a general discussion concerning the definition of hard cover and the definition of � These definitions were incorporated in the draft of the proposed zoning amen�nents that had been presented � previously to the Commission, the Council, the staff and that were available to the public at the City • Hall. • ! • • • � ' � � Work Session Council and Planning Cormnission, Dec. 13, 1974 -2 � � Van Nest then discussed the proposed provisions in Chapter � 31 dealing with lot of record and the need to seek Council approval for any variances for a lot of record which • did not meet the area and width measurements that are required by the Zoning Code for any use district. The � City Attorney noted that at some time in the future � the Council should consider amendi.ng this section of the Code to provide for replatting provisions. The City � Attorney then discussed section 31.510 of the proposed Zoning Code which dealt with "essential services" and � noted that it was previously requested by the Council that the Code be amended so that all structures etc. • for municipal services mist ha.ve a conditional use per- mit in order to insure that these structures are com- • patible with the uses in that district and that the � development and installation of these structures does not result in any harmful effects to the citizens of � Orono. � There then followed a general discussion of the pro- Section 3, posed amenc�nents to Chapter 32 of the Zoning Code. Chapter 32 � It was noted that Chapter 29 of the old Zoning Code would be repealed in its entirety since the uses set � forth in that Chapter for the most part are not com- ' � patible with the other uses permitted in the City of• Orono. Those uses that had previously been set forth � in Chapter 29 that were compatible with the other uses and the envimnment in Orono have been include� as con- � ditional or permitted uses in the various use districts. � The members present then discussed section 4 which Section 4, set forth amen�nents to Chapter 33 of the Zoning Code. Chapter 33 • There were no changes suggested. � The members present then discussed section 5 of the proposed ordinance which amends all of the present � chapter 34 of the Zoning Code. The members present � felt that the purpose section of the ordinance should be redrafted to clarify certain ambiguities. The r members present then discussed section 34.031 of the proposed amendment which dealt with the minimum acre- . i age rec{uirement for each animal unit in residential areas. The members present then discussed the purpose • section for the R1-B district and felt that it should � be redrafted to remove ambiguities. � There followed a general discussion concerning new lakeshore hard cover and set back regulations, • � • • • � � � Work Session Council and Planning Connnission, -3 � Dece�er 13, 1974 � Adclitional wording was suggested in order to clarify � ambiguities. The mesnbers discussed the purpose � sections for the LR districts. � It was felt that it was necessary to include private docks as an acessory use in the LR districts and � make these docks subject to the r�unicipal cod.e and other applicable regulations, including boat stor� � age density regulations. • The members then discussed the RR-lA district and decided that the purpose section of that district � be redrafted to clarify ambiguities. The same � suggestion was made as to the RR-1B residential district. � The me7nbers then discussed the proposed section 6 Section 6, � which amends Chapter 35 of the Zoning Code dealing Chapter 35 with the business districts within Orono. The r Council and Planni.ng Comomission decided that all applications for building pennits in any of the � business districts should be reviewed by the Council � and Planning Com�m�ssion so �hat the governing bodies would have an opportunity to detennine whether or not � the proposed structure met the requirements of the Zoning and Building Codes and whether or not the • � proposed structure or land use would be in conflict with the intents and purposes of the Zoning Code. • The members felt that the provision:. having to do with the building design a�d construction in a • B-1 district shauld be changed to elimina.te pre- S finished metal or plastic as a pennitted construction material. � The members then discussed the proposed amendments � to the B-2 and lakeshore business district. It was felt tha.t since the new marina licensing ordinance � applied to the uses in the B-2 areas that they shaxld be discussed concurrently and that the proposed � amendment to the B-2 use district regulations should be changed in order to reflect those changes that � have been roade to the Marina Licensing Ordinance. � The members stated that the draft as proposed by the Planning Conmission and Council and as developed by � the City staff reflected the necessary regulations to insure the protection of Lake rsinnetanka, the � protection of the residential uses near the B-2 areas and to protect the ground water supplies in � the area from excess storm water run-off which is � created by dense hardcover development near Lake � • • r � ` � � Work Session Council and Planning Commission -4 Dec. 13, 1974 � � Minnetonka. There followed a general discussion � of the need for the new regulations as to the sale of food, parking requirements, harcicover and set �� back regulations, drainage, hours of operation and other performance standards considered neces- S sary in the B-2 zone. � The members then discussed the proposed amend- ments to the B-3 shopping center business district � and noted that the purpose section should be amended � to provide that the districts shall have immediate access to adec�uate highways and public sanitary � sewer. � The members then discussed the B-4 office and pro- fessional business district and regulations. The � members stated that a purpose section was necessary and wording therefore was provided. Moreover, the • me�mbers present felt tha.t any application for building � permits in a B-4 area should be reviewed by the Council � and Planning Commission to insure campliance with the � intent and purpose of the Zoning Code. '� � The members then discussed the proposed amendments • Section 7, to Chapter 36, industrial districts. It was noted Chapter 36 � that all applications for building permits in iruiustrial districts should be reviewed by the Cauncil and � Planning Conenission for the reasons previously stated. • It was noted that restaurants (class 1) were to be canditional uses and not permitted uses within the i i.ndustrial district. � Van Nest then noted that there is a need for addi- tional provisions as to exterior storage in R districts, � and there follo�wed a general discussion concerning what estent boats and unoccupied trailers should be � allowed in residential districts. � The me�nbers then discusseci the proposed changes to Chapter 38 which dealt with the signs allowed in all � business districts. The draft of the proposed amend- � ment also included changes as to parking rules in � the districts and the location of those parking areas. • The members present then discussed the fact that Section 10, • it was necessary to repeal Chapter 29 since it was Chapter 29 and • outdated and the uses set £orth as conditional or Sections 38.830 to special use perlait uses were not compatible with 38.838 � the intests and purposes of the Zoning Code. It was noted that 7 Orono did not have adequate highways and sewer systems presently to service apartment dwellings, that sections � 38.830 through 38.838 should be repealed until the � Zoning Code is amended to allow for apartment structures in Orono. It was noted that through the use of the � planned residential development that apartment type camplexes cauld presently be built as long as other � necessary factors were met. • The members then discussed the proposed draft of the amendment to the marina licensing ordinance, Chapter � 73. The me�mbers felt that the parking space pro- i vision should be changed so that it states that at least 8 off-street parking spaces plus one additional ,� space for each 800 square feet of floor area over 1,000 feet including warehousing and all outside sales and -� storage areas related to the sales and service functions. It was felt that the Council should appoint a cmranittee � consisting df Planning Coirm►ission members and Cauncil . members who would review license applications and license operations and report the findings to the '�' ` City Council each year. There follawed a general � discussion as to the forn�at for inspection and the �' i � relationship between the LMCD dock regulations and those regulations which had previously been adopted • '' by the City of Orono. Since it was late in the day, `� � Mayor Searles announced that this work session would • be continued to Tlxesday, December 17, 1974, at 8:00 at the City Hall.
