HomeMy WebLinkAboutagreement for use of accerssory structure-2002 THIS AGREEMENT is made by Leisel R. Cox, the owner of certain property in
the City of Orono, and the City of Orono, located in the County of Hennepin, State of
Minnesota.
Whereas, Leisel R. Cox (Hereafter "the Owner") owns the property at 3509 Ivy
Place and legally described as follows: (Exhibit Attached); and
Whereas, the Owner has applied to the City of Orono for a building permit in
order to tear down an existing house and build a new one on the Property; and
Whereas, the Property also has an accessory building which is a combination
garage and residential unit; and
Whereas, the Owner agrees that Orono ordinances do not allow an accessory use
to be in place on the Property if there is no principal structure on the Property; and
Whereas, the City of Orono is willing to allow the accessory structure to remain
on the Property during the removal of the principal structure and the reconstruction of a
new principal structure, if the Owner agrees to promptly commence and complete the
construction of the new principal structure, and in no case to allow the Property to
continue without a principal structure for more than six months; and
Whereas, the Owner has agreed that the accessory use shall be modified so that it
is no longer available as a residential property, and that the Owner will apply for a
Conditional Use Permit which controls the future use of the property as a workshop with
running water and a toilet;
Now Therefore, in consideration of these premises, and other good and valuable
consideration, the owner and the City of Orono do hereby agree as follows:
1. The City of Orono will issue a building permit to the Owner for the
construction of a new principal residence.
2. The Owner agrees that she will tear down the existing principle structure and
promptly replace it with a new one, and agree that in no event will the Property be
without a principal structure for more than six months after the date of this agreement.
3. The Owner agrees that if the Owner fails to replace the principal structure
within six months,that the Owner will, at the Owner's expense, at the demand of the City
of Orono, immediately remove the accessory structure from the Property. In the event
that the Owner fails to remove the accessory structure within thirty days of demand by
the City of Orono, the City may enter the Property, remove the structure and recover its

costs from the Owner, or assess the Property in order to recover the costs, as the City
determines is in its best interest.
4. The Owner agrees that the Owner will cease to use the accessory structure as a
guest house or rental unit, and will apply for a Conditional Use Permit on the accessory
structure to allow its use as a workshop with running water a toilet and a tub or sho,wer,
but no further residential use. The Owner further agrees and understands that the City
Council may, in its review of the CUP, deny the inclusion of a toilet and a tub or shower
in the property.
IN WITNESS WHEREOF, Leisel R. Cox and the City of Orono sign this
document below. This Agreement is effective as of the date set out below.
