HomeMy WebLinkAbout#5374-extension of site plan approval t � O� O O �;� ..- C I�Y of ORONO 1>1 ,,�3.,,,'a �Jy L' ., �, Y' � '�' RESOLUTION OF THE CITY COUNCIL �L`qkESII���� NO. � J � � A R�SOLUTION GRANTING A ONE YEAR EXTENSION OF A COMMERCIAL SITE PLAN APPROVAL FOR PLANNED UNIT DEVELOPMENT NO. 3A FOR PROFESSIONAL PROPERTIES OF ORONO, L�,P GR.ANTED PER RESOLUTION #5191 FILE #0�-3144 WHER�AS, the City of Orono is a municipal corporation organized and eaistiilj under the laws of the State of Minnesota; and WHEREAS, the Ci�� Council of the City of Orono (hereinafter "City Colulcil") has adopted land developm�nt regulations for the orderl5r, economic and safe development of land within the Cit�T; and WHEREAS, Berkshire Properties ("the Applicant") made application for an extension of the approvals aranted under Resolution �5191 on behalf of Professional Properties of Orono, LLP ("the Owner�') for propez-ry located at 2745 Kelley Parkway and legally described as: Lot l, Blocl: 2, City of Orono Addition, Heruiepin County, Minnesota (hereinafter the "Property"); and ����5, the City Council has considered the application by the Applicant for an extension of the approvals granted under Resolutioi� #�191 for development of the Property by the Plaiu�ed Unit Development (PUD) process; and �%�-+i��A�, on June 14, 2004 the �ity �ouncil �ranicd �oin�-r�ercial Site Plan Approval for the proposed development consistin� of a 36,000 square foot medical office buildin�; and WI�E��S, the Applicants have aQreed to execute the Planned Unit Development :�To. 3A Aareement drafted in conjunction ti�ith the June l�. ?00� approval of Resolution�5191, Pa�e 1 01'� R � O� O O � � � C ITY of ORONO ti ti RESOLUTION OF THE CITY COUNCIL ��`�kESI���`'�G NO. _ 5 �S � Q . NOW, THEREFORE, BE TT RESOLVED that the City Council of the City of Orono does hereby grant a one year eYtension of the approvals granted u�der Resolution #5191 for Planned Unit Development No. 3A, subject to the following conditions: 1. If substantial development has not occurred within one year after approval of this extensioii, the City Council may declare the approvals granted within this resolution, Resolution #5191 and Plaruied Unit Development Agreement No. 3A as null and void.
