A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-305 FILE NO. 08-3343 , . , � O� O O CITY of URONO a :. � ti ti RESOLUTION OF THE CITY COUNCIL ��`9kESi1�g'�G NO. 5 7 3 4 A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-305 FILE NO. 08-3343 WHEREAS, Strong Arm Construction Services,LLC, a Minnesota limited liability corporation (hereinafter"Owner")is the owner of the property located at 460 East Long Lake Road within the Ciry of Orono(hereinafter "City") and legally described as: See Exhibit A(hereinafter"the Property"); and WHEREAS, Strong Arm Construction Services, LLC has made application on behalf of the Owner to the City for a variance to Municipal Zoning Code Section 78 305 to - construct a house on the Property which has a defined lot area of 0.59 acre when two acres is required; and WHEREAS, Strong Arm Construction Services, LLC has made application on behalf of the Owner to the City for variances to Municipal Zoning Code Section 78-305 to construct this house with a 43-foot front setback when a 50-foot setback is required and a 10- foot south side setback when a 30-foot setback is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on February 19, 2008, at which times all persons desiring to be heard concerning this application were given the opporfunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#08-3343. 2. The Property is located in the LR-lA zoning district, where two acres is the minimum lot azea and 200 feet is the minimum lot width. The Property is approximately 0.84 acre (0.59 acre non-wetland)in azea and 203 feet in width. 3. The Planning Commission reviewed this application on February 19, 2008 and Page 1 of 5 _ • �O� O O CITY of ORONO � s � ti ti RESOLUTION OF THE CITY COUNCII ��`9k'ESS�g'�G NO. � 5 7 3 4 on a vote of 6 - 1 recommended approval of the variances, based on the following findings: a. The Property is served by City sewer. b. There is no adjaeent property available for the Owner to purchase to enlarge the property to two acres non-wetland. c. There has been a house on the property for over 50 years. d. Although the lot is rectangular the non-wetland portion of the lot is triangular. Its effective width is 130 feet. e. The proposed front setback is the same as the adjacent house at 450. A larger front setback variance would not be compatible with the other houses on East Long Lake Road. f. Although the Owner is reducing the size- of the lot by a Lot Line Rearrangement, the reduction is based on an apparent surveying error made about 50 years ago that resulted in the neighboring house being on the Owner's property. The Owner was not aware of the error until after the property was purchased. The lot line rearrangement and the side setback variance will allow quick resolution of this very serious problem. The alternative would be to resolve the problem in the courts. This would be a severe hardship, both financial and emotional, to the neighboring property owner. This is a very unique situation. g. Side setback variances have been granted for properties zoned LR-lA that are substandaxd in area and width. h. The house has been designed to fit the shape of the lot as much as possible. It will be compatible with the character of the surrounding area. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comtnents by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owner but necessary to alleviate a demonstrable hardship or difficulty; are necessary to preserve a substantial property right of the Owner; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. - CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Section 78-305 to allow construction of a house on a LR-lA zoned lot with a defined lot area of 0.59 acre with a 43-foot front setback and a 10-foot south side setback, subject to the following conditions: 1. The Lot Line Rearrangement approved by Resolution No. 5735 being put into effect. 2. Council approval is based on the site and house plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits B and C. Any amendments to these plans may require further Planning Commission and City Council review. 3. The Owner shall grant the City a road and utility easement over the westerly_ 19.58 feet of the property, to reflect the historic right of way of East Long Lake Road. 4. The Owner shall execute Flowage and Conservation Easement and Restrictive Covenant for Wetland and Wetland Buffer prior to issuance of the building permit for the house. 5. The Certificate of Occupancy shall not be issued until an as-built grading plan verifying compliance with engineering and zoning approvals has been submitted and approved. Any deviation from the approved plan may require Planning Commission and/or City Council review. Authorities granted by this resolution run with the Property not with the owner, but are pemussive only and must be exercised by obtaining a building permit for the new construction before March 10, 2009 or the variance will expire on that date. 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 8. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of its successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
