RESOLUTION OF THE CITY COUNCIL

� � � A RESOLUTION GRANTING A VARIANCE TO �
MUNIEIPAL ZONING CODE SECTION 34.552-FILE #800
WHEREAS, Thomas Burnevik (hereafter "the applicant) has an
interest in the property located at 3630 Northern Avenue within the
, City of Orono (hereafter "City" ). and legally described as follows :
That part of Lot 6, Block l0 , Townsite of Langdon Park,
described as follows:
, Beginning at the ,Southwest corner of said lot; thence North
along the West line of said lot a distance of 150 feet; thence .
deflecting right 90° a distance of 50 feet; thence South ,
' parallel with said West of said lot; thence Westerly along
said South line to the point of beginning and that part of
Northern Avenue, vacated lying be�ween� the Southerly �
extensions of the East and West lines of said above described -
� property; (hereafter "property") ;
WHEREAS, the applicant has applied to the City for variances .
to Municipal Zoning Code Section 34.552 to permit the construction of a
� new residence on a lot with 7500� sq. ft. existing instead of the required
21, 780 sq. ft. and to approve a lot wi,dth of •5o' instead of the required
100 ' . .
NOW, THEREFORE BE IT RESOLVED by the City of Orono, Minriesota:
Findings � . �
1) This application was reviewed as Zoning File #800 �
2) The property is located in the LR-1C Single Family Lakeshore
Residential Zoning District
3) The Orono Planning Commission reviewed this application
on November 21, 1983, and recommended approval of the proposed
. variances as amended based upon the. following findings:
a) There is no available vacant land available to be
combined with the property "
b) Sewer and water assessments have been levied against
the property �

� d) The property could never be developed to meet all
�standards of the LR-1C Zoning District �
4 . The City. .Council has considered this application including
_ . �the findings� and recommendations of the Planning Commission, .
� reports by staff, comments� by the owrier. and the affect of the
' proposed variance on the �health, safety, and welfare of the
. commuriity.
� �5. . The City .Couricil finds that the conditions existing on this
' progerty. :are peculiar to it and do not apply ,generally to 'other
, •property in •this zoning district; that granting. the. variance
. .. would not adversely affect traffic conditions, light, air nor
'�pose .'a '.fire hazard. or other danger to neighboring property;
• � wbuld not merely serve as a� convenience to the owner, but is
' � � necessary to .preserve a substantial property .•right of the owner;
� - and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive plan of the City..
. • .� � Conclusions, Order, and Conditions:
� Based upon the . above findings, the Orono City Council hereby
grants variances to Zoning Code Section 34.552 to permit the construction
of a� new' residence on a lot with 7500 sq. ft. existing .instead of �the
required� 21,780� sq. ft. and to approve a lot width of 50 '. instead� of the
. �required 100 ' , subject to the following conditions:
1) Demolition permit must be obtained from City .prior to
the removal of existing house •
, 2� Water ass�ss:nen� must be paid in �ull with builclinQ
Aermit.
3) Hardcover limitation r�pt to exceed� 35�, including decking,
� patios,� garages, etc. � .
� 4) Applicant placed on notice that there are hardcover .
limitatiflns � ��
. � 5) Applicant to grant 5 ' drainage easement along the east
. , property line to City.. Applicant to provide legal description
. • . ' for drainage easements to be filed in �the chain of title.

6 . Authorities granted by this variance run with the
property, not with the owner, �but are permissive only and
must be exercised by applicant for a building permit within
one year of the date of Council approval, or the variance
will expire on that date (December 1�, 1984) .

7. Violation of or noncompliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
8 . The undersigned owner has read, understood and hereby
agrees to the terms of this resolution and on behalf of �
himself, his heirs, successors, and assigns, hereby agrees
to the recording of this resolution� in the chain of title
of the property.
Adopted by the City Council of the City of Orono, Minnesota at a regular
