All three variance documents noted in the Examiner's report should remain of record.
The referenced utility easement is being used for existing sewer and water utility lines in
the street immediately adjacent to the property, so that easement also should remain of
record. The street right-of-way is extremely narrow at this location (15' ) and the 5'
easement over the Pyle property is necessary for future maintenance of the sewer and water
lines. I can provide you with as-built sewer and water maps if you need them.

The City was served with a Summons related to the Land Title Registration for the
property owned by Charles and Shirley Pyle, and the Hennepin County, Examiner of Titles
required that Orono be named as a Defendant. I have obtained and attached hereto the
Examiner's Report which shows that the Village of Orono was granted an easement for utility
purposes and underground sewer over and under the southwesterly 5 feet of the land being
registered. (See 4(c) of the Examiner's Report), in 1966, which was filed in the office of
the Hennepin County Recorder, as Doc.# 3622491, If the City is still using this and wants
to keep it the City will have to have the Pyle's agree to it or the City will need to defend
it easement rights, in this matter and prove that it is still using the easement and that the
property being Registered is subject to the easement.
Please review the Examiner's Report and let me know if the City is using the easement. If
the City is using the easement I should be able to get the Pyle's to agree that the easement
is still in effect and should be shown on the Certificate of Title in the "subject clause "
as set forth in the Examiner's Report .

TO THE HONORABLE JUDGES OF THE DISTRICT COURT OF HENNEPIN COUNTY
Pursuant to Minn. Stat. § 508.13, the undersigned Examiner of Titles has examined the title of
the Applicants to the land described in the Application, investigated the truth of ail matters set
forth therein, determined whether or not the land is occupied, and, if occupied, the nature
thereof and by what right the occupation is held, and also whether ar not any judgments against
the Applicants or those through whom the Applicants claims title may be a lien upon the land
described in the Application. I have searched the pubiic records, and fully investigated all facts
brought to my notice pertaining to the title, including an inspection report by the County
Surveyor. This report to the Court contains the substance of the proof and a Certi�cate of
Opinion upon the title.
1. At the time the Application was filed, the Applicants were the record owners of
the land described in the Application and as follows:
Lot 174, Taylors Subdivision of Spring Park Lots.
2. According to the Application and the Hennepin County Surveyor's Inspection
Report on file herein, the property being registered is occupied by the Applicants.
3. Pursuant to mortgage County Recorder poc. No. 9714096, the following concluding
statement should be contained in the"subject clause°of the Decree of Registration:
To a Mortgage in favor of Mortgage Electronic
Registration Systems, Inc. as mortgagee and as
nominee for CU Members Mortgage, a division of
Colonial Savings, F.A., as lender, filed November 8,
2011, as County Recorder poc. No. 9714096, in the
original principal amount of$155,000.00.

4. I note the following encumbrances, defects and irreqularities:
(a) Two abstracts were filed in this matter, a partial abstract from Chicago Title
Insurance Company containing abstract entries numbered 94-107, and a full abstract from Land
Title containing abstract entries numbered 1-132. All abstract entries referred to in this report
will relate to the full abstract. Abstract entry no. 94 certifies the abstract of title for entry nos. 94-
132 from July 23, 1994 to June 4, 2014. The July 23, 1994 date appears to be a typo as the
certification for entry nos. 1-93 is dated July 23, 1984, and therefore a 10 year period from that
date to July 23, 1994 has not been certified. Prior to issuance of the Land Title Summons, the
Applicant must obtain and file a new Certification of the abstract of title to land in Hennepin
County. Your examiner will then issue a Supplemental Report, if necessary.
(b) Paragraph "I" of the Application discloses the desire to register the eastern and
western boundary lines; however, I assume Applicants intend to register the northwesterly and
southeasterly boundary lines. Paragraph "H" of the Application states that these boundary lines
have been established by boundary by practical location based on express agreement on
August 15, 2008. Prior to the issuance of the Land Title Summons, there must be filed herein a
Plat of Survey, certified to the legal description at paragraph 1 of this Report, containing a
certification.by a licensed surveyor similar to the following: i

The survey should locate the boundary lines by reference to "well-known permanent
landmarks." Minn. Stat. §559.25.Typically, the landmarks will be section corners maintained by the
Hennepin County Surveyor pursuant to Minn. Stat. §381.12. The Applicants' surveyor may contact
the Hennepin County Surveyor or the Examiner of Titles for guidance in the selection of
appropriate landmarks.
At the time of the hearing, evidence will be received as to the title of the Applicants and
as to the location of the no�thwesterly and southeasterly boundary lines. At that time only an
Interlocutory Order adjudicating the location of the boundaries and directing that they be marked
by Judicial Landmarks wili be entered. After the Judiciai Landmarks have been placed, the
Applicants' surveyor should prepare a plat of survey showing the location of each of the judicial
landmarks. The surveyor's certification on the piat should be in a form such as the foilowing:
I hereby certify that pursuanf to the Onder of the District Court of Hennepin
County, Fourth Judicial Dlstrlct, Sfate of Mlnnesota, dated�F►er�s insert date of
lnter�ocutory Order], Torrens Case No. 27-ET-CV-14-456, Judicia/Landmarks
have been placed as shown on the annexed plat Each Judicia! Landmark
consists of a (describe size, shape and materials of judicial landmar�ks) with
letters cut or marked thereon reading"Judicial Landmark':
The case may then be placed again on the Land Title Calendar at which time the
Decree of Registration will be entered. Two copies of the Plat of Survey showing the location of
the Judiciai Landmarks should be submitted when the case is again placed on the calendar for
hearing, one of which will be filed in the Court file and the other will be certified by the Court
Administrator and must then be filed with the Registrar along with the Decree. Said certfied
Plat of Survey will be shown as a�memorial on the Certificate entered pursuant to the Decree.
To conform to the General Rules of Practice for District Courts, Title III, Part A, Rule 211,
the legal description in the final Decree must be followed by this statement:
The northwesterly and southeasterly boundaries of said land
have been marked by Judicial Landmarks set pursuant to
Order in Torrens Case No. 27-ET-CV-14456.
I recommend as defendants the owners and encumbrancers of the adjoining Lot 173,
currently discfosed by the records of the Hennepin County Recorder to be Willfam S. Damaler
and Joan I. Dampfer, as Joint tenants, as shown by Doc. No. 5074842, and CU Morts�a�e
Services. Inc., as shown by Doc. No. 8101277 and City County Federal Credit Union, now
known as Win�s Financial Credit Unlon as shown by Doc. No. 8942987. I aiso recommend as

� defendants the occupants of said land whose names must be ascertained by the applicants'
attorney and listed in the Land Title Summons.
I recommend as defendants the owners and encumbrancers of the adjoining Lot 175,
which is registered property, currently disclosed by the records of the Hennepin County
Registrar of Titles to be Marv F. Drazan and Michael Drazan, as joint tenants, as shown by
Certificate of Title No. 1111495, and I again recommend Mortaaae Electronic Reaistration
Svstems, Inc., as nominee for Summit Mortaaste Coraoration, a Mtnnesota coraoratfon, as
shown by Doc. No. 4949892. I also recommend as defendants the occupants of said land
whose names must be ascertained by the applicants' attomey and listed in the Land Title
Summons.
As previously mentioned, the land adjoining to the southwest is registered and therefore
the Order and Decree of Registration should contain an additional Order to the Registrar of
Titles, as follows:
IT IS FURTHER ORDERED,that the Registrar of Titles:
receive for registration on Certificate of Title No. 1111495, a certified copy of the plat of
survey on file in Case No. 27-ET-CV-14-456, showing the placement of Judicial
Landmarks, and show by memorial on said Certificate of Title that the northwesterly
boundary line of the land described therein has been marked by Judicial Landmarks;
and in future Certificates of Title issued for the land described in said Certificate of Title,
the Registrar place in the body of said Certificate of Title immediately following the land
description the statement "The northwesterly boundary line of the above-described land
has been marked by Judiciai Landmarks set pursuant to Order in Case No. 27-ET-CV-
14-456(Document No. [Registrar insert document number assigned to this Orderj)."
(c) Abstract entry no. 62 contains a permanent easemen for utility purposes and
underground sewer granted in 1966 in favor of the Village of Orono over, under, and across the
southwesterly 5 feet of the land to be registered. The Application and the Inspec�on Report
make no mention of this easement. I assume there will be evidence at the hearing to support a
Finding in the Order to be entered in this matter that the easement recoMed wifh the County
Recorder as Document No. 3622491 no longer affects the land being registered and has

Northern States Power Comaanv as a defendant. If the power provider is a company other
than Northern States Power Company (where statements would come from Xcel Energy
Company), there should be evidence at the hearing sufficient to sustain a Finding of Fact in the
