Mark—
We have received the rain garden calculations and revised survey for 1070 Hunter Drive. I have reviewed the revised
floor elevations and find that the confirmed highest existing adjacent grade of 1019.4' and lowering of the house by
approximately 2.5 feet have resulted in defined height being just under 30'which conforms to the code. Accordingly I
have approved the zoning review. However, in reviewing the site plan there are two grading issues that need additional
information before we can issue the permit:
1) We will need engineering on the retaining walls that exceed 4 feet in height.
2) We need a calculation on the square footage of ground to be disturbed,as it appears to be close to an acre and
may require an NPDES permit.
Please provide the required information as soon as possible. Call me or Adam if you have any questions.

I assume you intend to lower the house,which means more than 500 cy excavation to create the walkout level. We
would have to see a plan that works within the 500 cy limit now(or close to it)with the idea that maybe retaining walls
later on could be removed and an excavated area widened to work without them.
We would need to see a plan in order to make a final determination on this.

Mark—
You are using an old Building Height info sheet. See attached 2014 sheet. For a gable or hipped roof that has no
windows within the roof svstem,you subtract half the distance between the highest point of the roof system to the
lowest point of the gable. You can't take into account windows that are below the roof system. So I agree with the 8.5'
subtraction the architect used on his building plans, rather than your 9.3'.
The 1019.4'existing spot elevation at the perimeter of the proposed house needs to be shown on the survey.That likely
helps them out.
Do not even think about revising the grading plan for the site.This lot had no grading,and there is no apparent
justification at this late date to suggest a grading plan amendment.
You can only take advantage of the extra 1 foot of fill in determining whether a basement is a story or not, but not in
determining the defined height. See the attached definitions sheet.

Mike:The existing grade goes up from the 1018 contour to 1019.4 at the proposed house.
Attached is what I came up with for height based on the current house plans. If they can raise the grade 1 foot which
they are allowed can they lower the house 1 foot and be in compliance? They would then have to bring the retaining
wall in a little tighter to stay under the 500 CY of excavation.Would that work?Or could we have George revise the
grading plan for a couple of feet?The problem is they don't want to have the back of the house face County Road 6.

I hope to get a letter out today on this, but here's the main issue: Our review confirms that the lowest level of the
proposed house is a basement by definition, but the defined building height exceeds the 30-foot maximum. The
building plans show the upper dormer with window has been removed,which we advised was necessary. However,the
defined height is required to be measured based on the existing grade where it abuts the house, not the proposed
grade that was used by the architect/designer on building plans(see attached two sketches). The survey suggests that
the highest existing grade at any point on the house perimeter is at or near elevation 1018'. The lower measuring point
used in the height depiction on the plans was approximately 1.5' below the main floor elevation,or about 1022',which
is the proposed grade. Based on the 1018'correct measuring point,the building's defined height is approximately 34',
exceeding the 30' limit. The building plans(and potentially the survey)will have to be revised so the house meets the
30' maximum. There may be a variety of ways to accomplish this, perhaps a combination of reducing the roof pitches,
lowering ceiling heights, reducing joist depths, and lowering the house further into the ground (which impacts the
amount of cut and retaining walls).
I'm also looking for rain garden calculations and specifications,which Scott said you are working on.

Dear Mr.Warren:
Last November upon completion of the Mooney Lake Preserve subdivision the City of Orono in a letter dated November
18,2015 advised your firm of a number of issues with the building permit application. On March 31,2016 we received
from your surveyor Mark Gronberg a revised survey depicting revised locations for the house,septic systems sites,and
driveway,as well as a new grading plan including a rain garden.We noted that a sport court has also been added to the
house.
On April 11, 2016 the City received a revised building permit proposal including revised house plans, updated septic
systems reports, and a landscape plan. Staff has conducted a preliminary review based on the information provided
and recommends the following items be submitted or revised in order for your application to be considered complete
and for the plan review to continue:
1. Certificate of Survey. The Certificate of Survey submitted is lacking certain items which must be added by the
surveyor,as follows:
a. Location of the proposed septic system components(transfer from Rusty Olson report).
b. Top of Foundation. The top of foundation elevation is shown on the survey. Please have the surveyor
show the point or spot on the foundation that the top of foundation elevation is referencing. Please
note,we expect the location to be consistent when submitting the foundation as-built survey.
2. Building Plans — Height Issue. While our review confirms that the lowest level of the proposed house is a

3. Rain Garden Specifications. Your surveyor/engineer must provide calculations and specifications for the
proposed rain garden,for review by the City Engineer.
4. Minnehaha Creek Watershed District (MCWD). As a minimum, you will need an MCWD Erosion Control
Permit.Your project may trigger other MCWD permitting requirements; please contact the MCWD directly at
952-471-0590 regarding your project. Please note,the City of Orono will not issue a building permit without a
copy of the MCWD Erosion Control Permit or documentation stating the proposed project does not trigger any
of their permitting requirements.
5. Prior to the issuance of the building permit a landscape plan must be submitted showing all the proposed
exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc. The plan should
include the name of the individual perForming the work. Any proposed patios, grading, sidewalks, retaining
walls shown on the landscape plan should also be reflected on the survey. OR Will there be any changes to
the landscaping with the proposed ? If so, the City requires a landscape plan be submitted
showing all the proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls,
etc. The plan should include the name of the individual performing the work. Any proposed patios, grading,
sidewalks, retaining walls shown on the landscape plan should also be reflected on the survey.
6. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow

Dear Mr. Hove:
The City of Orono is in receipt of a revised survey for development of a home on the above
referenced property. We note the following revisions from the previous survey:
1. The proposed house location has been pivoted and moved approximately 30 feet to the
south.
2. The driveway has been relocated to eliminate the wetland crossing and to meet the
required 35' setback from the wetland.
3. In order to relocate the driveway,the septic sites have been relocated to the southeast.
4. A rain garden has been added, as required per the Development Contract Special
Provisions [Item 23(S)] —see attached.
5. A sport court has been added behind the garage.
6. The grading plan has been substantially revised to involve the movement of less than 500
cubic yards of material, eliminating the need for a Land Alteration Conditional Use
Permit.
Based on the above,the following items are required in order for the City to complete its review
and be able to issue a building permit:
a. ISTS Design. The septic design dated May 28, 2015 is not a complete design. In
addition, the septic sites have been relocated. Your ISTS Designer(Rusty Olson)must
complete a design based on the proposed house size, location and drainfield sites. His
final design must be submitted and also shown on the survey. He must provide additional
testing if necessary confirm that the relocated sites are acceptable.
b. Rain Garden Specifications. Your surveyor/engineer must provide calculations and
specifications for the proposed rain garden, for review by the City Engineer.
c. Revised/LTpdated Building Plans and Elevations. Provide revised and updated
building plans and elevations, showing the revised rear elevations based on the new
grading plan, as well as depicting the proposed sport court.

d. Building Height. As noted in the November 18, 2015 letter(attached) our preliminary
review of the building plans indicated a 3`d story window within a gabled dormer on the
front roo£ This feature was not shown on the proposed roof plan. The potential issue is
that if this is in fact a window, per City Code the building height is measured from the
highest existing grade to the midpoint of the roof from the top of that window to the peak.
With the window in place, the defined height of the home is approximately 33 feet,
exceeding the 30-foot height maximum allowed by City Code. The simple solution is to
remove the window in that gabled dormer, or remove the dormer entirely.
e. Minnehaha Creek Watershed District (MCWD). As a minimum, you will need an
MCWD Erosion Control Permit. Your project may trigger other MCWD permitting
requirements; please contact the MCWD directly at 952-471-0590 regarding your project.
Please note, the City of Orono will not issue a building permit without a copy of the
MCWD Erosion Control Permit ar documentation stating the proposed project does not
trigger any of their permitting requirements.
£ Landscape Plan. Prior to the issuance of the building permit a landscape plan must be
submitted showing all the proposed exterior/landscaping improvements, i.e. patios,
grading, sidewalks, retaining walls, etc. The plan should include the name of the
individual performing the work. The landscape plan should match what is shown on the
survey.

regarding the allowed uses within the designated Preservation Areas and regarding the necessity
of preserving alternate mound drainfield sites, by recording the Declaration described as Plan I in
Section 7 above.
S. Plans B and C depict the potential location of a rain garden on each of Lots
1,2, 3, 5, G and 7,Block l,and Lots 1,2 and 3,Block Z, which rain gardens are required as part
of the overall stormwater drainage system for the Project. No rain garden shall be required on
Lots 4 and 8, Block 1. The City shall not be obligated to issue a Certificate of Occupancy for a
dwelling constructed on any of Lots 1,2, 3, 5,6 or 7, Block 1,or Lots 1,2 or 3, Block 2,until the
City Engineer has Approved, based on the location and dimensions of the dwelling and other
improvements to be constructed on the lot, the location and dimensions of the rain garden to be
created on such lot, and unril the owner of the lot has caused to be duly recorded in the office of
said Registrar of Titles an easement in favor of the City, substantially in the form attached hereto
as EXffiBIT B, encumbering the approved area of the rain garden on the lot. The recording of
such easement shall be conclusive evidence of compliance by such owner with this Subsection
23S if the recorded easement includes the written approval of the City Engineer.
24. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance
with the terms of this Contract and construcrion and payment of the costs of all Iinprovements,the
Developer shall fizmish the City,prior to the City's release of the Plat for recorcling,with cash,or

Dear Mr. Hove:
The plat of Mooney Lake Preserve has been approved and filed with Hennepin County, allowing
the City of Orono to proceed with review of the building permit application you submitted to this
office on September 11 far Lot 3, Block 2. Our initial site plan review indicates the following
issues that must be resolved in order for the application review to proceed:
1. Wetland Crossing. The proposed driveway crossing of the wetland and wetland buffer
cannot be approved, as these areas are protected via City ordinance and the Mooney Lake
Preserve development covenants.
2. Driveway Relocation. Additionally, per City Code, any driveway location that is within
35 feet of the wetland boundary or within 10 feet of the septic system soil treatment area
cannot be approved. It would appear that the only feasible driveway location will be
easterly and southerly of the proposed septic areas as depicted on the submitted survey.
Any driveway proposed in this area must be designed to have no impact on the tree buffer
required by the development approvals along the southeast border of this property.
Alternatively, if it is feasible to shift the septic sites further east, a driveway might be
located between the wetland and the septic sites; this will require analysis and approval
from your ISTS Site Evaluatar/Designer.
3. Excavation for Walkout—CUP Required. The proposed excavation to create a rear
walkout configuration is estimated at 5,000-6,000 cubic yards, and requires a Conditional
Use Permit(CUP) because it exceeds the 500 cubic yard threshold allowed for the normal
and customary grading in the area of a proposed house, per Orono Zoning Code Sections
78-966 thru 78-968. The CUP application process typically takes approximately 60 days
from the date of submittal of a complete application, and there is no guarantee of
approval.
4. Potential Wetland Impact. The proposed rear walkout excavation has the potential to
have a negative impact on the wetland at the northeast corner of the property, because the
wetland is at approximately the 1016' elevation and the proposed excavation within 50-
80 feet of the wetland is as much as 8 feet lower than the wetland elevation. This has the
potential to result in draining of that wetland which would be prohibited.

5. Building Height. A preliminary review of the building plans indicates a 3`d story window
within a gabled dormer on the front roo£ This feature is not shown on the proposed roof
plan. The potential issue is that if this is in fact a window, per City Code the building
height is measured from the highest existing grade to the midpoint of the roof from the
top of that window to the peak. With the window in place, the defined height of the
home is approximately 33 feet, exceeding the 30-foot height maximum allowed by City
Code. The simple solution is to remove the window in that gabled dormer, or remove the
dormer entirely.
6. Minnehaha Creek Watershed District (MCWD). As a minimum, you will need an
MCWD Erosion Control Permit. Your project may trigger other MCWD permitting
requirements; please contact the MCWD directly at 952-471-0590 regarding your project.
Please note, the City of Orono will not issue a building permit without a copy of the
MCWD Erosion Control Permit or documentation stating the proposed project does not
trigger any of their permitting requirements.
7. Landscape Plan. Prior to the issuance of the building permit a landscape plan must be
submitted showing all the proposed exterior/landscaping improvements, i.e. patios,
grading, sidewalks, retaining walls, etc. The plan should include the name of the
individual performing the work. The landscape plan should match what is shown on the
survey.
8. ISTS Design. The septic design dated May 28, 2015 is not a complete design. Your
ISTS Designer(Rusty Olson) must complete a design based on the proposed house size,
location and drainfield sites. His final design must be submitted and also shown on the
survey.

Dear Mr. Hove:
The plat of Mooney Lake Preserve has been approved and filed with Hennepin County, allowing
the City of Orono to proceed with review of the building permit application you submitted to this
office on September 11 for Lot 3, Block 2. Our initial site plan review indicates the following
issues that must be resolved in order for the application review to proceed:
1. Wetland Crossing. The proposed driveway crossing of the wetland and wetland buffer
cannot be approved, as these areas are protected via City ordinance and the Mooney Lake
Preserve development covenants.
2. Driveway Relocation. Additionally, per City Code, any driveway location that is within
35 feet of the wetland boundary ar within 10 feet of the septic system soil treatment area
cannot be approved. It would appear that the only feasible driveway location will be
easterly and southerly of the proposed septic areas as depicted on the submitted survey.
Any driveway proposed in this area must be designed to have no impact on the tree buffer
required by the development approvals along the southeast border of this property.
Alternatively, if it is feasible to shift the septic sites further east, a driveway might be
located between the wetland and the septic sites; this will require analysis and approval
from your ISTS Site Evaluator/Designer.
3. Excavation for Walkout—CUP Required. The proposed excavation to create a rear
walkout configuration is estimated at 5,000-6,000 cubic yards, and requires a Conditional
Use Permit(CUP) because it exceeds the 500 cubic yard threshold allowed for the normal
and customary grading in the area of a proposed house, per Orono Zoning Code Sections
78-966 thru 78-968. The CUP application process typically takes approximately 60 days
from the date of submittal of a complete application, and there is no guarantee of
approval.
4. Potential Wetland Impact. The proposed rear walkout excavation has the potential to
have a negative impact on the wetland at the northeast corner of the property, because the
wetland is at approximately the 1016' elevation and the proposed excavation within 50-
80 feet of the wetland is as much as 8 feet lower than the wetland elevation. This has the
potential to result in draining of that wetland which would be prohibited.

�. Building Height. A preliminary review of the building plans indicates a 3`a story window
within a gabled dormer on the front roo£ This feature is not shown on the proposed roof
plan. The potential issue is that if this is in fact a window, per City Code the building
height is measured from the highest existing grade to the midpoint of the roof from the
top of that window to the peak. With the window in place, the defined height of the
home is approximately 33 feet, exceeding the 30-foot height maximum allowed by City
Code. The simple solution is to remove the window in that gabled dormer, or remove the
dormer entirely.
6. Minnehaha Creek Watershed District (MCWD). As a minimum, you will need an
MCWD Erosion Control Permit. Your project may trigger other MCWD permitting
requirements; please contact the MCWD directly at 952-471-0590 regarding your project.
Please note, the City of Orono will not issue a building permit without a copy of the
MCWD Erosion Control Permit or documentation stating the proposed project does not
trigger any of their permitting requirements.
7. Landscape Plan. Prior to the issuance of the building permit a landscape plan must be
submitted showing all the proposed exterior/landscaping improvements, i.e. patios,
grading, sidewalks, retaining walls, etc. The plan should include the name of the
individual performing the work. The landscape plan should match what is shown on the
survey.
8. ISTS Design. The septic design dated May 28, 2015 is not a complete design. Your
ISTS Designer (Rusty Olson) must complete a design based on the proposed house size,
location and drainfield sites. His final design must be submitted and also shown on the
survey.
