I have reviewed the permit application for a proposed house and pool at 3625 Jacob Mills Rd and have the following
comments:

1. Has a wetland delineation been performed in the last 5 years? I could not find documentation in the file to
indicate the wetland boundaries shown in the survey were delineated.
2. Minnehaha Creek Watershed District permits will be required and we will need to have the approved MCWD
permits before approving the building permit.
3. There appears to be several retaining walls being proposed. There is a wall along the NW side of the proposed
pool where the top and bottom elevations of the retaining wall are not called out and need to be added to the
survey.
4. The wall NE of the proposed garage is shown to be at 4' in height. Any wall over 4' in height or any tiered walls
over 4' in height and not separated by more than 2x the height of the taller wall (as measured from face of
upper wall to back of lower wall) engineered plans and specifications signed by a registered professional
engineer.
5. The proposed contours should be labeled.

A wetland delineation was conducted at 3625 Jacobs Mill Road in the City of Orono by Kjolhaug
Environmental Services on Apri112,2012.The boundary&type of the delineated wetland boundary was
reviewed in the field on July 15,2013 by Wenck Associates staff on behalf of the Minnehaha Croek
Watershed District(MCWD).
Three wetlands were identified on the properiy. Wetland 1 was identified in the delineation report as a
Type 4 deep marsh/shallow marshlfresh meadow;Wetland 2 was identified as a'I�pe 1 partially drained
fresh meadow;and Wetland 3 was identified as a Type 1 fresh meadow.Wenck staff confirmed that the
wetland boundaries were delineated accurately and that the wetland types were identified correctly for all
three basins.
MCWD approves the wetland boundary&type as delineated in the field and documented delineation
report dated May 24,2013. This decision is valid for five years. A project on this property may require a
permit from the MCWD.

Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the
approval of a Wetland Replacement Plan is conditional upon the following.
❑ Financial Assurance: For project-specific replacement that is not in-advance, a financial
assurance specified by the LGU must be submitted to tlie LGU in accordance with MN Rule
8420.0522,Subp.9(List amount and type in LGU Findings).
❑ Deed Recording: For project-specific replacement, evidence must be provided to the LGU that
the BWSR "Declaration of Restrictions and Covenants" and "Consent to Replacement Wetland"
forms have been filed with the county recoi�der's office in which the replacement wetland is located.
❑ Credit Withdrawal: For replacement consisting of wetland bank credits, confirmation that
BWSR has withdrawn the credits from the state wetland bank as spec�ed in the approved
replacement plan.
Wetlands may not be impacted until all appllcable conditions have been met!

Additional approvals or permits from local, state, and federal agencies may be required. Check with all
appropriate authorities before commencing work in or near wetlands.
Applicants proceed at their own risk if work authorized by this decision is started before the time period
for appeal(30 days)has expired. If this decision is reversed or revised under appeal,the applicant may be
responsible for restoring or replacing all wetland impacts.
This decision is valid for three years from tUe date of decision unless a longer period is advised by the
. TEP and specified in tlus notice of decision.
