Steel scr�W jacks were present in several areas. Matty of them had dimensional 2x fumber chris-anssed over the top of
the screw jack to pick up two exisl,tng floor fi'aming m@rnbers. The new diReensional lumbor was placed flai, in it's weak
axis so It would not have significar�strenqth or stifFness ta pick up floor loading in this con�iguration. This is acceptable
sir�ce the purpose af the screw jacks as placed is to just slightty reduce the bouncy feefing of the floor framing rathe�than
to ba a primary vertical Ioad resisting element. �he base of the j�cks are in direct contaCt wlth lhe conCrete floor slab
and is acceptable, but may�cause cracking of the floor slab due to the concemratlon of the loads dlre�tly over the slab
and not distributed ovar a larger area of the floor slab. The sciew iacks should be monitored bv vou for sians of
Ioosenin,�c.mavemerrt.etc.and should be anchored to conc slab with a minimum of a sinate anchor to the

Pursuant to your request, I conducted an on-site inspection at the
above-captioned address, the Hollander residence. The inspection
was prompted because of safety concerns with whether or not the
requirements of the City of Orono are being met ta have this
residence safe and secure for continued habitation. As a guideline,
i used the letter from Douglas L. Fell, P.E. dated November 13, 2002
which was accepted by the City on Niay 5, 2003 as a check list.
The inspection took place on November 25, 2008 at 2: 00 p.m. I was
met at the site by Mr. John Hollander and his attorney, Nir. Gregory
Lang. The following items as noted have not been completed:
CLEANING:
1 Remove all trash from the interior of the building; living room
and front porch.
2) i�'ash all interior surfaces: floors, walls, ceilings in living
room and front porch; not done.
FLOOR LOAD REDUCTIOI�S:
1) Remove all store items that are concentrated in areas of the
floor.
4j Remove one (1) of the pianos �rom living room.
FOUNDAT I ON I�dORK:
4 Provi e new treated wood plates between any new grout or boulders.
5) Provide a treated double 2x8 header spanning over the front base-
ment wall window.
6) Foundation wall repaired near bot�om of stairs.
7) Provide continuous foundation system around all basement wall
windows (fill voids around windows) . Foundation work to be
reviewed by structural engineer.

This report contains the resutts of my final site observation of your house that occurred on October 6, 2007 at
approximately 10:30 a.m. This site observation and report were pertormed at your reque�t and the request of your
attorney, as per our consulting agreement dated October 6,2007, in order to determine if fhe repairs to your house meet
the intent of the November 13,2�02 report items that were identified by Lyie Ohman requiring review by a struc#urat
engineer as a condition of the building permit, {based upon the report with the City of Orono Building Permit Plan Review
stamp on it datecf 5-5-03,signed by Lyle Ohman anct checked as approved with corrections noted).
I have discussed the current situation and our intended approach with Mr. Lyle Ohman from the City of Orono prior to
making this last site visit and he was ln agreement that this approach woaid be acceptable.
Review of these ifems was pertormed after the work had been done.
I have copied the iterr�s from the November 13,2002 repo�t{with the 5-5-03 City stamp on it)that were identified as
requiring the structura!engineer's review and have commented d'rrectly beneath those items as to my observations of

The wall area appears to have been repaired adequately. A hatch was not provided at ihis location since you were
concemed that existing pipes under the existiFlg kitche�area may freeze if you completely closes off the crawE space

conditions of the house.

Steel screw jacks were present in severa!areas. Many of them had dimensional 2x lumber chris-crossed over the top of
the screw jack to pick up two existing fioor framing members. The new dimensionat lumber was piaced flat, in iYs weak
axis so it would not have signif�cant strength or s#iffness to pick up floor loading in#his con�iguration. This is acceptabie
since the purpose of the screw jacks as placed is to just sligMiy reduce the bouncy feeling of the floor framing rather than
to be a primary verticaf load resisting efement. The base of#he jacics are in direct contact with th�conctete floar slab
and is acceptable, but may cause cracking of the floor slab due to ttre concerrtration of the loads dire�tly over the slab
and not distributed over a farger area of the floor slab. The screw iacks shoutd be monitored bv vou for sians of
iaoseninq,movement etc �nd should be anchored to concrete stab wtth a minimum of a sinale anchorto the
stab and should also be na�led to the wood members at the to of the screw"ack.

years. You did s#ate that you did add in a� exterior drain tile system adjacent to the exterioF of the foundation wall and
have it daylight draining away from the house site. This should be acceptable since he did not do any significant
changes to the site#hat would require re-grading. Any future site work shouJd atterr�t to dive�t surfaee mofSture away
from the house and should consider the use of impervious materiaEs at the surface adjacer�to the house to reduce the
potentiaf of moisturE infittration into the basement area.

The framing appears to be adequate for the given conditions. The condition of the exterior should con#inued to be
monitored by you and shoufd be maintained as required.

' This report contains the written findings of our Limited Structural Engineering Evaluation for the residence located at
the address listed above. This evaluation was performed according to our consulting agreement dated May 2, 2002.
The primary concern of this evaluation was to address the structural issues in the City of Orono, Minnesota
resolution of the City Council No. 4699. The evaluation was limited to those items and others as addressed within
' this report. The following are the results of our evaluation.
Intent of the Evaluation 8�Anticipated Process:
' The primary intent of this evaluation is to respond to the specific items addressed within the resolution relating to the
residential structure with the following goals:
' 1. Provide a response to each item listed within the resolution with either a reason why the current item should
be acceptable or with a defined fix to the situation.
2. Work with representatives from the City of Orono Building Department to achieve a reasonable approach to
resolving the building structure's problems to allow occupancy of the residence again by Mr. Hollander.
' 3. Each listed fix should have enough definition to atlow Mr. Hollander to obtain bids to have the required repairs
quantified from a cost standpoint.
4. Once the bids are returned, Mr. Hollander will make the decisions required to determine to proceed with the
' required fixes, obtain other approaches to fixing the problems, obtaining additional bids or following other
options relating to the building.
5. Once the bids are back and Mr. Hollander decides to go forward with the required repairs, the work may
begin on the repairs according to an established relative repair and inspection schedule. This schedule shall
' be established and agreed upon by Mr. Hollander and the City of Orono for the purpose of correcting the
problems according to an approved, concise, defined schedule that will define what is to be done and when.
The when will be tied to both the relative terms and to actual calendar time. A tentative schedule is included
' at the end of this report.

for a very long time. There are some minor areas of failure, especially around the windows where
� there are openings for water and animals.
2. It is our intent at this time to have the basement area cleaned out of the dirt and moisture that is
currently within the basement area.
3. The basement drainage system will be slightly modified to continue to drain water that does get into
' the basement area. At this point we are anticipating that the sump pump discharge will be re-routed
from its current discharge location at the front to the south side of the house. At that location we
would suggest that the sump pump discharge pipe have a standard threaded hose fitting so that a
1 standard garden hose may be connected to it in the warm weather and that it should be removed in
the colder weather so that it does not freeze and hinder discharge water flow. The hose shall
discharge the water a minimum of four feet from the house onto a splash block of some kind. The
owner may look into an underground discharge for the sump pump discharge.
, 4. Steps will be taken to provide additional assurance the basement wall will continue to function.
Areas of the foundation wall shall be hand brushed to remove any loose material from between the
boulders. Grout shall be installed between the boulders to anchor the boulders to each other and
' create a gridlock system to reduce the potential of the boulders moving independently. The grout
should cover the areas befinreen the boulders and not extend any further into the basement area
than the most interior surface of the boulders. This should occur on all walls where significant voids
remain befinreen the boulders.
, City: "Backfill with earth sloped away from the building with positive drainage."
Response: 1. Wherever possible provide additional grade at the house to allow the surface moisture to drain
away from the building. Care should be taken not to have the soil come any closer than 6"to the
' house siding or framing when adding soil. Grade should be removed from some distance away
from the house wherever the addition of grade at the house cannot be provided to create the
positive drainage. This can be accomplished by providing some slight soil removal (approximately
3"to 4"total depth) approximately 5'to 6' away from the base of the house. The grade should
' slope from the house toward the lower area (sloping the 3"to 4"over the 5'to 6' distance). This
lower area should then continue to slope away from the house area. The newly graded area should
be seeded. Existing conditions where grade is closer than 6"to the siding or the framing will be
' permitted to remain where site conditions may not allow the removal of those soils to achieve
adequate drainage. The north side of the house is a good example of this since there are existing
trees in the area that may be affected if excessive surface modifications are pertormed
2. Gutters and downspouts should be added to all of the roof lines of the house, after any required
' roof edge/fascia repairs are made. The ends of the downspouts shall discharge the rain water a
minimum of 5' away from the base of the house. Splash blocks shall be provided at the ends of all
downspouts. Underground discharges for the downspouts should be considered by the owner
wherever possible to reduce the potential for damage to the ends of the downspouts. Color of the
' gutters and downspouts shall be selected by the owner and shall be coordinated with the color of
the exterior of the home.
3. We are requesting that as much area as possible be covered with impervious material adjacent to
' the house for a distance of approximately 5'to 6'. This may consist of heavy plastic sheeting with
landscape gravel or bark on top of the plastic. All vegetation shall be removed from beneath the
plastic before the plastic is installed. The plastic shall be anchored to the ground with landscaping
pegs. The area of impervious material shall be made to slope away from the base of the house.

Response: 1. Egress windows are not required by code at these foundation walls.
2. The existing window wells shall be cleared of debris. This includes the tree truck growing in one of
them.
� 3. The existing windows shall be cleaned and either repaired or replaced so as to not permit
access into the basement area by insects or animals.
4. A clear plexiglass cover shall be provided over the top of the window wells to restrict acess of
' insects, animals and accidental falls into the window well. The cover shall be sealed all around with
caulking compound and mechanically anchored to the window well concrete, with anchors that will
permit the future removal for cleaning and maintenance of the window well area.
' Floor Svstem
City: "Replace floor system with code compliant materials a minimum of 18"from earth."
' Response: 1. Only a few areas need to be repaired due to some splitting/cracking of the members&/or
connections.
2. The structure has been there in its current state for many years prior to many of the current building
codes and code requirements. To require that the floor framing be changed now, to become
� compliant with current building codes is excessively restricting and borders on excessive restrictive
code compliance. If it is allowed to be applied here, for this project, in broad generalized terms
(replace the floor system), rather than individual specific bad members or connection, we are at risk
, of setting a very serious precident that may affect many other homeowners.
3. We are recommending at this time that individual members be supported by additional framing
down to the floor slab/foundations at the chimney area and at the beam adjacent to the basement
stair opening. This additional framing at the chimney would consist of steel adjustable screw jacks
� under the severed existing framing. The tops of the jacks shall be nailed to the existing framing
members with a minimum of four 16d nails per jack. The bottom of the screw jacks shall be
anchored to the concrete slab on grade with concrete anchors, Tapcon type screws or equal. This
area will be inspected by the engineer of record for the project at the time of installation and upon
, completion of the installation. Similar framing shall be provided for the severed beam adjacent to
the basement stair opening. Additional screw jacks shall be provided beneath the beam. A new
additional double 2x8 treated beam members shall be fastened to each side of the existing severed
' beam and fastened to the screw jacks also.
4. The existing system appears to have worked well for many years. It would be very unfortunate to
totally replace the existing floor system, unfortunate not only for the unnecessary costs, but also for
the loss of historical framing systems.
, 5. The intent with the floor system shall be to reinforce only those areas that are needed without
significantly changing the existing framing (due to historical preservation goals)or the existing load
path of the structure.
t 6. Additional observation will occur by the engineer of record during the course of repairs. Additional
framing repairs may be identified at that time. A final evaluation and report shall be provided upon
completion of the framing repairs.
7. Wherever reasonably accessible, areas where existing framing comes into contact with the soils,
' shall have the soil removed and a treated 2x member placed between the existing framing and the
soil.

' Response: 1. As with the floor framing, the total demolition of the existing stairways and re-working of the
stairways to be code compliant may be cost prohibitive, impossible to lay out without significant
framing changes and at least would be excessively restrictive.
' 2. We are proposing that the entire stairway in the basement be replaced and a gripable
handrail be installed prior to occupancy. However, the basic layout of the stair would remain as it
has for many years. The material to be used for the replacement steps shall be treated lumber.
3. To require these stairways to be re-worked for code compliance would be setting a very serious
, precident for other homes in the area. Homes down the street could be required to become code
compliant at tremendous costs and interruption to the homeowner.
4. The stairway to the upstairs from the kitchen appears to be in very good shape, with a slight slope
to the framing. This stair we feel should remain in the condition it is currently in. The base of this
, stair stringer shall be supported off of the foundation wall at the base of the stringer with a vertical
treated 2x10 member nailed to the stringer. Some slight adjustments of the stringer may be
attempted to reduce the slight side slope of the steps. Care must be taken not to exert excessively
' high stresses in adjusting the steps. The framing of the stringer support shall be observed by the
engineer of record at the completion of the framing repairs. There is currently a handrail installed at
the stairway going from the kitchen up to the bedrooms.
tExterior
City: "Support fuel tank on proper base."
' Response: 1. Tank is not currently being utilized for any systems within the house. It will be removed as part of
the cleaning efforts and will be properly discardedlrecycled/sold.
City: "Raise building or lower grade to provide 6 inch clearance from earth to framing."
Response: 1. This is another example of the building being here much before the code requirements for soil
' clearance from the framing/cladding. See above in the foundation section for measures to be taken
to provide positive drainage away from the house.
City: "Replace porch with code compliant materials."
' Response: 1. The porch that this report is addressing is the front porch, with the failing concrete knee wall. We
are calling for any loose concrete of the knee wall to be patched as required with concrete patching
materials.
2. This report does not address the"back" porch area. The side walls of this porch are failing. This
' back porch needs to be removed and/or replaced.
3. We are at this time intending to proceed obtaining prices to remove the back porch and also take
prices to re-build the porch. Once the prices come back, Mr. Hollander will determine if the rear
' porch walls will be totally removed or if it will be removed, repaired or replaced with new porch walls
of similar style and construction. The City will be informed which way Mr. Hollander will proceed
after he obtains the bids. Proper documentation will be provided to the City, if necessary.
� City: "Replace siding,soffit, and facia where needed."
Response: 1. Bids will be taken by contractors for the preparation and painting of the exterior of the house
including siding, soffits and facia. The purpose of the bids is to determine the cost extent for this
' part of the project and to possibly identify some of the work that may be able to be performed by Mr.
Hollander or some of his friends.
2. When the house is prepared for painting, the siding, soffit and facia will be further reviewed to
determine the extent of the existing materials that will need to be repaired/replaced.

Response: Missing tiles are to be repaired/replaced and the bathroom and kitchen are to be sanitized.

Response: It is the intention of Mr. Hollander to utilize the services of a licensed mechanical/electrical contractor to
determine the type of heating/ventilating/air conditions systems to utilize within this residence. The
� existing central heating system will be removed and the existing electrical baseboard heating will be
utilized either by itself or in conjunction with additional electrical baseboard heating or central heating
system. The final systems will be presented to the city prior to installation.

residential structure as identified within the City resolution.
' These final documents shall be submitted to the city for their approval. Mr. Hollander will take bids on the required
work. A conditional building permit may be requested utilizing this information, conditional upon the continued
substantial adherence to the given work description and schedule. Variation from the given schedule or work coufd
' result in loss of the building permit.
This building shall be treated not to detract from any historical significance that it may have. All modifications to the
building shall be reviewed with the owner prior to making such modifications.
, Heavy equipment use is prohibited within approximately 10' of the base of the building to reduce the potential of high
lateral loads to the foundation system. This includes equipment and material storage and auto/truck traffic/parking.
t All items being utilized for the construction/repairs of this home shall have their contents disclosed to the owner prior
to use. The owner has allergies to many materials and the final selection of materials shall be made by the owner

' This report contains the written findings of our Limited Structural Engineering Evaluation for the residence located at
the address listed above. This evaluation was performed according to our consulting agreement dated May 2, 2002.
The primary concern of this evaluation was to address the structurat issues in the City of Orono, Minnesota
resolution of the City Council No. 4699. The evaluation was limited to those items and others as addressed within
' this report. The following are the results of our evaluation.
Intent of the Evaluation 8 Anticipated Process:
' The primary intent of this evaluation is to respond to the specific items addressed within the resolution relating to the
residential structure with the following goals:
' 1. Provide a response to each item listed within the resolution with either a reason why the current item should
be acceptable or with a defined fix to the situation.
2. Work with representatives from the City of Orono Building Department to achieve a reasonable approach to
resolving the building structure's problems to allow occupancy of the residence again by Mr. Hollander.
' 3. Each listed fix should have enough definition to allow Mr. Hollander to obtain bids to have the required repairs
quantified from a cost standpoint.
4. Once the bids are returned, Mr. Hollander will make the decisions required to determine to proceed with the
' required fixes, obtain other approaches to fixing the problems, obtaining additional bids or following other
options relating to the building.
5. Once the bids are back and Mr. Hollander decides to go forward with the required repairs, the work may
begin on the repairs according to an established relative repair and inspection schedule. This schedule shall
' be established and agreed upon by Mr. Hollander and the City of Orono for the purpose of correcting the
problems according to an approved, concise, defined schedule that will define what is to be done and when.
The when will be tied to both the relative terms and to actual calendar time. A tentative schedule is included
' at the end of this report.

� The intent of this document is to provide a rational reasonable approach to resolving the deficiencies relating to this
residential structure as identified within the City resolution.
' What is presented here is the initial approach direction for all parties to review and agree upon, in principle. The final
approach will be created upon tentative approval by the City of these approaches to this situation. The final
approach will be this document refined and the refined calendar. These final documents will then be submitted to
' the city for their approval of this approach. Mr. Hollander will take bids on the required work. This document will be
re-submitted to the City with any defined changes and scope of work definitions for the purpose of obtaining a
building permit for the given work. A conditional building permit could then be issued, conditional upon the continued

1.0 BACKGROUND
The John Hollander Residence, located at 200 Hollander Road, Orono, Minnesota, was inspected
by Lyle Oman, City of Orono, and me on September 11, 2002. Also attending the inspection
were the property owner, Mr. Hollander, Mr. Hollander's engineer, Doug Fell, P.E., and Mr.
Hollander's attorney, Greg Lang. This report describes the building, the inspection findings, and
recommended actions.
2.0 PURPOSE
The City of Orono has passed a resolution finding the Hollander residence to be hazardous, and
requiring the securing and repair or removal of the residential structure (refer to resolution, dated
October 8, 2001). The purpose of the inspection was to provide a professional evaluation of the
structural condition of the dwelling and to note any observed structural deficiencies. The
inspection was to be limited to visual observations only—no material testing or quantitative
analysis was performed.
3.0 DESCRIPTION OF STRUCTURE
The Hollander residence is a single family, two-story wood framed farmhouse, reportedly
constructed in the mid-to late-1800's. It is understood that the dwelling has been continuously
occupied until recently, following passage of the City's hazardous building finding resolution.
A full basement extends below a portion of the original building, with wood log joist floor
framing above. The north wing of the original building spans an abandoned cistern with no top
- slab and which has a large opening in the south wall, allowing through access from the basement
area. At least two single-story porch additions were added to the original house, one in the front
(northeast corner) and the other in the rear(northwest corner). Total floor area for the 3levels is
estimated to be on the order of 2,000 square feet.

4.0 SCOPE OF INVESTIGATION
The investigation of the Hollander residence consisted of a visual observation made during a
single walk-through inspection on September 11, 2002. Finishes, stored materials andlor debris
covered all of the structural components except the basemendfoundation walls, stairs, and the
underside of the main floor framing. No drawings of the building were available.
5.0 DISCUSSION OF FINDINGS
The general condition of the building was extremely poor, with pervasive evidence of severe
neglect over an extended period of time. Sanitary, health and minor maintenance-related items
are not discussed here, except as they relate to the effects on the structural conditions.
During the course of the inspection several structural deficiencies were observed, some of which
are considered to be potentially hazardous to life safety if not remedied. The major de�ciencies
related to the structure are described below, with those that are considered to be potentially
hazardous noted. Re-occupancy of the building should not be permitted until those items that are
considered to be hazardous are mitigated.
1. Poor site drainage around the exterior has directed water toward the house, rather than
away from it. In addition, the surrounding grade is high enough that it is in contact with
the wood lap siding in many places, absorbing and wicking moisture into contact with the
wood framing members behind it. This moisture has caused some decay and loss of
strength in the wall and main floor wood framing members.
2. The concrete portion (up to window sill height) of the front porch exterior walls has
deteriorated badly and has large cracks through the wall. The wall was observed to be
unreinforced and the concrete soft and friable. See attached Photo No. 2. Because this
wall supports the roof framing above, this condition is considered to be hazazdous.
3. Main floor framing was observed to slope noticeably from the perimeter inwards, due
either to foundation settlements or to framing deflections. Inspection from below
revealed that some log floor joists are decayed at the perimeter wall bearings, that some
are cracked and split near midspan, and that others are simply terminated with no support

at the end (e.g. framing the stair opening and at the brick chimney). Several of the wood
beams supportin�the joists showed signs of decay and deterioration, particularly above
the stone foundation walls. The poor condition of these beams and the len�th of their
spans, perhaps more than any other deficiency observed, are considered to create the
greatest hazard and potentially unsafe condition.
4. Wood framed stairs from the basement to main floor, and from main floor to second
floor, do not have sufficient support or identifiable load paths, and are considered to be
unsafe.
5. Large piles of materials, including furniture, linen, and miscellaneous household items
were stored on the main floor to as much as 3 feet high in some areas, creating large
sustained live loads on the main floor framing. These loads are considered to be
excessive for this building type, age, and condition. The amount (weight) of stored
materials creates a condition that is considered to be unsafe. ;
6. Basemendfoundation walls are constructed of large igneous field stones, mortared
together with a heavily sanded mortar. The mortar has deteriorated and has virtually
eroded away in some areas. Without mortar to bond the stones together, the walls are
potentially unstable and aze considered to be unsafe. Sump pump discharge piping
(described below) currently is leaking water onto one of these areas, and should be sealed
or redirected.
7. A sump pit has been retrofitted into the middle of the basement floor slab, and an
operable pump was pumping water through a flexible discharge hose to the front yard.
Pipe joints were leaking severely into the basement, allowing the water to flow across the
floor slab and return to the sump to be repumped. This large source of moisture without
mechanical ventilation has created an extremely damp interior environment, accelerating
decay and deterioration of the structural materials.
8. The wood framed walls of the rear porch were observed to be pushed outward, calling
into question the adequacy of the support provided for the roof framing above. In

addition, the porch foundation was observed to be an unreinforced slab on �rade,
exhibiting large cracks and movements due to frost heave. These movements are
excessive and do not provide an adequate foundation for habitable space. The condition
of the porch framin� and foundation are considered to be unsafe.
6.0 CONCLUSIONS AND RECONm1ENDATIONS
As mentioned, the general condition of the building is poor, and the condition of several
particular structural components is poor enou�h to be considered hazardous and too unsafe for
the building to be occupied. It is possible, however, that these conditions can be repaired,
replaced, or removed altogether in order to abate this condition. There apparently is no legal
financial limit (e.g. 50% of property value) restricting the amount that can be spent mitigatin�
the noted hazardous conditions.
If it is the owner's desire to re-occupy or sell the buildin�, a demolition and rehabilitation plan
must be prepared and signed by a structural engineer that addresses the hazardous conditions
identified above. The engineer must also be retained throughout the demolition and
rehabilitation to observe and approve the work done, and to observe the condition of the many
structural components that are currently hidden and cannot yet be evaluated.
7.0 DISCLAIMERS AND QUALIFICATIONS
The opinions stated in this report are based on limited visual observations only. No physical
testing was performed and no calculations have been made to determine the adequacy of the
structural systems observed or the their compliance with accepted building code requirements.
No warranty is made, expressed or implied, that deficiencies that may affect life safety, though
not addressed in this report, may not exist.
