Warranty Period The warranty period will terminate immediately folfowing the earliest occurrence of either of the following: » 18 months have elapsed following the shipment of any system or subsystem of SimplexGrinnell to the customer site, or » 12 months have elapsed following the final connection, operation or beneficial use of all or any part of the system. SimplexGrinnell Obligation Under fhe Terms of the Warranty: SimplexGrinnetl sole responsibility shall be to repair, adjust or replace at its option any SimplexGrinnefl product when it fails during this period provided purchaser has promptly reported such failure to SimplexGrinnell in writing. Replacement parts provided under warranty of products may contain used parts,which are equivalent to new parts when used. Replacement parts wi(I be warranted only for the balance of the equipment warranty. SimplexGrinnell agrees to continue to honor all of the unexpired expressed warranties specified above on defective equipment after transfer of the equipment to the purchasers'customer, provided the purchasers'customer assumes the purchasers'obligations specified herein. Except for the express warranties stated herein, SimplexGrinnell disclaims all warranties on products furnished hereunder, including ' without limitation,all implied warranties of inerchantability and fitness for a particular purpose, and the stated warranties are in lieu of or in connection with the performance of the products.The , seller shall not be liable for any direct, incidental or consequential loss or damage to the purchaser or user of this equipment arising out of the failure of the equipment to operate in excess of the said equipment.
