Hennepin County, Minnesota(hereinafter the"Property"); and WHEREAS, the Applicants have made application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-1288 in order to permit 60f square feet or 0.8% hardcover consisting entirely of an allowed lake access stair within the 0-75' zone where 0% is normally allowed and 13.6%previously existed; and WHEREAS, the Applicants have made application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-1288 in order to permit 4,665 s.f. or 29.8°/a hardcover within the 75' — 250' zone where 25% is normally allowed and 5,376 s.f. or 34.5% currently exists in conjunction with the construction of a new single family home on the existing lot; and WHEREAS, the Applicants have made application to the City of Orono for a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1286 to allow re-grading of the slope within the 0-75' zone after the removal of wooden retaining walls, a wooden lake access stair and lakeside deck where a conditional use permit for any topographic alteration is required. NOW, THEREFORE BE IT RESOLVED by the City Council of . Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#08-3375. The Property is located in the LR — 1 C zoning district, which requires a minimum lot area of 0.5 acre and a minimum lot width of 100 feet. The Applicants' Property is 23,127 s.f. or 0.53 acres. 3. The Planning Commission reviewed this application at a public hearing held on August 18, 2008 and recommended approval of hardcover variances based on the following findings: a. The Property is 0.53 acres in size when 0.5 acres is required. b. The Property has a lot width of 100 feet where 100 feet is required. c. The Applicants' proposed home meets the 30' height limitation. d. Ivy Place is very narrow and does not allow for any additional parking. e. A 250'-500' zone does not exist on the property which would normally allow for a detached garage and less driveway hardcover within the 75'-250' zone. f. The footprint size proposed is not out of character with the neighborhood, and does not exceed the structural coverage limit for the property. g. The Applicants have proposed to utilize a water filtration and percolation area and a French ditch to manage the excess storm water resulting from the additional 768 s.f. of hardcover on the site. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community_ 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other Property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary Page 2 of 5 �°� 0 0 CITY of ORONO a s ''a' h ti RESOLUTION OF THE CITY COUNCIL ��`9k'Esi3�g'�G NO. 5 7 7 2 to preserve a substantial Property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby , grants variances to Qrono Municipal Zoning Code $ecfion 78-1288 in order to permit 60f square feet or 0.8% hardcover consisting entirely of an allowed lake access stair within the 0-75' zone where 0% is normally allowed and 13.6% previously existed; and 4,665 s.f. or 29.8%hardcover within the 75' —250' zone where 25% is normally allowed and 5,376 s.f. or 34.5% currently exists; and a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1286 to allow re-grading of the slope within the 0-75' zone after wooden retaining walls, a wooden lake access stair and lakeside deck are removed in conjunction with the construction of a new single family home on the existing lot, subj ect to the following conditions: � 1. Council approval is based on the site plan, building plans and stormwater infiltration and percolation system plan submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A, B, and C. Any amendments to the site plan and building plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. The water infiltration and percolation system design shall be submitted for approval by the City Engineer prior to issuance of a building permit. 3. ADDITIONAL SURVEYS REQUIRED: a. A foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building permit, stormwater management, grading and drainage plans shall be submitted . prior to the issuance of�a Certificate of Occupancy for the residence. 4. The building plans submitted for building .permit will be reviewed to ensure compliance with the City's building height and number of stories regulations. �� 5. Hardcover in the 0-75' zone shall be limited to 60f square feet or 0.8% hardcover consisting entirely of an allowed lake access stair; and hardcover within the 75'- Page 3 of 5 �°� � 0 0 � CITY of ORONO a , � ti ti RESOLUTION OF THE CITY COUNCIL ��9kESI3���G NO. 5 7 7 2 250' zone shall be limited to 4,665 s.f. or 29.8% hardcover per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 6. Authorities granted by this resolution run with the Property not with the . _ Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (September 22, 2009). 7. Violation of or non-compliance with any of tlie terms and conditions of this resolution sha11 constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 8. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the Property.
