Work Session of the City Council and Planning 9 : 00 A. M.
� Commission, November 2 , 1974
NThe City Council and Planning Commission met
� on the above date with the following members
present: Mayor Searles, Councilmen Butler,
� Massengale, and Welsh. Absent: Councilman
Paurus. Planning Commission members present:
� Curtis, Gasch, Kallestad, Pesek, and Van
• Nest. Absent: Chairman Guthrie, Elliott,
Kullberg, and Hake. Also present: City
• Administrator Benson, Building and Zoning
Director Muhich, John MacLennan from
� Hickok & Associates , Lyle Swanson from McCombs-
Knutson, and attorney Bruce Malkerson.

MacLennan presented the surface water management STORM WATER PLAN
plan put together by his firm. This is an
• inventory of storm water retention and runoff
as of the present and should be a useful tool
• in the planning processes of the future. We
should be concerned with two things, namely,
the quality and quantity of storm water as it
pertains to the lake. In the matter of quality,
� half of the problem is septic effluent and half
storm water runoff. He stated it is virtually
impossible to pipe all the runoff so provision
� has to be made to retain as much as possible
in swamps and marshes where a natural purification
S takes place. He used a test plant at Ely for an
example of cost, stating it costs $800 , 000 a
� year to run this small plant, whereby storm
water is chemically purified with lime and
� alum. He presented a base map showing natural
retention and runoff in the City. Searles
felt we should use this map for future development
• and developers should furnish the burden of
proof if they do not concur with it. MacLennan
� now showed examples of using tables presented
with base map to find the runoff co-efficient
� based on quantity as of the present. In conjunction
with municipality management, the function of the
Lake Minnetonka Conservation District is to
regulate the runoff from one municipality to the
� other.
He now presented another map showing the marshes
� in the City with code numbers. This will be
used to study the relationship between development
� and pollution. Van Nest felt we have to continue
to make better definitives for marsh areas.
� Discussion was held on the use of zoning in wetland
control or regulations such as our present Ordinance
� No. 125. The attorney opined that good definitions
, are better than using a case-by-case basis .

Van Nest felt that there should be one elevation
contour on each marsh to define more accurately
� the area of each one for legal purposes. Members
felt there should be more study on this matter,
such as, vegetation regulation and duck pond
regulations and this should be placed on the
next regular agenda; also, this study should be
referenced in any future zoning and rezoning
and should be officially adopted and become
� part of Ordinance No. 125.
Searles passed out a rough draft of the B-2
study committee, also, a boat density policy
� statement by Lake Minnetonka Conservation
. District. He now read Part I of the report
voicing the overall concern for commercial
usage of the lake. In conjunction with this,
he presented a series of photos showing the
� present configuration of the B-2 areas as
compared with these areas 25 years ago. He
� was at a seminar at the University of Wisconsin
and it was brought out at this seminar that it
would take Lake Minnetonka 25 years to flush
• itself out.
He now read report #II dealing with the special LAKESHORE COMMERCIAL
situation involving lakeshore commercial on the
� southwest shore of Maxwell Bay. After reading
the report, he asked members two questions to
begin discussion.
� 1. Is the thrust of this correct?
2 . Does it leave elements out?
Massenagle asked if there was any criteria on
commercial usage from the DNR. Searles stated
� that while there was no documentation, the DNR
has worked very closely with L.M.C.D.

The B-2 committee felt that one thing left out
� of the study was the outrage of the people
living in this area.
Massengale felt that the present B-2 zoning
ordinance was not working and there was a
, definite need to enact a workable ordinance
and then have good enforcement.
Malkerson questioned whether the complete
usage of the B-2 area was any longer in the
public interest.
� Massengale asked whether there was a degradation
of property values in this type of usage. The
Mayor instructed the staff to get a report from
the assessor on this consideration.

Malkerson now read a rough draft of licensing
procedure and new standards for marina operations.
t On proposed Chapter 73. 030, it was felt that due
to new rezoning processes an exception in the
time of licensing should be made for this year
` so the new zoning requirements can be incorporated.
On proposed Chapter 73. 060 (2) , it was felt the
parking requirement should be one parking space
to each wet or dry storage and the next paragraph
regulating the parking for the serving of food
such read "snack food" .
On proposed Chapter 73. 060 (3) , the words "berm"
• and "fencing" should be removed.
On proposed Chapter 73. 060 (7) , hours of 8 : 00 A. M.
to 6 : 00 P.M. were established.
On proposed Chapter 73. 060 (8) , the word "operation"
' should be changed to "service operation" .
On proposed Chapter 73.090 , the initial application
` fee and annual renewal fee was discussed but no
firm decision made.
The meeting was adjourned at 1: 30 P.M.
