Dear Mr. Waldera:
This letter is in reference to violations of the Orono Zoning Code that were outlined in a letter dated
April 10, 2000 from myself. A site inspection was conducted on June 22, 2000. At that inspection, a11
required restoration of the wetlands had occurred except for removal of the wood chips from the
`��etland. All other parts of the wetland have been restored to the satisfaction of Orono.
Another site inspection was conducted on October 17, 2000. At this inspection it �vas determined that
the wood chips had been removed from the wetlands. The property at the above stated address is no�v
in compliance with the Orono Zoning Code.

The Building & Zoning Department has become aware of various types of work occurring at the
above referenced properry: '
� Construction of a circuitous driveway.
• Excavation to create a small pond or for some other purpose.
• Installation of a water well.
• Placement of massive boulders along driveway.
You are advised that the excavation work in the absence of a building permit for construction
of a new residence requires a separate land alteration permit. Further, we are extremely
concerned that the driveway construction, excavation, and well location may have limited, and
perhaps done irreparable damage to, potential sewage system drainf'ield sites.

The Orono Building&Zoning Department has become aware that certain activities in violation of
Orono ordinances have occuned at the above referenced property:
► Excavation within a City-protected wetland(drainage ditch).
► Filling within a City-protected wetland(wood chips).
► Draining a City-protected wetland(connecting two wetlands by excavating a ditch
through the property).
► Grading and excavation without a land alteration permit.
► Burning wood and brush without a burning permit.
On Apri14,2000 I met on the site with Mike Gaf&on, Senior Planning Coordinator for the City of
Orono and Jim Hafner,District Technician for the Minnehaha Creek Watershed District(MCWD).
The following was determined during the meeting:
1. The excavation of the ditch within the wetland and the ditch connecting the two wedands,
and filling the wedand with wood chips, is a violation of Orono Municipal Code Section
10.55 Subdivision 8. This work is also in violation of MCWD regulations and potentially
Minnesota Department of Natural Resources regulations. It is highly unlikely this work
would be permitted even if you had applied for a permit.
2. Excavation outside the wetland, whether to create a pond, a channel or for other purposes,
requires a City issued land alteration permit. No such permit has been issued for this
property.

3. It also appeazs that the excavation of the wetland extends across the east property line. The
construction of the wood chip walking paths appears to have crossed both the east and west
property lines. This work appeazs to have been done within Outlot A, Huntington Farm.
Therefore,the Huntington Farm Homeowners Association is copied on this letter.
4. A burn pile of recent origin was found directly below the power line near the south boundary
of the property. City files confirm that no burning permit has been issued for this property.
This is a violation of Orono Municipal Code,Section 9.30,Subdivision 4. A burning permit
is required to do any outdoor burning in Orono.
In addition to these violations,City staff reviewed the septic sites designed by S-P Testing on July
20, 1995. Fortunately,it appears you have not damaged or disturbed these sites. If the septic sites
had been damaged,this lot could have been deemed unbuildable.
Enclosed with this letter are violation citations for work within the wetlands and for performing land
alterations without the proper permits. The following restoration actions must be completed within
30 days to avoid further legal action:
— .The ditching within the wetlands and the ditching and grading across your property must be
filled back in,to restore these areas to their original grade elevations. These areas must then
be revegetated with native materials. You must advise the City of when this restoration will
be commenced so an inspector can be on the site.
— All wood chips within the wetlands and within the 26' wedand buffer must be removed.
Once restoration has been completed to the City's satisfaction, any further excavation on the
property may occur only if you obtain a land alteration permit from the City. An application for
such a permit will only be approved if accompanied by detailed plans for all intended work.
You aze further advised that any further burning on the property without a valid burning permit
issued by the City will result in legal action.

§ 10 .55
Subd. 6. Zoning Use �istricts. The Zoning Use Districts
as designated on the Official Zoning Map shall remain unchanged
with the adoption of this Section. The provisions of this Section,
including the designation of Flood Plain and Wetlands Conservation
Areas, shall be in addition to all other provisions of this
Chapter. Whenever conflicts occur between other provisions of this
Chapter and provisions of this Section, the most restrictive
provision shall prevail.
Subd. 7. Regulatory Flood Protection Elevation. The
Regulatory Flood Protection Elevation shall be an elevation no
lower than one foot above the elevation of the regional flood plus
any increases in flood elevation caused by encroachments on the
flood plain.
A. The regulatory flood protection elevation within
the Floodway and Flood Fringe Districts shall be established by
adding 1.0 foot to the Base Flood Water Surface Elevations within
Floodway listed in the Floodway Data Table contained in the Flood
Insurance Study. Regulatory flood protection elevations between
cross-sections shall be interpolated.
B. The regulatory flood protection elevation for
Lake Minnetonka shall be 932.5 MSL.
C. The regulatory flood protection elevation within
the General Flood Plain District shall be calculated by a qualified
registered professional engineer in-accordance with procedures set
forth herein.

Subd. 8. Development Restricted; PL'�ohibition. Except as
hereinafter specifically permitted,. no filling, grading, dredging,
excavation , hardcover , temporary� or permanent structures ,
obstructions, septic systems, w�ll or . other construction shall be
allowed within the Flood Plain and Wetlands Conservation Area; nor
on any lands within 26 feet thereaf; • nor on any land within 75 feet
of the ordinary high water elevation of any lake shoreline, nor on
land abutting, adjoining or affecting said area if such activity
upon those adjacent areas is incompatible with the policies -
expressed in this Section and the preservation of those
conservation areas in their natural state.
Subd. 9. Floodway District (FW) . The following uses
have a low flood damage potential and do not ob,struct flood flows.
These uses shall be permitted within the Floodway District to the
extent that they are not prohibited by any other City Code
provision and provided all permits or authorizations are received
as may be required by other City Code provisions or regtilation of
other governmental agencies having jurisdiction, including without
limitation, the Minnesota �Department of Natural Resources, the
Minnehaha Creek Watershed District, and the Lake �Iinnetonka
Conservation District. In addition, no use shall adversely affect
