The facts tending to establish the grounds for issuance of an administrative search warrant are as follows: Your affiant is the City of Orono Building Inspector. Your affiant states that he inspected the Subject Property on December 1, 2010, and identified numerous hazardous conditions and city code violations requiring immediate attention. It is the belief of your affiant that the homeowner recently passed away and there is no one to step in and manage the property. As such, electricity has been disconnected and the water pipes have been left to burst. Water has now filled the basement entirely and is beginning to seep outside the home. Your lot has street yard where ever it abuts a street. This height is also required on the side lot lines to the end of the street yard which is 50' back. After that 50' back from the street property line the fence can be 6' high. The City will need to verify that the fence is on your property and not in the right of way. Ho!lander—Hazardous Buildings Matter Our File No. �1288-754868 Dear Ron: This letter is to update you as to the status of the hazardous buildings litigation involving the structure located at 200 Hollande�c Road. • On Friday, February 1,2002,Judge Ann Aiton held a status conference witti the attorneys for both parties. During this conference,the judge made it clear that action needs to be.taken with regard to the structure, inastnuch as it consatutes a hazardous condition. Judge A1ton has given Mr.Hollander until March 1, 2002, co decide whether to repair the prope�ty,restoring it to a safe condition pursuant to the buildin�code,or to otherw�ise provide for its removal. A number of possible scenazios for demolition were suggested, including using the property as a controlIed burn for local fire departments, or allowing the Ciry to handle demolition and assessing the cost back to the property. Itegardless of his decision.Mr. Hollander to report back to the Court in w,riting by th�Mazch 1 deadline. Once a decision is made, the Court has given Mr.�Iallander sixty-one days(until May �,2002) to initiate repair or removal. You may recall that a certificate of occupancy is the permit from the city that says a house may be occupied as a residence. The litigation with the city that began years ago related to the city claiming that you could not occupy the house. Lyle advised that the following tasks must be completed prior to issuance of a certificate of occupancy: 1) Plumbing: Licensed plumber must inspect, repair as needed and certify to the city that the plumbing meets code. 2) Electrical: Licensed electrician must inspect, repair as needed and certify to the city that the electrical meets code. 3) Add cedar members to the four piers at the front of the porch. You advised that this work has been completed. 4) Fina1 inspection. City inspector must inspect house and certify that house is ready for occupancy. I requested a final inspection be scheduled. 5) Certificate of Occupancy will be issued following inspection and approval that the house is ready for occupancy. As you know, the city has scheduled a hearing before the court alleging that there is no certificate of occupancy. The date of the hearing is December 9, 2008. I viewed the plumbing fixtures and observed they were coated with a film of rust from the well water. I do not believe the fixtures have deteriorated to the point where they must be replaced. The tub and sinks do require thorough cleaning. Hopefully John can complete the cleaning before he gets a plumber out far the inspection. John has no cash and no credit. This is an obstacle for hiring a plumber and an electrician. He has requested an organization (I believe it is Interfaith Outreach) to assist him with the plumbing and electrical repairs/inspection. Although they have helped him in the past, they are slow and have 1'united resources. He is hopeful they will assist him with the plumbing and electrical expenses. If you are aware of any organization that can assist John with completing these tasks please let me know. On a positive note, John has completed the work on the four piers at the front of the porch. (a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse, litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the property. (b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds on the property at a height of not more than six inches, except this provision shall not apply to the following: � (1) Publicly owned parks, trails or nature areas. (2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78. (3) Residential properties in excess of one acre gross lot size when located in the RR- 1A, RR-16, LR-1A and RS rural residential zoning districts, provided that such properties or portions of properties shall be maintained in conformance with this subsection upon notice from the city that lack of such maintenance has caused complaints from abutting property owners and is thereby creating a public nuisance. (4) Wetlands vegetation as defined in chapter 78. (5) Grass, weeds or underbrush on any slope in excess of 100 percent (45 degrees). It is a misdemeanor for any person to construct, reconstruct, or in any way alter or extend any public or private drainage system unless such person is within the scope of a contract with the city or has a written permit from the city. (e) /ncrease of volume, velocity. It is a misdemeanor for any person to increase the volume or velocity of surface water runoff leaving his property, or to channel any surface water runoff so that it is redirected outside of the normal, natural watercourse as such surface water is discharged from private property on to public streets, public property, or on to neighboring private property, without a permit from the city. (Code 1984, § 9.04) Sec. 58-3. Junk cars, furniture, household furnishings and appliances stored on public or private property. It is unlawful to park or store any unlicensed, unregistered or inoperable motor vehicle lacking essential parts, household furnishings or appliances, or parts or components, on any property, public or private, unless housed within a lawfully erected building. I am writing this note so that you will have written documentation of my concerns as a neighbor of Mr. Hollander. I hope that you will share my complaints with the judge that reviews the Hollander case at the end of October. As a family with smaller children,we have serious concerns about living close to the Hollander property. Here are a few of our specific concerns: • He puts out large bags of what appears to be cat food that attract all kinds of animals to the area. We have seen large raccoons wandering around and have lately had a problem with black crows. He apparently does not have any animals of his own but continues to put out large amounts of food in the middle of his yard on a regular basis. This is attracting animals that are both a nuisance and could be dangerous. • There are two abandoned cars on his property. While I lrnow that he keeps them licensed and has apparently started them to prove that they are operable,they have never moved since we have lived in our home for over a year. They are filled with junk and usually have flat tires. They fit the description of abandoned or junk cars. • Since he cannot live in the home,Mr. Hollander sits in his van in front of his house with his ignition on for hours at a time throughout the day and night. Occasionally,when he is nearing his property he honks his horn,which is loud and annoying. Since he does not have a real driveway,he parks in front and sits for much of the day and night in his van. When there is snow,he parks in the street outside of his property. It can't be healthy to have a car running and emitting exhaust all day long and it is frightening for our children when they are playing outside in our yard. I know that there is not a code for this,but imagine someone sitting outside your house all day and much of the night in a running vehicle. • The property,house and sheds are in disrepair and look terrible. There are fence posts with no fence. The sheds are falling apart and make it look like a junk yard. He has spent much of the summer"fixing"his house which adds even more junk in front and more cars and people hanging around, doing very little. I have noticed at most,two people at a time,on weekends that are actually working on the house. The project is dragging out with very little progress an3 e��en:ncre of a mess. In general,the property, sheds,cars and house are all in disrepair. They are a nuisance to look at and potentially dangerous.
