Regular Meeting of the Village Council , 7 : 30 P.M.
r September 24 , 1973
� The Village Council met on the above date
� with the following members present : Mayor
Oberhauser, Councilmen Butler, Dorn ,
w Massengale, and Welsh.
� Dorn moved, Butler seconded, that the Minutes MINUTES
� of the Regular Meeting of September 10 , 1973 ,
be approved. Motion, Ayes (5) - Nays (0) .
�
� Dr. Panuska, representing the Park Commission, LUCE LINE TRAIL
informed the Council of a Department of
� Natural Resources public hearing regarding
the Luce Line Trail which was held at the
s Orono Middle School . A sample questionnaire
was read, which the Park Commission would
• like to distribute to the owners of property
� abutting the Luce Line Trail.
� Mayor Oberhauser suggested to Dr. Panuska
that the Park Commission consider allowing
� individuals to place trails on their property
as they choose , as long as they do not interrupt
� the continuity of the trail .
�� Mr . Paurus informed the Council that the PLANNING COMMISSION REQUEST
Planning Commission did not have a quorum
at their September 17, 1973 meeting. The
� Planning Commission members that were present
asked that the Council consider the Thompson,
� Schuett , and Gardner applications without
• formal Planning Commission recommendation.
r The final plat approval for DiCon was tabled DICON - FINAL PLAT
until the October 9 , 1973 Council meeting.

� Discussion regarding the Larson request for VARIANCE
a variance from the lot si�e requirement and 1465 Long Lake Boulevard
� the moratorium was continued until the October 9 ,
1973 Council meeting at which time the Zoning
� Administrator would present staff recommendations .

Dorn moved, Butler seconded, that the preliminary PRELIMINARY PLAT
� plat of Edward Johnston be approved with a drive- #151 �, Loma Linda Avenue
• way in the southeast corner of the property serving
Lots 1 F� 2 (access to #151 should be within 70 '
� of the east property line) , and with Lot 1 , enter
Loma Linda as is shown on the plat map. This
� division and variance for lot size was deemed reasonable
� because of the unique shape of the lots . Motion,
Ayes (3) - Nays (1) . Councilman Welsh Nay, Mayor
Oberhauser abstained.

Dorn moved, Butler seconded, that a variance BUILDING PERMIT
- from Ordinance No. 194 be granted for Gerald Guetzkow
� Guetzkow because soil borings indicate an
� adequate septic system can be constructed, and
due to the fact that this lot is in an area
which the Village plans on sewering. Motion,
� Ayes (5) - Nays (0) .

Massengale moved, Butler seconded, that VARIANCE
Diamond Construction' s application for a Diamond Construction

requirements as well as from Ordinance No. 149

� Butler moved, Welsh seconded, that a variance VARIANCE
from Ordinance No . 149 be granted for Lot J 2914 Casco Point Road
� of RLS 461, 2914 Casco Point Road, because
of the availability of sewer and water and
• due to the fact that the comprehensive plan
. will not alter existing zoning. Motion,
Ayes (5) - Nays (0) .
� Mr. Stevenson ' s request for a lot width VARIANCE
variance and a variance from Ordinance No . 149 3133 Casco Point Road
� was referred to the Planning Commission for
their comments .

� In depth studies of the south Highway #12 WATERSHED SUBDISTRICTS
� and Orono School subdistrict and the Eisinger
subdistrict were approved as described in
� Tom Louck' s memo of September 24 , 1973 ,
but the Cnuncil asked to have Eugene Hickok
� talk with the Council before the third
subdistrict was defined.
� The Council scheduled meetings for October 2 , 1974 PROPOSED BUDGET
� 3 , � 4, 1973, to review the preliminary budget.
� Massengale moved, Butler seconded, that RESOLUTION #510
� Resolution #510, A Resolution Providing For Delinquent Charges
The Collection Of Delinauent Sewer � Water
� Usage Charges , be adopted. Motion, Ayes (5) -
• Nays (0) .
� Welsh moved, Massengale seconded, that RESOLUTION #511
� Resolution #511 , A Resolution Appointing Election Judges
Election Judges For The Primary Election To
� Be Held October 23, 1973 , If Necessary, And
The General Election To Be Held November 6,
� 1973, be adopted. Motion, Ayes (5) - Nays (0) .

Massengale moved, Butler seconded, that public RESOLUTION # 512
hearings regarding the Comprehensive Sewer Comprehensive�wer Plan
, Plan be scheduled for October 18 , November l,
� and 8 , 1973 at the Orono Middle School . Motion,
Ayes (5) - Nays (0) .

Mayor Oberhauser asked that the Zoning SUBURBAN LEAGUE OF
Administrator attend the October 4 , 1973 MUNICIPALITIES
� meeting for the Suburban League of Munici-
palities .
� Mayor Oberhauser suggested that anyone that LETTER FROM RICHARD MENKE
could, should attend a meeting regarding Legis- House of kepresentatives
♦ lative Hearings on Metropolitan issues in Shako- 36B
. pee on September 26, 1973.
S Butler moved, Massengale seconded, approval ASSESSMENT ROLLS
of the assessment roll for the street lighting 68SL- 1
project , 68SL-1. Motion, Ayes (5) - Nays (0) .
� The Council directed the Village Attorney to NEW MINNESOTA ELECTION
check on whether the new election would allow LAWS - Chapter 123
� the Mayor to run every even year and Council
• every odd year. A situation that the Council
would want to avoid is where the Mayor and two
Cuuncil members would be running in the same
year.

� Dorn moved, Butler seconded, that the Village BLINKING LIGHT BID
accept bids for a blinking light upon receipt #12 � Old Crystal Bay Rd.
� of MAS approval for the use of funds on this
project, and if MSA approval is not received,
t:�en the Village should proceed with its own
funds . Motion, Ayes (5) - Nays (0) .
� Oberhauser moved, Butler seconded, that the
� State proceed with plans and specifications
for the channelization of traffic and the
• installation of automatic lights for the
. Highway #12 and Old Crystal Bay Road intersection
in 1974 . Motion, Ayes (5) - Nays (0) .

The Village Engineer was directed to get legal
descriptions of the needed slope easements and
� report back to the Council with this information
at its October 9 , 1973 meeting.

� Oberhauser moved, Massengale seconded, to RESOLUTION #513
adopt Resolution #513, which would authorize Authorizing Engineer to
the Village -Engineer to request necessary Reauest Technical Services
technical services from the Minnesota Highway
Department with the costs being born by the

� The Council felt that the conditions of the EBERHARDT CONSTRUCTION
, Eberhardt bond has been met and it should be BOND
allowed to expire .

The Village Engineer was asked to contact NSP UNDERGROUND LINE ON
Northern States Power Company and Lake BIG ISLAND
� Minnetonka Conservation District regarding
a permit to bury a power line . NSP should be
instructed not to proceed until they receive
, approval from the Village and the LMCD.
�
Dorn moved, Butler seconded� that the Village PARTENWOOD
accept the dedicated street right-of-way in the
Partenwood Plat with a $1 , 000 performance bond
or certificate of deposit for a one-year time
period. Motion, Ayes (5) - Nays (0) .
� The Council directed the Village Engineer to FERNDALE ROAD
ask the City of Wayzata to remove the dirt
� barricade on F erndale which was placed within
the Village limits of Orono.
• Butler moved, Massengale seconded, that the BILLS
All Fund Accounts 14599 through 14645 and
t Liquor Store Accounts 9600 through 9629 ,
be paid. Motion, Ayes (5) - Nays (0) .
� Massengale moved, Butler seconded, that the ADJOURNMENT
meeting be adjourned at 11 : 55 P.M. Motion,
� Ayes (5) - Nays (0) .
