The definition of Building Footprint is as follows:
• Sec. 78-1. Definitions
Building footprint means the outline of the total area covered by a building's perimeter at the ground level(to the
block/foundation).
(1)Carports, covered porches and other similar building features which have no exterior walls shall be included as
part of a building footprint by drawing a straight line between the outer edges of all support structures(and the main
building if applicable).
(2) The outer edge of building protrusions, bay windows or other similar features that extend outward from a
building and are less than four feet from the gound shall be considered as part of the building footprint.
Based on your description,the cantilevered cabinets and fireplaces would be included in the footprint if the bottom of
the se structures begin less than 4 feet above the ground.
The roof overhangs extending 30" from the building do not count towards lot coverage as long as they are not
supported by a post.

Hello Mike,
I had a few additional questions regarding what is counted for the lot coverage calculations for a property in Orono.
- Sec. 78-1403 of the zoning code makes reference first to the combined "footprints" of structures,and later to
"all roofed structures more than six feet above the existing ground level".
o The home in question has cabinets and a fireplace which are cantilevered beyond the footprint of the
structure.This cantilevered portion is not habitable, and does not touch the ground, but it is 8 ft.tall

and has a roof(independent of the main roof of the structure). Does this cantilevered structure count
towards the lot coverage total?
o The existing home has roof eaves which project approximately 30" beyond the outside wall of the
structure. I assume that these do not count towards the lot coverage calculations, but the note
regarding "all roofed structures more than six feet above the ground" made this less clear. Does the
roof overhang count towards the lot coverage?
Your clarification on these items is greatly appreciated.

Side setback on the west side is 10 feet; Baldur Park Road does not abut the west side of the property, so side street
yard does not apply. See attached 1994 survey and recent airphoto. The average lakeshore setback is applicable—new
addition must not extend lakeward of the average setback line as depicted in the airphoto.
Ordinary high water mark (OHW)for this property and all Lake Minnetonka properties is 929.4 feet,with a 100-year(1%)
flood elevation of 931.5 feet. The Regulatory Flood Protection Elevation (Orono code) is 932.5'. Minimum lowest
opening per Minnehaha Creek Watershed District(MCWD) rules is 933.5'. I suggest that you contact the MCWD to
determine how these requirements affect your specific home design.

I am an architect working with Todd and Luchin Mischke who own a property at 3490 Birch Lane in Orono.They are
interested in planning an addition to their home and in researching the applicable zoning laws, I have a couple of
questions regarding the building setbacks I am hoping you can answer:
For your reference,this property is on the North Arm of lake Minnetonka, is zoned LR-1C,and is in the Shoreland
Overlay District,and the Stormwater Management District, (Tier 1):
1. What is the side yard setback for the west side of the lot?
There is no street on this side of the property, but the adjacent property fronts a different street. I
would like to confirm whether the "Side Yard" setback(10'-0")applies,or the"Side Yard Adjacent to
Street"setback(15'-0")applies. (1 assume that because the actua/side yard does not front a street
that the Side Yard setback(10'-0"J would apply). Please confirm.
2. Is there data available from the city to show the ordinary high water mark for this property?
(We have a copy of a survey from 2000, but this does not show the high water mark. 1 am also aware
that these were recent/y replotted and want to be sure 1 am working with the correct data. Is it
in/and from the North(lake sideJ property IineJ?
I have reviewed the lot coverage and hardcover limitations and believe these are clear, but I just want to be sure that I
fully understand the setback limits before beginning design. I greatly appreciate any assistance you can offer.

LOT COVERAGE CODE EXCERPTS
Sec.78-1403.Lot coverage and massing standards.
In all zoning districts other than the I—Industrial district, all lots that have a gross acreage of less than
two acres shall comply with the following massing standards for structures:
(a)Maximum total footprints allowed.
(1)On lots equal to or greater than 10,000 square feet in area,the total combined footprints of
all principal and accessory structures shall not exceed 15 percent of the gross lot area.
(2)On lots of less than 10,000 square feet in area,the total combined footprints of all
principal and accessory structures shall not exceed 1,500 square feet.
(b)Calculation of massing. The following shall be included in the calculation of the total combined
footprints by structures:
(1)All roofed structures more than six feet above existing ground level.
(2)Tennis courts, patios, decks, and all similar open structures when partially or fully
enclosed by fences, railings or walls which extend more than six feet above existing
ground level(if any portion of such structures extends more than six feet above grade
level,the entire structure shall count toward lot coverage).
Sec.78-1685.Massing Standards(Shoreland)
(1)Non-industrial zoning districts. Except for parcels zoned industrial, all lots in the stormwater
quality overlay district that have a gross acreage of less than two acres shall comply with the
following massing standards for structures.
a.Maximum total footprints allowed.

Sec. 78-1684. -Standard hardcover exclusions.
Landscaping with permeable lining shall not be considered hardcover.Additionally, the
following hardcover items shall be excluded from hardcover calculations:
(1) Roads,trails, sidewalks, utilities and other hardcover encroachments intended for the
public's benefit;
(2) Hardcover encroachments created by improvements on adjacent property not owned by
the subject landowner;
a. In such cases of encroachment, the square footage of all encroaching hardcover shall
not be added to the overall hardcover counting against the subject lot;
b. The land area upon which the encroachment rests shall count towards the overall lot
area for the subject lot.
(3) Retaining walls;
(4) Handicapped ramps with a pervious surface below; and
(5) The first 100 square feet of pervious paver patios/walkways or the first 100 square feet
of deck with a minimum one-fourth-inch spacing between boards and a pervious surface
below the decking.
