HomeMy WebLinkAbout#2029-approving plat-1986 �- �5 Nur�l-- i e��rv� �pt� �� � � ��� �I- � , BlocK.t �����; � ���� t =���� C�t� o� OR�NO �s., . � :; - RESOLUTION OF THE CITY COUNCIL r�. � NO. 2029 g '�"`-�' � � � ; � 4 ��� ��{ . �'� � A RESOY,UTION APPROVING THE PLAT OF HUNTINGTON FARM FILE NO. 841 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Oron� has adopted subdivision regulations for the orderly, economic and safe development of Iand within the City; and WHEREAS, the City Council has considered the dual application for a subdivision for a plat and conditional use permit for a 9 unit Planned Residential Development by Craig G. Winters and Janette C. Winters the subdividers; and WHEREAS, on August 27, 1984, the City Counci 1 granted approval of a preliminary plat of the 9 unit Planned Residential Development that designated the building and septic envelopes for each of the pads (hereinafter referred to as "Development Guide Plan"). Each septic envelope maintains a minimum 20 foot setback from each building envelope and the boundary lines of each pad. The building envelope of each pad shall maintain approved building setbacks as follows:� Pads 1-4 , 8 and 9 - front/rear 50 ' , side 30 ' Pads 5 and 6 - front 30 ' , rear 50 ' , side 30 ° Pad ? - front/rear 50', right/west side 30' left/east side 52 ' Pads 2, 7 and 8 - principal structures must be located 100 feet from existing animal barn in Outlot D WHEREAS, the subdivision for a Planned Residen'cial Development has been found to meet all standards of the Planned Residential Development Code, On-Site Septic Code and aIl other pertinent sections of the Zoning and Subdivision Codes that deal with the �ural development of property within the City, so that each pad can be developed as a single family residential unit without the need of variances; and WHER�AS , the subdividers have completed all requirements of the platting regulations of the City, including: l . Creation of a new private road shown on the plat as Outlot B, to be known henceforth as Hunt Farm Road. 3. Concurrent with the creation of this private road, the Subdividers have dedicated to the City a Road and Utilities Easement granting to the City permanent access, improvement and utility easements over said 0utlot; the Subdividers have created non-exclusive ingress, egress, drainage and utility easements over said Outlot in favor of all abutting and/or � benefiting lots including a declaration of certain maintenance covenants wherein each of the abutting and/or benefiting lot owners covenants and agrees to permanently maintain and pay the cost of maintenance for said private road. 4. Dedication to the City of a Flowage and Conservation Easement providing for limitations on the use of wetlands and/or drainageways described therein and shown on the plat as "drainage easements". 5. Dedication to the City of an open space easement over Outlot A to fulfill the density requirement for nine residential units in the RR-lA Rural Residential Zoning District requiring 5 acres of dry land per unit. 6. Execution of a Special Lot Combination to define common ownership relationship between Outlot D, Block l, Huntington Farm and the residential pad, Lot 1, Block 4, Huntington Farm. The Special Lot Combination shall also establish controls on the use and building limitations for Outlot D. Outlot D with existing barn and coral shall serve as accessory to Lot 1 , Block 4. Outlot D shall not be considered as an independent residential pad/unit and must be set aside for density credit for nine unit PRD in RR-lA Zone. 7. Creation of private covenants restricting use of shared commons area within Outlot A. 8. Execution of a Subdivider's Agreement providing for installation of the following road improvements within Outlots B and C as a condition of subdivision approval : a) 8 inch base of Class 5 gravel; b) 3 inch bituminous surfacing; c) ditches 2 feet below centerline crown (applicable to roadway within Outlot B) . 9. Payment to the City for the legal review and filing of the plat easements and covenants in the amount of $150. 00. NOW, THEI��'OR13 BE IT RRSOLVED, that the City Counci 1 of the City of Orono hereby approves the plat of Huntington Farm, Hennepin County, Minnesota; subject to the following conditions: . 1. Access to a� l residential pads shall be via the plat road. Building permits for new construction shall not be issued by the City until the required base work has been instal led and approved by the City. 2. Subdividers must stake all drainfield envelopes prior to any land alterations. 3. Cul verts shall be installed within Outlot C, the shared driveway, per engineering plans by Coffin & Gronberg dated 7/28/86. The Minnehaha Creek Watershed District must inspect culverts at time of installation. . 4. Subdividers are placed on notice that alteration of a designated wetland will require a separate conditional use permit review and that all improvements involving hardcover within commons area must maintain 26 feet setback from edge of designated wetlands. 5. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Recorder's Office on or before February 11, 1987 together with a certified original copy of this Resolution and executed copies of the documents as noted above. The approval granted by this Resolution shall expire if the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Dated this llth day of August, 1986.
