HomeMy WebLinkAbout#4345-approving plat-1999 •+ !r. , J� /� �1V' O O , CITY of ORONO � � ti ti RESOLUTION OF THE CITY COUNCIL �L9kESII�4'�G NO. tl„��. �,_ A RESOLUTION APPROVING THE PLAT OF JACOBS MILL FILE NO. 2526 WHEREAS,the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and VV��REAS,the City Council has considered the application for a subdivision of a seven(7) lot residential development by James P.Deanovic and Deborah W.Deanovic (hereinafter "the subdivider"); and WHEREAS,the subdivision has been found to meet all standazds of the RR-lA, 5 Acre Sin?le Family Rural Residential Zoning District fmding that each lot is of a size and configuration that would allow its use for a single family residence to be fully developed; and WHEREAS,the subdivider has completed or has agreed to complete all requirements of the platting regulations of the City,including: 1. Completion of all the requirements of Resolution No. 4330,the resolution granting preliminary approval of the Class III subdivision. 2. Dedication on the plat of standazd perimeter drainage and utility easements. ;. Designation and dedication of drainage easements over the stormwater pond and designated wetlands within the plat. 4. A Homeowners Association has been developed for ownership and maintenance of ' the private road to be located within Outlot A. The Homeowners Association shall also be responsible for maintenance of all stormwater facilities serving the subdivision. Subdivider has granted to the City an underlyina Road and Utilities Easement for Outlots A,B and C. 6. The City Engineer and MCWD (Permit 99-169) has approved the grading and drainage improvements on this property. 7. Creation of covenants for all lots for protection of drainfield sites, including protective language for alternate septic sites along with site plans locating both primary and alternative sites, and alerting future property owners of the need to protect sites on adjacent properties. 8. Execution of a Subdivider's Agreement providing for the installation of drainage and stormwater facilities required as a condition of subdivision approval, and posting of � security to ensure that these required improvements aze completed to the City's satisfaction, the design of said improvements subject to approval of the City Engineer. 9. A drainage easement has been granted to protect wetlands and ensure BMPs for the buffer strips located within Lots 1,2 and 3, Block 2. 10. Payment to the City for the final plat review fee and fee for legal review and filing of the plat, easements and covenants in the amount of$400.00. 11. Payment to the City for park dedication fees for the creation of seven(7) new lots in the amount of$34,300. 12. The private road within Outlot A shall be known as Jacobs Mill Road. Pa�e 2 of 4 •� � / /� O� O O , C ITY of ORONO � � ti ti RESOLUTION OF THE CITY COUNCII ��9k'ES�I�g'�G NO. 4 :3 � � NOW, THEREFORE, BE IT RESOLVED,that the City Council of the City of Orono hereby approves the plat of Jacobs Mill, Hennepin County, Minnesota, subject to the followina conditions: 1. All identified primary and altemate sewage system drainfield sites v�ithin the subdivision shall be fenced off prior to any land alterations, and such fencin� shall remain in place until such time the individual lot is developed and the Ciry Septic Inspector authorizes removal.' 2. The stormwater improvements shall be constructed to City requirements, subject to the Developers Agreement executed between the City and the developer. Drainaae and stormwater improvement construction can begin as soon as the final plans ha�-e been formally approved by the City Engineer and the Developers Agreement has been executed. 3. Outlots B and C shall be undeveloped until the City determines access is required to the west at shich time the road shall be opened and developed to the requirements listed in Municipal Code Section 11.33, Subdivision 4. 4. Per Hennepin County request 27'of existing right-of-way easement is dedicated for public right-of-way as shown on the plat as Rolling Road. 5. No building pernuts shall be issued until the stormwater management impro��ements have been completed and road is constructed by the developer and appro��ed by the City Engineer and Director of Public Services. 6. Prior to City release of the plat for filing, applicant shall provide evidence of fee ownership of the property in a form acceptable to the City Attomey, and applicant shall meet any other title requirements and requirements of Preliminary Plat approral as may be required by the City Attorney. 7. Applicant shall provide all documents noted in this resolution in a format acceptable to the City Attorney prior to release of the plat for filing, and shall • complete all conditions to the satisfaction of City staff,prior to release of thz plat for filing. The aforesaid plat shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registraz of Titles Office on or before March 13,2000 together with a cerufied original copy of this resolution and executed copies of the easements and co�enants noted above. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above. In that event,it�till be necessary to file a ne�L application with the City of Orono for subdivision review. Dated this 13th day of September, 1999. ATTEST: � � Lin�a S.
