Nic,
Per our telephone conversation two remaining items are needed before the permit can be issued:
1. A copy of an erosion control permit from the MCWD or documentation from them stating this proposed project
does not trigger their permitting requirements. (MCWD permit#16-521 is for the detached accessory structure
which we don't have an application for.)
2. A copy of an updated escrow agreement is attached. This combines the variance escrow with this project. No
additional escrow money is needed at this time,just a signature from one of the property owners.

As I mentioned, I'm leaving around noon for the day and our office is closed on Monday. If you are able to bring in
documentation from the MCWD and a signed copy of the escrow agreement before 4:30 pm today we can issue the
permit.

I've reviewed the subject grading plan and stamped it approved with revisions:
1. The Certificate of Survey was annotated to indicate perimeter erosion control measures(silt fence, bio logs,etc.)
down gradient from proposed work. Measures must be installed by the Contractor and inspected by the City
prior to any work. Contractor must provide a minimum 24 hour notice prior to inspection.
2. The plan shows top of wall and bottom of wall elevations for a wall that is not depicted and would not be
allowed in that location.

We have had many iterations of this application before you have seen it. The wetland was delineated which has a 35'
setback from hardcover/structures. Proposed retaining walls and walking path which were within the 35'setback have
been removed from the survey despite the top and bottom of wall elevations remaining. Please review and provide
comments.

Hi Nic,
I'm following up on the voice mail I left you. The survey's submitted are not printed to scale and I cannot accurately
verify setbacks.
Before you submit updated survey's though, it appears some of the retaining walls and possibly stepping stones may
with within 35'of the delineated edge of the wetland. According to Citv Code Section 78-1605(c) no structures or
hardcover can be within 35'of the delineated edge of a wetland. Since the survey is not to scale I cannot accurately
determine at this time. Please review and submit updated information for our review. Please note our engineer has not
reviewed the survey,so additional comments may be forthcoming.

I was a little premature in sending my last email.
When having the survey updated, please make sure all proposed additions/changes are shown on the survey along with
the proposed landscape plan (i.e. retaining walls, patios,stairs,etc.). Attached is a copy of the City's survey
requirements. Please note our engineer has not reviewed the survey so there may be additional comments
forthcoming.
Also, please confirm with the MCWD if your project triggers their permitting requirements and requires an erosion
control permit.

On December 20, 2016 the City received a building permit application for an addition to the house. Staff
conducted a preliminary review based on the information provided and recommends the following items be
submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Wetland. Based on our available information, it appears there is a wetland within the subject property.
This wetland appears to be located within 150 feet of the proposed project. Because Orono City Code
requires a 35-foot setback from any wetland for structures or hardcover,the location of the wetland must
be indicated on the survey.Setbacks from the veri�ed with wetland delineation information.
Level 2 Delineation is required. A Level 2 delineation must include the exact surveved boundarv
of the wetland shown on the certificate of survey.
2. Certificate of Survey. Once the wetland delineation has been completed and approved by the Minnehaha
Creek Watershed District the delineated wetland edge should be shown on an updated survey. The
setback for structures and hardcover is 35' from the delineated edge of the wetland. Our engineer has
not reviewed the survey,so additional comments may be forthcoming.
3. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,500. We currently hold $2,500 in
conjunction with the variance application. Please have the property owners sign the updated escrow
agreement. No additional escrow money is needed at this time.

4. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek
Watershed District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-
0590 regarding your project. Please note,the City of Orono will not issue a building permit without a copy
of the MCWD permit or documentation stating the proposed project does not trigger any of their
permitting requirements.

Tim Sullivan has applied for a WCA No Loss Decision for proposed home repair and
excavation of sediment from a deepwater habitat at 440 Brown Rd in the City of Orono,
Hennepin County, Minnesota. Legal description: Sections 3, Township 117N, Range 23W.
A Level 1 wetland delineation was conducted by Kjolhaug Environmental Services on
January 9th, 2017. One deepwater waterbody with a Type 2, Fresh(Wet) Meadow fringe was
identified on site. A Level 1 wetland delineation was deemed appropriate because an on-site
review by Kjolhaug and MCWD on September 16�', 2016 identified an abrupt wetland-upland
transition zone.
MCWD finds that the proposed home repair meet the criteria of conditions of 8420.410 and
criteria of 8420.0415 Subp. A: "an activity that will not impact a wetland" as there is no
wetland within the home repair project area.
MCWD finds that the proposed excavation of material from the deepwater area meets the
criteria of conditions of 8420.410 and criteria of 8420.0415 Subp. A: "an activity that will not
impact a wetland" as the proposed removal of sediment is from a deepwater waterbody.
Excavation is not allowed within the area delineated as Type 2 Fresh(Wet) Meadow.

This decision is valid for five years. Any proposed changes to the project that are outside of
the scope of this exemption and no-loss decision may not begin without approval from the
MCWD. These projects or a future project located on this property may require a permit from

1. WETLAND DELINEATION AND APPLICATION SUMMARY
1.1 Wetland Delineation
• The 2.5-acre Sullivan Property was inspected on September 16, 2016 and January 9, 2017
for the presence and extent of wetland.
• The National Wetlands Inventory(NWI) shows one PUBGx(Palustrine unconsolidated
bottom, intermittently exposed, excavated) wetland located on the eastern part of the
property.
• The soil survey shows that soil types on the property are classified as predominantly non-
hydric.
• The DNR Public Waters Inventory shows no public waters onsite. DNR Public Waters
Wetland 27-858W is located about 300 feet east of the property boundary.
• The National Hydrography Dataset(NHD) shows no NHD waters or flowlines onsite.
The nearest NHD Waterbody is the DNR Wetland that is located about 300 feet east of
the property.
• One wetland/deepwater habitat was delineated on the site and is summarized below.

• The proposed sediment removal meets no-loss criteria listed under Minnesota Rules Part
8420.0415, A., because removal of sediment from a deepwater habitat is"an activity that
will not impact a wetland."
• The proposed sediment removal is not regulated under Section 404 of the Federal Clean
Water Act because the excavation will be conducted with an excavator or backhoe.

2. OVERVIEW
The 2.5-acre Sullivan Property was inspected on September 16, 2016 and January 9, 2017 for the
presence and extent of wetland. The property is located in the NE '/ of the NE '/ of the SE '/ of
Section 3, Township 117 North, Range 23 West, City of Orono, Hennepin County, Minnesota.
The site address is 440 Brown Road South, Orono, MN (Figure 1). The property corresponds to
� Hennepin County PID 03-117-23-42-0012.
The site includes mature woodland, a home, driveway, lawn, and an excavated pond. The
excavated pond straddles the eastern property boundary (Figure 2). Most of the Sullivan
Property drains toward the pond (Figure 3). The pond/wetland boundary roughly corresponds to
the 970 contour and most of the home is located above the 980 contour. The pond has no natural
or created outlet. The site falls within the Minnehaha Creek Watershed District (MCWD).
Surrounding land use includes a mix of woodland, wetland, lawn, and rural residential homes.
One wetland was delineated on the site.
Appendix A of this report includes a Joint Application Form for Activities Affecting Water
Resources in Minnesota, which is submitted in request for: (1) a wetland boundary and type
determination under the Minnesota Wetland Conservation Act(WCA), and (2) delineation
concurrence and an Approved Jurisdictional Determination (AJD) under Section 404 of the
Federal Clean Water Act.
3. METHODS
3.1 Wetland Delineation
Kjolhaug Environmental (KES) confirmed with MCWD staff on January 5, 2017 that a Level 1
Wetland Delineation would be acceptable for this project. The Level 1 routine method was
modified to include a field review for site inspection and building setback measurement.
Wetlands were identified using a hybrid Routine Determination method as discussed below.
Routine Determination methods are described in the Coms of Engineers Wetlands Delineation
Manual (Waterways Experiment Station, 1987) and the Regional Supplenlent to the Corps of
En�ineers Wetland Delineation Manual: Midwest Region(Version 2.0) as required under
Section 404 of the Clean Water Act and the Minnesota Wetland Conservation Act.
This Wetland Delineation was completed to allow setback measurement for a home remodeling
project. Whereas Routine Level 1 delineations do not require site inspections, Routine Level 2
delineations include field data collection and marking of wetland boundaries. This delineation
involved a hybrid of the two methods. The wetland edge was reviewed in the field on September
16, 2016 and the setback was measured in the field on January 9, 2017. Approximate wetland
boundaries were mapped on aerial photography.
The Level 1 inethod and a site inspection was deemed an appropriate method for this project
because the location of most of the wetland boundary was not critical and because the wetland

boundary in the area near the setback measurement was found to be quite abrupt during the
September 16, 2016 field review.
Wetland boundaries were identified as the upper-most extent of wetland that met criteria for
hydric soils,hydrophytic vegetation, and wetland hydrology. Because this delineation used a
modified Level 1 method and the ground was frozen during the January 9, 2017 site visit,
detailed data on soils, vegetation, and hydrology were not collected in the field.
The building setback from the wetland edge was measured in the field. The wetland boundary
was interpreted and mapped using 2016 aerial photography, field knowledge, soils mapping, and
Lidar topographic mapping.
4. RESULTS
4.1 Review of NWI, Soils, Public Waters and NHD Information
The National Wetlands Inventorv (NWI�(Minnesota Geospatial Commons 2009-2014 and U.S.
Fish and Wildlife Service) shows one PUBGx(Palustrine unconsolidated bottom, intermittently
exposed, excavated)wetland located on the eastern part of the property(Figure 4). This wetland
is more accurately classified as a PEMB/L1UB4x(Palustrine, emergent, saturated/Lacustrine,
limnetic,unconsolidated bottom, organic, excavated)basin.
The Soil Survev (USDA NRCS 2015) showed that soil types on the property ranged from
predominantly non-hydric to hydric. Soil types mapped on the property are shown on Figure 5
and listed in Table 2.

The Minnesota DNR Public Waters Inventorv (Minnesota Department of Natural Resources
2015) shows no public waters onsite. DNR Public Waters Wetland 27-858W is located about
300 feet east of the property boundary.
The National Hvdro�raphv Dataset(U.S. Geological Survey 2015) shows no NHD waters or
flowlines onsite. The nearest NHD Waterbody is the DNR Wetland that is located about 300
feet east of the property.

4.2 Wetland Delineation
The property was evaluated for wetlands during field observations on September 16, 2016 and
January 9, 2017. The landowner sampled soils from the pond bottom on October 3, 2016. One
wetland/deepwater habitat was identified and delineated on the property(Figure 6). The
following description reflects conditions observed at the times of the field visits. Herbaceous
vegetation was actively growing at the time of the field visit on September 16. A property
boundary survey prepared by Frank R. Cardarelle Land Survey is included in Appendia�B.
The one delineated Wetland is a Deepwater habitat with a narrow Type 2 (PEMB) wet meadow
and boulder toe fringe. It is located in the eastern part of the property. The wetland/deepwater
habitat is classified as a PEMB/L1UB4x (Palustrine, emergent, saturated/Lacustrine, limnetic,
unconsolidated bottom, organic, excavated)basin. The L1UB4x part of the basin corresponds to
the deepwater habitat and covers about 15,140 square feet(0.3456 acre). The PEMB wet
meadow fringe covers about 3,350 square feet(0.0769 acre) and ranges from about 3 to 20 feet
wide.
The deepwater habitat consists of open water. The wet meadow fringe is dominated by reed
canary grass with boulders at the water's edge in some locations. The reed canary grass
transitions to open water with steep side slopes. The adjacent upland was dominated by
manicured lawn on the northwest and southwest sides of the wetland, and to mixed maple
woodland on northeast and southeast sides of the wetland. The wetland boundary corresponded
to a rise in elevation and a transition from reed canary grass and open water to upland plant
communities with 6 to 12% slopes. This wetland is an excavated depression with no visible
inlets or outlets.
No other areas with hydrophytic vegetation or wetland hydrology were observed on the site. No
other areas were shown as hydric soil on the soil survey or as wetland on the NWI map.
Most of the basin is classified as a deepwater habitat because the substrate sample from the
wetland center indicated it was excavated to a depth of more than 6.6 feet around the time the
house was constructed. The landowner, Tim Sullivan, sampled soils of the pond bottom on
October 3, 2016. The resulting soil profile is shown in Table 3. The sample was taken in the
central part of the pond. At that location,the pond contained about 4 feet of water, underlain by
approximately 6 feet of mucky/silty sediment. At a depth of approximately 6 feet, the
mucky/silty substrate abruptly transitioned to gleyed blue-gray clay loam.

4.3 Historical Review of the Excavated Pond
An anecdotal history, site conditions observed in the field, and historical aerial photography
indicate that the wetland basin was previously excavated. During an onsite pre-application
meeting with the MCWD on September 16, 2016, Tim Sullivan explained how the original
homeowner told him that the wetland previously existed as a grassy wet meadow containing
debris and old appliances. The previous owner removed the debris and excavated the wetland to
create the pond that exists today. Hennepin County property information shows that the home
was built in 1986. The wetland excavation likely occurred around that time. Evidence
supporting the excavated wetland determination includes:
1. NWI mapping, which is based on 1980s color infrared aerial photography, shows the
wetland as a PUBGx, and"x" indicates excavated.
2. The 1974 Hennepin County Soil Survey(based on field work in 1960s) shows the
wetland as a symbol that means "small depression,poor to very poorly drained."
3. Aerial photographs from 1937, 1945, 1956, 1960, 1962, 1967, 1971, and 1994 (8 years)
don't show the open water area until 1994 (Table 4,Appendix C).

4.4 Request for Wetland Boundary and Jurisdictional Determination
Appendix A of this report includes a Joint Application Form for Activities Affecting Water
Resources in Minnesota, which is submitted in request for: (1) a wetland boundary and type
determination under the Minnesota Wetland Conservation Act(WCA), and(2)delineation
concurrence and an Approved Jurisdictional Determination(AJD)under Section 404 of the
Federal Clean Water Act.
5. NO-LOSS APPLICATION
The landowner would like to remove accumulated sediment down to the blue-gray clay layer,
which corresponds to the depth of the original excavation. Excavation of sediment with an
excavator or backhoe will restore the deepwater habitat to the previous maximum pond depth of
approximately 10 feet, which existed following the original excavation.

The only water resource to be affected by excavation will be the deepwater habitat. The narrow
Type 2 wetland fringe will be avoided. The excavation will be conducted during winter
conditions to minimize disturbance and sedimentation.
No-loss criteria and eligibility are discussed in the Joint Application Form for Activities
Affecting Water Resources in Minnesota(Appendia�A).
5.1 Minnehaha Creek Watershed District
Removal of accumulated sediment from the deepwater habitat is eligible for no-loss certification
under the Minnesota Wetland Conservation Act. Sediment removal was discussed with the
Minnehaha Creek Watershed District during an onsite pre-application meeting on September 16.
2016. Samples subsequently obtained from the pond bottom showed approximately 6 feet of
mucky/silty sediment. At a depth of approximately 6 feet, the pond substrate abruptly
transitioned to gleyed blue-gray clay loam.
The proposed sediment removal meets no-loss criteria listed under Minnesota Rules Part
8420.0415,A., because removal of sediment from a deepwater habitat is "an activity that will not
impact a wetland."
5.2 U.S. Army Corps of Engineers
The proposed sediment removal is not regulated under Section 404 of the Federal Clean Water
Act because the excavation will be conducted with an excavator or backhoe. The excavated
material will be loaded on trucks and hauled to a location where it can be deposited on upland
and used as black dirt. The activity will not result in a discharge of dredged or fill material into
waters of the United States.
6. CERTIFICATION OF DELINEATION
The procedures utilized in this delineation are based on the U.S. Army Corps of Engineers 1987
Wetlands Delineation Manual, as required under Section 404 of the Clean Water Act and the
Minnesota Wetland Conservation Act. This wetland delineation was prepared in compliance

By submission of the enclosed wetland delineation report, I am requesting that the U.S.Army Corps of Engineers,St. Paul District
(Corps)and/or the Wetland Conservation Act Local Government Unit(LGU) provide me with the following(check all that apply):

� Delineation Concurrence. Concurrence with a delineation is a written notification from the Corps and a decision from the LGU
concurring, not concurring, or commenting on the boundaries of the aquatic resources delineated on the property. Delineation
concurrences are generally valid for five years unless site conditions change. Under this request alone,the Corps will not address
the jurisdictional status of the aquatic resources on the property,only the boundaries of the resources within the review area
(including wetlands,tributaries, lakes,etc.).
� PreliminaryJurisdictional Determination.A preliminaryjurisdictional determination(PJD) is a non-binding written indication
from the Corps that waters, including wetlands, identified on a parcel may be waters of the United States. For purposes of
computation of impacts and compensatory mitigation requirements, a permit decision made on the basis of a PJD will treat all
waters and wetlands in the review area as if they are jurisdictional waters of the U.S. PJDs are advisory in nature and may not be
appealed.
�Approved Jurisdictional Determination.An approved jurisdictional determination (A1D) is an official Corps determination that
jurisdictional waters of the United States are either present or absent on the property.�l1Ds can generally be relied upon by the
affected party for five years.An A1D may be appealed through the Corps administrative appeal process.

Supporting Information for Applications Involving Exemptions, No Loss
Determinations, and Activities Not Requiring Mitigation
Complete this part if you maintain that the identified aquatic resource impacts in Part Four do not require wetland
replacement/compensatory mitigation OR if you are seeking verification that the proposed water resource impacts are either
exempt from replacement or are not under CWA/WCA jurisdiction.
Identify the specific exemption or no-loss provision for which you believe your project or site qualifies:
The proposed sediment removal is eligible for no-loss certification under the Minnesota Wetland Conservation Act.
Specifically,the proposed sediment removal is eligible under the No-Loss Criterion set forth under Minnesota Rules Part
8420.0415,A,"an activity that will not impact a wetland."
T'he proposed sediment removal is not regulated under Section 404 of the Federal Clean Water Act because the excavation
will be conducted with an excavator or backhoe. The excavated material will be loaded on trucks and hauled to a location
where it can be deposited on upland and used as black dirt. The activity will not result in a discharge of dredged or fill
material into waters of the United States.
Provide a detailed explanation of how your project or site qualifies for the above. Be specific and provide and refer to attachments
and exhibits that support your contention.Applicants should refer to rules(e.g.WCA rules),guidance documents(e.g. BWSR
guidance,Corps guidance letters/public notices),and permit conditions(e.g.Corps General Permit conditions)to determine the
necessary information to support the application.Applicants are strongly encouraged to contact the WCA LGU and Corps Project
Manager prior to submitting an application if they are unsure of what type of information to provide:
Removal of accumulated sediment from the deepwater habitat is eligible for no-loss certification under the Minnesota
Wetland Conservation Act. Sediment removal was discussed with the Minnehaha Creek Watershed District during an
onsite pre-application meeting on September 16.2016. Samples subsequently obtained from the pond bottom showed
approximately 6 feet of mucky/silty sediment. At a depth of approximately 6 feet,the pond substrate abruptly transitioned
to gleyed blue-gray clay loam.
The proposed sediment removal meets no-loss criteria listed under Minnesota Rules Part 8420.0415,A.,because removal of
sediment from a deepwater habitat is"an activity that will not impact a wetland."
The only water resource to be affected by excavation will be the deepwater habitat. The narrow Type 2 wetland fringe will
be avoided. The excavation will be conducted during winter conditions to minimize disturbance and sedimentation.
The landowner would like to remove accumulated sediment down to the blue-gray clay layer,which corresponds to the
depth of the original excavation. Excavation of sediment with an excavator or backhoe will restore the deepwater habitat to
the previous ma�cimum pond depth of approximately 10 feet,which existed following the original excavation.
The proposed sediment removal is not regulated by the U.S.Army Corps of Engineers under Section 404 of the Clean Water
Act because it will not involve the discharge of dredged or fill material into waters of the United States. Sediment removal
will be accomplished using an excavator or backhoe with a sealed bucket. The excavator will load the bottom sediment
onto trucks and it will be hauled to a site where it can be used and deposited on upland. The black soils from the bottom
sediments will likely be used as top dressing on fill or mixed with topsoil.

municipal corporation ("City")and Timothy& Amy S�Illivan ("Owner(s)").
RECITALS
A. The undersigned are the Owner(s) of the Subject Property and hereby agrees to and consent to the
terms and conditions of this Escrow Agreement.
B. Owner has: (check one)

� Filed an application for a Building Permit#2016-01529
❑ Agreed to comply with Orono City Code Section 78-1432 regarding accessory structures.
❑ Filed an Individual Sewer Treatment System (ISTS) permit application.

C. The City is willing to review or monitor the Application only if the Owner agrees to reimburse the City
for the actual costs expended by the City on behalf of, or on account of, the Owner.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT RE�UIRED. Contemporaneously with the execution of this Escrow Agreement, the Owner
shall deposit$2,500("Escrov�')with the City necessary to secure coverage of the total costs associated
with review, approval, and monitoring of the Application. Any Escrow shall be held in a special escrow
account and shall be credited to the Owner.
2. PURPOSE OF ESCROW.
• Zoninp. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures
including but not be limited to staff time, at the rates established by the City Council, in excess of
that covered by the standard application fees, engineering consultant and legal consultant
expenses incurred by the City in reviewing and approving the Application and all other city staff
administrative and consultant services performed in the processing of said review and approval.
■ Building/Zoninp. The purpose of the escrow is to guarantee completion of the site plan as approved
and the provision of the as-built survey as required by the Building official.
■ Accessorv Structure. The purpose of the Escrow is to guarantee reimbursement to the City for
expenditures including but not limited to staff time, at the rates established by the City
Administrator, engineering and legal consultant expenses incurred by the City in removing an
accessory building if the Owner fails to perform the obligations in Orono City Code Section 78-1432
and all other City staff administrative and consultant services pertormed in removing the accessory
building, including land stabilization.
• ISTS. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures
including but not be limited to staff time, at the rates established by the City Council, in excess of
that covered by the standard application fees, engineering consultant and legal consultant
expenses incurred by the City if Owner for any reason is unable or unwilling to honor the
requirements of Chapter 58 of the Orono City Code, and all other city staff administrative and
consultant services performed in relating to the Application. The City may also reimburse itself for
all engineering and legal expenses associated with the construction, removal, alteration, or repair
of the ISTS if the Owner fails to do so.
■ Temporarv Certificate of Occupancv. The purpose of the Escrow is to guarantee completion of
exterior improvements (driveway, grass, etc.) that cannot be accomplished due to weather
conditions.

3. MONTHLY BILLING. The City will monthly forward to the Owner a statement and bill for the
expenditures incurred by the City for staff and consultant services. Such statements shall be due and
payabie within 15 days for receipt by the Owner. No statement will be sent if there are no expenses
incurred in the period since the most recent statement. The City shall itemize all time, services, and
materials billed to any Owner and said time, services, and materials shall be in accordance with the
rules, regulations, and fees as promulgated and adopted by the City Council.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event the Owner does not make payment the
City as required under paragraph 3, the City may draw from the Escrow without further approval of the
Owner to reimburse the City for eligible expenses the City has incurred. The City shall periodically
notify the Owner of the draws the City has made and the nature of the expense for which the
reimbursement is being made.
5. REIMBURSEMENT OF ESCROW. The Owner shall reimburse the Escrow fund for any deficits caused
if the amount actually expended by, or billed to,the City exceeds the escrow fund balance.
6. RIGHT OF ENTRY.

• Buildin4. This section is not applicable.
■ Accessory Structure. The Owner hereby grants the City, its agents, employees, o�cers and
contractors the right to enter the property to remove the accessory building(s) should the Owner
not complete the removal obligations in Orono City Code Section 78-1432.
■ ISTS. The Owner hereby grants the City, its agents, employees,officers and contractors the right
to enter the property to perfortn all work and inspections deemed appropriate by the City in
conjunction with replacement of the septic system, including but not limited to constructing or
completing any and all of the agreed upon improvements should the Owner not complete those
improvements by the date agreed upon.

7. Nd INTEREST PAID. All accrued interest, if any, shall be paid to the City to reimburse the City for its
cost in administering the Escrow account.
8. CLOSING ESCROW. When the review has been completed or the project has been completed, the
