Brama (hereinafter the "Applicant") has an interest in � the properties located at 1150 Homestead Trail and 3020 Sixth Avenue North within the City of Orono, said properties owned by the Margaret M. Buschbom Trust represented by Timothy J. Skelly as Trustee (hereinafter the "owner") and legally described as follows: Attached as Exhibit A(hereinafter the "properties"); and WHEREAS, the Applicant has made application to the City for approval of a lot line rearrangement which would relocate the lot boundary line between the properties; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the proposed lot line rearrangement on June 15, 2015 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon, and on a vote of 6-0 recommended approval of the lot line rearrangement; and WHEREAS, the Orono City Council reviewed the proposed lot line rearrangement at a regular meeting held on June 22, 2015 and makes the following findings with regards to the proposed lot line rearrangement: l Page 1 of 3 � ' O �°��`: �- �� �� CITY OF OR�TO :;,� ��" RESOLUTION OF THE CITY COUN�,�L � a � �� ��j'�k �ti G~ N O. � TJ � �' FSH� FINDINGS 1. This application was reviewed as Zoning File#15-3737. 2. The parcel at 1150 Homestead Trail (the "north parcel") contains 4.20 acres in total area including platted Hennepin County Road 201 right-of-way and currently contains a single family residence. 3. The parcel at 3020 Sixth Avenue North (the "south parcel") contains 0.75 acres in total area including platted right-of-way for Hennepin County Road 201 and C.S.A.H. 6, and currently is vacant. The residence structure on this parcel was removed in 1997. , - 4. The properties are or will be served by private wells and on-site sewage treatment systems. , 5. This application contemplates a lot line rearrangement to relocate the common boundary between the two properties further north. The application also contemplates recognition of the County Road right-of-ways, as well as the creation of perimeter drainage and utility easements. The result is that the north parcel decreases in area to 2.20 acres excluding platted Hennepin County Road 201 right-of-way, and the south parcel increases in area to 2.47 acres excluding platted right-of-way for Hennepin County Road 201 and C.S.A.H. 6. The existing residence structure will henceforth be located within the new boundaries of the south parcel. 6. Each revised parcel contains suitable primary and alternate sites for individual sewage treatment systems. 7. The lot line rearrangement will result in both parcels being conforming to the RR-1 B Rural Residential Zoning District with regards to lot area and lot width. 8. RESOLUTION OF THE CITY COUNCIL.���� �. � � `� �'~ N O. � � � R--- j'�kFSHo�`` CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the lot line rearrangement survey dated April 23, 2015, revised May 14, 2015, by David B. Pemberton of Sathre Bergquist, Inc. attached as E�ibit B, subject to the following conditions: 1. Following the lot line rearrangement the properties shall be legally described as shown in Exhibit C attached. 2. The applicant shall grant to the City perimeter drainage and utility easements for each of Proposed Pazcels 1 and 2 on standard forms provided by the City for filing with Hennepin County. , 3. The Applicantss shall file the appropriate deeds reflecting the new legal descriptions (subject to City Attorney approval) with the Hennepin CounTy Recorder's Office andlor Registrar of Titles Office on or before June 22, 2016, or the approval granted by this resolution shall expire. Here's a friendly reminder to all Orono property owners with non-compliant onsite septic systems. Beginning in the mid-1990s the City began to identify those septic systems that made use of trench drainfields, a majority of which do not maintain the minimum required vertical separation above seasonal water tables. Each existing system was subjected to soil borings to determine the seasonal water table depth. When a system was identified as non-compliant,the owner was notified of the need to bring the system into compliance and given several years to complete the upgrade. The deadlines'to upgrade were divided into whether or not the property was in the Shoreland District (within 1000' of a lake, or within 300' of a protected tributary stream). Properties in the Shoreland District were given until December 31, 2007 to become compliant. Properties outside the Shoreland area with non-compliant systems were allowed until December 31, 2010 to conforrn to the septic code. Don't wait until the last minute'. The City is strongly recommending that property owners not wait until the deadline arrives to bring their systems into compliance. The process to upgrade your septic system can be guite lengthy. The first step in the process is to hire a site evaluator& designer to determine what type of system is required and provide the blueprint for the system installation. The property owner must then contract with a septic system installer to have the system constructed. The installation of septic systems is very weather dependent, especially for mound systems, which can onl�y be installed when the ground is relatively dry,i.e. typically June thru September. Contractors' schedules fill up quickly, so it's important to start your planning and design process now to ensure a timely insta.11ation. The period of time from deciding to update your septic system to the actual installation can easily exceed three to four months or more.
