In the event of winter or other extended unfavorable weather conditions(which prevent the

Any changes to the exterior/landscaping improvements, i.e. patios,grading, sidewalks, retaining

Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the

My name is leremy Barnhart, and I oversee the plan review and building permitting processes. I appreciate you taking
the time to share your frustration with us,and your suggestions to improving our processes.
Our goal,with every building permit, is to issue the permit as rapidly as possible,without sacrificing the thoroughness of
our review. This review is a service to ensure that your project is consistent with applicable zoning and building codes
and to avoid costly alterations in the field. For instance, our engineer recently noted your landscape plan,the retaining
wall site plan,and the grading plan do not match. The grading plan depicts two long retaining walls. The landscape plan
depicts two short walls. The Site plan from Civil Design depicts one long wall and two short walls. All three plans should
reflect the same retaining walls. This discrepancy leads to confusion in the field, may require alterations of the grade,
and could require you to purchase too much, or not enough materials. Please address in revised drawings.
Regarding the retaining walls,the choice to install one is yours alone, however, if one is to be installed over 4 feet in
height, it requires engineering. This is for your protection and a requirement of the state building code.
The rain garden on your property resulted from the platting process,finalized in October after your builder submitted
the building permit application in September. I trust the developer informed you of the requirement.
The building plans are being reviewed by the building official,the city engineer has reviewed your plans and provided
the comments above. The review of the rain garden has been completed,and the following comments will be included
in the final permit:
1. The rain garden has been adequately sized to maintain proposed peak runoff rates below existing conditions
and retain a volume on site equal to 1"over the new impervious surfaces.
2. The rain garden should not be constructed until the upstream areas have been permanently stabilized.
3. The installation of the rain garden should be inspected by the City to ensure it is constructed as proposed.

4. A record survey of the rain garden should be provided after it is completed to ensure adequate volume is
provided to meet requirements.
Again, I appreciate your comments on our building review process,and please know we are working toward getting you

Hearing your concerns regarding the timeliness of our review, attached is a timeline of the application submittal for
1070 Hunter Drive. While the City has had the application for several months, it was only recently considered
"complete" and was able to be sent onto the building official and engineer for their respective reviews. Our policy is the
building plans and survey are not reviewed until all planning and zoning requirements have been met, i.e.verification of
number of stories, building height,setbacks,etc.
An updated survey was received dated 5-13-2016. An email was sent to Mark Gronberg with comments. According to
Mark's May 17th email, he is preparing a SWPPP and preparing an application for a NPDES permit(email attached). We
will need both of those items before the permit will be issued.
We strive to complete reviews in a timely manner, however, incomplete applications hamper this goal. We currently are
processing a significant number of applications. I anticipate the building official and engineer to review the application
by June 9, 2016. Any questions or concerns they have will be communicated with you. We hope to have the
application ready to be issued by June 20th, however,this is dependent upon any questions or concerns the building
official and/or engineer may have and the timing of your response.
Please be aware, per page 14, Item S of the Mooney Lake Development Contract(copy attached) a certificate of
occupancy will not be issued until the rain garden has been installed, inspected, approved by the City Engineer and an
easement has been granted to the City for the rain garden. See Exhibit B of the Development Contract and the form
entitled Grant of Permanent Flowage and Conservation Easement and Restrictive Covenant.
A Temporary Certificate of Occupancy(TCO)can be issued due to winter or weather conditions which prohibit the
completion of final grading and exterior improvements. A TCO requires a $10,000 escrow which is held until all exterior
improvements are completed,vegetation has been established and an as-built survey has been submitted and
approved.

Thanks for taking the time to meet with me yesterday. Sorry to be a pest, but we are just trying to put a timeline
together for our home owners along with our subcontractors regarding a start date for this project. The permit process
for this home really started back in Nov 2015 so everyones patience is starting to run out. I spoke with Roger yesterday
afternoon and found out the permit package didn't get to his desk until Wed of this week which is weeks after our
application was submitted.
My new understanding is that the permit packet goes from one department to the next in a certain order. Is this
correct? If this is the case I understand that the process is what it is and do not expect it to change for us. However, I
am wondering if there is any reason why each department couldn't at least take a look at the permit packet and let me
know if there is anything missing and or more information that is going to be needed so that�we can make sure you have
everything when the time comes.
Obviously we are anxious to get this project underway and we have home owners that have been very patient. With
that said,we feel like we all deserve to know a timeline other than "we'll get to it when we get to it". We are more than
happy to provide whatever information is needed but are asking for the city of Orono to let us know ahead of time.
As far as I know we still need to turn in the following information;
• Retaining wall engineering(hoping to have this for you on tues 5/31)

Timeline— 1070 Hunter Drive(Saved in 1070 Hunter Street file in Data drive)
September 10, 2015 - Initial application and plans dropped off at City Hall. Applicant was
advised that the plat had not been finalized and that the application was premature. He was
advised to not submit application at this time since City would not review it until platting process
was complete. Applicant chose to leave the application with City including checks and other
documents.
October 30, 2015 —Plat was recorded with Hennepin County, allowing City to begin building
permit review.
November 18, 2015—City letter to builder Kenton Hove advising of a variety of issues that
needed to be resolved in order for permit to be issued.
Winter 2015-2016—No contact with applicant.
March 31, 2016—Received from Mark Gronberg revised surveys indicating that the grading plan
for the walkout area had been substantially revised.
April 1 l, 2016—Received revised application, new plans, etc. from builder Jeff Warren to go
with surveys received earlier.
May 5, 2016—Staff conversed with Mark Gronberg via email to advise that building height was
still an issue, offering possible remedies to the height issue, and noting that we needed rain
garden calculations and specifications. (See email conversation)
May 12, 2016—Staff conversed with Scott Gronholz via email, noting that we had yet to receive
any new information from Gronberg.(see email)
May 13, 2016—Received updated information from Gronberg.
May 17, 2016—Emailed Gronberg with additional issue resulting from revised grading plan and
initial review by City Engineer, noting that disturbed area calcs are needed—if exceeding 1.0
acre, requires SWPPP and NPDES permit, and since newly-proposed retaining walls exceed 4
feet in height,will need engineered wall design. Gronberg will followup. MPG advised
Gronholz we would try to have permit ready to issue "middle of next week". (see emails)
June 1, 2016—Email from City Consulting Engineer Bob Bean confirming that rain garden
calculations and design are acceptable, and including construction details to be adhered to. (see
email)

You are using an old Building Height info sheet. See attached 2014 sheet. For a gable or hipped roof
that has no windows within the roof svstem,you subtract half the distance between the highest point of
the roof system to the lowest point of the gable. You can't take into account windows that are below
the roof system. So I agree with the 8.5' subtraction the architect used on his building plans, rather than
your 9.3'.
The 1019.4'existing spot elevation at the perimeter of the proposed house needs to be shown on the
survey.That likely helps them out.

Do not even think about revising the grading plan for the site.This lot had no grading, and there is no
apparent justification at this late date to suggest a grading plan amendment.
You can only take advantage of the extra 1 foot of fill in determining whether a basement is a story or
not, but not in determining the defined height. See the attached definitions sheet.

Mike:The existing grade goes up from the 1018 contour to 1019.4 at the proposed house.
Attached is what I came up with for height based on the current house plans. If they can raise the grade
1 foot which they are allowed can they lower the house 1 foot and be in compliance? They would then
have to bring the retaining wall in a little tighter to stay under the 500 CY of excavation.Would that
work?Or could we have George revise the grading plan for a couple of feet?The problem is they don't
want to have the back of the house face County Road 6.

I hope to get a letter out today on this, but here's the main issue: Our review confirms that the lowest
level of the proposed house is a basement by definition, but the defined building height exceeds the 30-
foot maximum. The building plans show the upper dormer with window has been removed,which we
advised was necessary. However,the defined height is required to be measured based on the existing
grade where it abuts the house, not the proposed grade that was used by the architect/designer on
building plans(see attached two sketches). The survey suggests that the highest existing grade at any
point on the house perimeter is at or near elevation 1018'. The lower measuring point used in the
height depiction on the plans was approximately 1.5' below the main floor elevation,or about 1022',
which is the proposed grade. Based on the 1018'correct measuring point,the building's defined height
is approximately 34',exceeding the 30' limit. The building plans(and potentially the survey)will have to
be revised so the house meets the 30' maximum. There may be a variety of ways to accomplish this,
perhaps a combination of reducing the roof pitches, lowering ceiling heights, reducing joist depths, and
lowering the house further into the ground (which impacts the amount of cut and retaining walls).

Updated surveys and engineering for the retaining walls were dropped off yesterday,lune 8, 2016,thank you.
The survey received yesterday is dated 5-9-16 however, it is not signed. When comparing the recently received survey,
we noted the previously submitted survey is also dated 5-9-16, however the sunreys do not match.
• Rain garden is missing annotations and the weir is no longer shown. Grading around the proposed rain garden
is different. Has the design changed since the last review? Please clarify.
• Proposed earth excavation annotations are missing. .
Please have the surveyor submit two, signed copies of the survey for our review.

We have received the rain garden calculations and revised survey for 1070 Hunter Drive. I have reviewed the revised
floor elevations and find that the confirmed highest existing adjacent grade of 1019.4' and lowering of the house by
approximately 2.5 feet have resulted in defined height being just under 30'which conforms to the code. Accordingly I
have approved the zoning review. However, in reviewing the site plan there are two grading issues that need additional
information before we can issue the permit:
1) We will need engineering on the retaining walls that exceed 4 feet in height.
2) We need a calculation on the square footage of ground to be disturbed, as it appears to be close to an acre and
may require an NPDES permit.
Please provide the required information as soon as possible. Call me or Adam if you have any questions.

I've reviewed the grading plan with respect to Retaining walls and offer the following comments:
1. The land scape plan,the retaining wall site plan and the grading plan do not match. The grading plan depicts
two long retaining walls. The landscape plan depicts two short walls. The Site plan from Civil Design depicts 1
long wall and 2 short walls. All three plans should reflect the same retaining walls.
Please also note that Bob Bean completed a review of the raingarden and provided that input back to Mike. Copied

The plat of Mooney Lake Preserve has been approved and filed with Hennepin County, allowing
the City of Orono to proceed with review of the building permit appfication you submitted to this
office an September 11 for Lot 3, Block 2. Our initial site plan review indicates the following
issues that must be resolved in order for the application review to proceed:
' 1. Wetiand Crossing. The proposed driveway crossing of the wetiand and wetland buffer

2. Driveway Relocation. Additionally,per City Code,any driveway location that is within
35 feet of the wetland boundary or within 10 feet of the septic system soil treatment area

5. Building Height. A preliminary review of the building plans indicates a 3rd story window
within a gabled dormer on the front roof. This feature is not shown on the proposed r�of
rj�U�� ���`"�- plan. The potential issue is that if this is in fact a window,per City Code the buitding
�,�v��S ,�� height is measured from the highest elc�isting grade to the midpoint of the roof from the
top of that window to the peak. With the window in place,the defined height of the

dormer entirely.

received survey, we noted the previously submitted survey is also dated 5-9-16, however the surveys do not
match.
• Rain garden is missing annotations and the weir is no longer shown. Grading around the proposed rain
garden is different. Has the design changed since the last review? Please clarify.
