I am writing to advise on a Code of Ordinances violation at 1255 Dickenson Street (Sec. 18-238).The property in
unkempt and a hazard.This property has weeds that are knee high throughout and is an eyesore to the surrounding
neighborhood.
I live at 1225 Dickenson Street and on behalf of my family and the others in our neighborhood, I request that immediate
action be taken.

Sec. 5i-1. Maintenance of private property. �'
a) It is the duty of the owner of every vacant property and the owner and o¢cupant
of every occupied property to maintain the property in a neat, cle n and
,presentable manner free of any junk, debris, refuse, litter, dead trees, or �oxious
weeds, and to remove all other public health or safety hazards from the prpperty.
(b) The owner or occupant of every lot or parcel shall regularly cut or otlherwise
maintain all grass and weeds on the property at a height of not more than six
inches, except this provision shall not apply to the following: � .
(1) Publicly owned parks, trails or nature areas.
(2) Property actively being farmed or used for agricultural purpolses in
conformance with chapter 78.
(3) Residential properties in excess of one acre gross lot size when lo ated in
the RR-1A, RR-1B, LR-1A and RS rural residential zoning districts, p ovided
that such properties or portions of properties shall be maintai ed in
conformance with this subsection upon notice from the city that lack f such
maintenance has caused complaints from abutting property owners and is
thereby creating a public nuisance.
(4) Wetlands vegetation as defined in chapter 78. I
(5) Grass, weeds or underbrush on any slope in excess of 100 perc�nt (45
degrees). �
(c) Any violation of this section is declared to be a nuisance and a public saf I ty and
welfare hazard, and upon seven days' written notice to the owner, as sh�wn by
the records of the office of the county auditor, of private premises on whidh such
material is found or any conditions in violation of this code section exist, he city
may remove such matter or correct any conditions in violation, and ce�ify the
�ost of such removals or corrections as any other special assessment.

is in violation of City Code Section 58-1(b).

Sec. 58-1. Mai�htenance of private property.
(a) It is th�: duty of the owner of every vacant property and the owner and occupant of every occupied
propert�r to maintain the property in a neat, clean and presentable manner free of any jun , debris, refuse,
litter, dead trees, or noxious weeds, and to remove all other public health or safety h zards from the
propert�r.
(b) The ow!ner or occupant of every lot or parcel shall regularly cut or otherwise maintain all rass and weeds
on the�property at a height of not more than six inches, except this provision shall ot apply to the
followi g:
(1) Pu�licly owned parks, trails or nature areas.
(2) Prqperty actively being farmed or used for agricultural purposes in conformance with �hapter 78.
(3) ReSidential properties in excess of one acre gross lot size when located in the RR-1 , RR-1B, LR-1A
and RS rural residential zoning districts, provided that such properties or portions o properties shall
be �maintained in conformance with this subsection upon notice from the city t at lack of such
ma�ntenance has caused complaints from abutting property owners and is thereby reating a public
nuisance.
(4) W�tlands vegetation as defined in chapter 78.
(5) Gr�ss, weeds or underbrush on any slope in excess of 100 percent(45 degrees).
(c) Any violation of this section is declared to be a nuisance and a public safety and wel are hazard, and
upon s�ven days' written notice to the owner, as shown by the records of the office of th county auditor,
of priv te premises on which such material is found or any conditions in violation of t is code section
exist, tMe city may remove such matter or correct any conditions in violation, and certify the cost of such
removals or corrections as any other special assessment.
