5/18/81 I was called by Ylalter I3enson, City Administrator,
at 7: 15 a.m, He was receiving complaints by neighbors
in the area of the Iv�v Place f.ire lane that Mr. Wiison,
of 350� Ivy Place was doing some work on the fire
lane without pe-�mits.
5/18/81 I checked the fire lane at 8:00 a.m, and verified
that some grading and cleari:�� of the :ire lane
had taken nlace.
5/18/81 John Gerhardson and I made another site insnection
at 9:00 a.m. a� this tir.te John noticed that the
culvert was covere3 and olugged up, Gnd that the
drainage was changed.
We lefL the fire lane an� �vent to :Lot 1�4, Taylor's
Subdivision of Sp.ring Yark Lots (vacant J_ot) and the
street right of way ror Mapl.e Place (un�.ml�roved street) ,
we f�und that C�UIri��lIlg h«a occurred there. Photns
` were taken af both si�es.
5/19/8.1 I snoke to Steve ��ils.on �3bout the work which was
done on the fire lane ,�r�d the �acant lot. At tha�
time we set up a meetin� for M�.v 28, 1981, at 10•60 a.m.
to discuss what must �e done.
5/21/81 I made another inspection to take more photos and
check the site, there was an attempt to unplug the
culvert, but water still will not drain away from it.
5/21/81 A certified letter was s`nt (see attached) .

Mr. Wilson:
We have reczived a number of complaints that yo�. have been doin��
some grading and clearing of the fire lane on ivy Place.
An inspection conducted May 18, 1981 revealed certain violati�ns,
as follows:
`�r 1) Work was done on City property_ without authorization from
the City or any permits issued.

2) Culvert was covered, restrzcting the water to follow the
natural flow.
3) Grading whir_h was dcne also restricts drainage from its nat-
ural flowo
4) Debris from the fire lane which ::as reinoved was taken to lot
184 Tay].ors subdivision of Spring Puric l�ts and unimproved
street right. of way.
To confirm our t��lephone convezsation on May 19, 1981. The fo�-
lowing items were discussed:

On Thursday, May 25, 1981, John Gerhardson and myself_ had a
meeting with Steve Wilson, 3508 Ivy. At this meeting �ae discussed
the following:
l. Grading that had been done. P^.r. Wilson said that he would
be seeding the area.
2. Chunr,e in flo�a of drainage. H� said he wants to rip rap
the ditch ar.d restore th� drainage b�ick to how it was. We
told him to su�mit some plans, and tha� this would be a
good idea.
3. ��e did locate another �urvey stake down by the lake on PRr.
Wilson' s �ide of the fire l�ne, The oublic wor�s department
will locate the other lot lines and ��ake them.
4, Mr. Wilscn also said that he and Mr. Lovestrand, 3486 Ivy
would li�ce to clean out under the bushes.
5. We explained to t�r. Wilson that when ever work is to be done
on the fire lane he is to notify the City of what he proposes
to do and the fire lane is used as public access to the
lake.
Mr. �ailson through out the meeting was verv cooperative and
understanding and said he wc�ll.d notify the City i_E he was going
to do anything on the fire lane again and that he understands that
any work done on the property does not give him any future rights
to the property.

The staff and Council have been researching the status of this

1981 Council meeting, I researched the old tax records cn the

: date3 January 9., 1961, clearly indicating residential occupancy

Bruce Malkerson and I hav� prepared the attached Covenants and
'� Agreements following direction of the Council at their December 14,
"'' 1981 meetin�. (It was felt that this format to be recorded in

I m�t with Mr. Wilson and delivered copies of this agreement to
;: him today. He stated that he thought he would have no problems
with. it but that he was going to have his attorney review it before
he �igned.
He went on to say that he intends to either remove the plumbing
and convert the building to a shed, or preferably remove it. What
,�,, �,, he seems to want to do is remove this building and add on to his
�'� ' home in its place. This may require hardcover and/or setback

�=:~�` : variances. He suggested some kind of "guarantee" to be added
�'� to this Agreement providing approval to do this work. Such a

This C�venant and Agreement made and entered into this
day of , 19_, by and between Stephen B. Wilson, a
si:�glz person, his heirs, grantees, succe�sor s and 3ssigns (hereinafter
�,-._-, "Wilson") , and the City of Orono, County of Hennepin, State of Minnesota,
�- a rnunicipal corporation (hereinafter "City") :
WHEREAS, Wilson �owns property located within the City of Orono
and legally described as follows:
� Lot Z83, and the southeast half. of Lot 182, Taylor's
Subdivision of Spring Park Lots (hereinafter "Wilson
property"j ; and -
WHEREAS, the City owns controls and has jurisdiction over
"Ivy Lane" a dedicated publi� street right �f way adjacent to two sides
�r o£ the Wilson property (hereinafter "Ivy Lane") ; and
�- WHEREAS, there is or has been occupancy of two separate
dwelling units on the Wilson property which occupancy use and density
{ ,,.:;_ . is contrary to the applicable �egulations in the Orono Zoning Code; and
��¢�` WHEREAS, Wilson or his predecessors in title have erected

and Wilson is maintaining private improvements within the public Ivy Lane

F � NOW, THEREFORE, in consideration of the foregoing and the terms,

taxation and zoning purposes on or before March 1,

���� Upon termination of rental use of the secondary dwelling,
said buildin� shall be removed or shall thereafter only

unit of residential occapancy of the Wilson praperty
�.� in conformance with applicable zoning regulations.

3) The portion of Ivy Lane which runs down to and
terminates at the shoreline of Lake Minnetonka
� is presently intended for purposes of walking
access to the lake by the general public, for
occassional emergency fire lane access to the lake.
, Wilson agrees not to obstruct, interfere with or
discourage such use of Ivy Lane. Vehicles, trailers
and other objects shall not be parked or stored within
the Ivy Lane rig}�t of way except on the existing
paved driveway and parking area.
:rt 4) Wilson agrees not to alter the grade, fill, excavate
*'` nor remove trees from Ivy Lane without the prior �

>� not preclude Wilson from cutting grass and weeds,

the Ivy Lane right of way for the exclusive benefit
of the Wilson property as shown on a survey prepared
by Gordon R. roffin for the City, dated September. 25,
1981, as follows: �
a) Approximately 1850 sf of paved driveway,
parking and turnaround area. '

� ' provided that the above improvements are not enlarged
or expanded and no new improvements are constructed
within ivy Lane without the prior written approval of
the City. Wilson agrees that this license is permissive
only, and may be revoked by the City for any reason
upon 15 days notice to the then current owner of the
Wilson property in which event Wilson or thQ then
current owner a�rees to remove any such private
' improvements as may be directed by the City, and to
restore the disturbed area of Ivy Lane to a natural
appearance and ground cover. In the event that such
improv�ments 3re not removed within 60 days of such
a notice from the City, the City may proceed and remove
�;:�:�, �" said improvements and the cost of such removal and
restoration shall be assessed against the Wilson property.
Wilson hereby releases the City from any cause of action
