A RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A PLAT AT 1185 HUNTER DRIVE -FILE NO. 2218 WHEREAS, Jyland Development, Inc., a Minnesota corporation, (hereinafter the "developer")on February 21, 1997 filed a formal subdivision application with the City for approval of a four lot residential plat of property legally described as: Lot 1, Block 1, Ten O�S, Henaepin County; Minnesota (hereinafter "the property"); and W�REAS, after due published and mailed notice in accordance with Minnesota Statutes 462358 et. seq. and the City of Orono's Zoning and Planning Codes, the Orono . Planning Commission held a public hearing on March 17, 1997 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, at their regular meeting held on March 24, 1997, the Orono City Council considered the subdivision of Jyland Development, Inc. noting the following findings of fact: . 1. The property is located within the RR-1B Single Family Rural Residential Zoning District requiring a minimum of two acres of contiguous dry buildable land within each newly created lot. � 2. The property contains a total of 21.57 acres, �vhere 18.47 acres is dry buildable and 3.1 acres is wetland. " 3. The proposed plat consists of four resideatial lots each meeting or exceeding the 2.0 acre minimum lot area requirement. 4. Lots 1, 2, 3 and 4 are proposed to front on and access a private road to be constructed �vithin Outlot A. � Page 1 of 5 � � °� . 0 0 - ��. The applicant has provided a grading and drainage plan for the property which will accommodate the current development of four building sites. 6. Lots 1, 2, 3 and 4 have been demonstrated to contain suitable sites for primary and alternate drainfields to serve the proposed single family residences. NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat for Jyland Development, Inc. at 1185 Hunter Drive per the survey dated February 21, 1997, most revised date February 28, 1997, attached as Exhibit A hereto by Coffin and Gronberg, Inc., subject to the following conditions: 1. The applicant shall grant to the City an underlying road and utility easement over Outlot A. 2. Standard perimeter drainage and utility easements shall be granted over the entire plat. 3. Drainage improvements to the property_ shall be constructed per the drainage and grading plan dated February 21, 1997, most revised date February 28, 1997, and as approved by the City Engineer, subject to a Developer's Agreement to be executed between the City and the developer. Private road and drainage improvement construction can commence after the engineering plans for such improvements have been approved by the City, the Developer's Agreement has been executed and Letter of Credit written to 150% of the cost of these improvements submitted to City. 4. Applicant shall pay the standard park fees for Lots 1, 2, 3 and 4 per the current Pazk Fee Ordinance; subject, however, to the review and recommendation of the Park Commission regarding dedication of any land in lieu of a cash contribution. Should the Park Commission recommend a land dedication, which is then approved by the City Council as part of the final plat approval process, the developer will receive a credit for the land dedication as per the Park Fee Ordinance. � 5. Applicant shall develop covenant for Type I and III wetlands within Lots 1 and 2. The purpose of the covenant is to alert all future property owners of the need to protect the azea if alterations are proposed to first obtain the necessary Page 2 of 5 � � �� O O - . Protection of drainfield sites via fencing shall be placed prior to construction of roadway and drainage improvements, and shall remain in place until residences � aze completed on all four lots. 7. Outlot A shall be given a new road name, and address assignments for Lots 1, 2, 3 and 4 shall be consistent with the grid system. . 8. Applicant shall designate Orono wedands as drainage easements on the plat and grant flowage and conservation easements. 9. Applicant shall create maintenance covenants for road and drainage improvements. 10. No building permits shall be issued until a satisfactory road base drainage improvements are installed per City Enaineer's approval. FINAL PLAT SUBMITTALS The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of each month. Required submiftals are as follows: 1. Record plat drawings in the form of two (2) mylar copies and one (1) copy reduced to 1" = 200'. Drawing to include: A. Lot lines platted per preliminary survey by Coffin and Gronberg, Inc. dated February 21, 1997, most revised date February 28, 1997, attached as Exhibit A hereto. B. Dedication of "drainage and utility easements" 10' wide along all perimeter property lines and 5' each side of intemal property lines. . C. Designation and dedication of the Orono designated wedands as "drainage � easements" on the plat. Page 3 of 5 � O� O O -� �. Title opinion addressed to the City: All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. C. Signed and executed Flowage and Conservation Easements over designated Orono wetlands within Lots 1 and 2. D. Signed and executed Developer's Agreement and Letter of Credit for construction of the private road and drainage improvements. . E. Signed and executed Road and Utilities Easement over Outlot A. F. Signed and executed covenants defining responsibility for construction and maintenance of the road in Outlot A, defining future financial . obligations of affected property owners. G. Completed "Application for Private Road Name". H. Signed and executed covenants for Type I and III wetlands within Lots 1 and 2. I. Signed and executed maintenance covenants for road and drainage improvements. 3. Fees to be paid: Total due: 4 . 0 A. Final plat fee = $ 200.00 B. Park Dedication Fee at the rate of 8% of the City Assessor's recommended fair market value of the land prior to development. Such fee shall be determined and paid prior to final plat approval.
