dVHEREAS, Gary A. Christensen & Lynn A. Christensen, husband and
wife (hereinafter "the applicants") are the owners of the property located at 3560 Ivy
Place �vithin the Cit�� of Orono (hereinafter the "City") and le�ally described as follows:

WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal 7oning Coc�e Section 78-1288 (a) and (b) to allow
4001.24 s.f. or 47% hardcover �vithin the 75'-?50' setback zone where 25% is normally
allo�ved, 1,3�1 s.f. hardcover �vithin the easterly 0-7�' zone where 0% is normally
allo�ved, and 2,425 s.f. hardcover within the westerly 0-75' zone �vhere 0% is normally
allowed consistent with previous v�riance approvals detailed in the Resolution associated
�vith zoning file OS-3078 in conjunction with a half stoiy garage addition.
NOW, TH�REFOR� B� IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #OS-3103.
2. The property is located in the LR-1C One Family Lakeshore Residential
Zoning District which requires a minimum of 0.5 acre in area and a
minimum lot width of 100'.
;, The Planning Commission reviewed this application at a public hearin�
held on May 16, 2005 and recommended approval of hardcover, side
setbacl:, lalce setback, and average lalceshore setback variances based on
the following findings:
a. The property is 0.417 acre in area and has 5�' in width measured at a
line parallel to the shore or 50' in width perpendictilar to the side lot
line.
b. No aclditional land is a�•ailable tor acquisition by the applic�nts t�
mal:e the property conforming in area or ��idth.
c. The property 1115 O-7�' zones on t�vo sides.
d. The appliclnts are proposing t� reorient the roofline; onl�� attic
storaUe, n� additional livin� space i� propo�ed �i=ithin tlze sLlbst�ndard
setbacks.

e. Due to the location of the garage any additions or alterations to the
south or west sides of the garage require variances.
£ Over half of the existing garage is located within 75' of the lalce on the
west side of the property. A variance is required to change an.y portion
of the structure within 75' of the lake.
g. The applicants have agreed to remove portions of nonconforming
hardcover and structure in conjunction with setback variance approvals
for zoning file#OS-3078.
4. The City Council has considered this application including the tindings
and recomrneiidation of the Planning Cormnission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the coininunity.
5. The City Council finds that the conditioiis existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; �vould not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.

Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Orono Municipal Zoning Code Sections 78-350(b) and 78-1288 to
aiiow construction of a half story garage addition with a steeper pitched roof 69' irom the
western OHWL of Lalce Miruietoi�lca and 2.5' from the north side lot line, subjeet to the
following conditions:
l. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A consistent with
approvals associated with zoning file OS-3078. Any amendments to the site plan
which are not in conformity �vith City codes will require further Plannin�
Commission and City Council revie«�.

2. Hardcover in the e�sterly 0-7�' zone shall not increase above the level of 1,351
s.f. or 32.5%, and hardcover in the westerly 0-75' zone shall not increase above
the level of 2.425 s.f. or 42.2%. Hardcover in the 75-250' zone shall be limited to
�,001.25 s.f. or 47% per the proposed plan and hardcover allowance summary as
depicted on E;�hibit A. Applicants are advised that any fiiture requests to increase
hardcover or change the nature of existing/approved hardcovcr shall require City
approval, and increases in hardcover will not likely be approved without
coilcurrent reduction in e�istin�hardcover.
3. A��thorities granted by tl�.is resolution run with the properiy not with the
applicants, but are permissive only and must be exercised Uy obtainin� a b1111C�111a
pennit for the new constnlction within one year of the clate of Council approval,
or the variance will expire on that date (June 13, Z006).
4. Violation of or non-compliance with any of the tei-�ns and conditions of this
resolution shall constitute a violation of the zoninc code, shall atitomatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understanc� and hereby agree to the terms
of tilis resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recordinj of this resolution in the
chain of title of the property.
