We have reviewed the plan for the proposed deck located at 4195 Highwood Road. The plan is
dated July 11, 2011. We have the following comments with regards to engineering matters:
• The proposed deck appears acceptable from an engineering standpoint. _
• This project will disturb more than 25, but less than 100 CY of material. Sediment and
erosion control information meeting the requirements of Orono's City Code 79-7(c)(1)
must be submitted. The minimum $2000 sediment and erosion control financial security
should be required of the owner for this permit.

AGREEMENT made this 3 day of . �.�'r , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City°)and as a„��1 I?b��• ' , ("Owners°).
Recitals
1. A building permit application has been filed for a remodel project located at 4195 Highwood Lane,
the ("Subject Property"), legally described as Lots 26, 27 and 28 Highwood Lake Minnetonka, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with tMe City. All accrued interest, if any, shall be paid#o the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infirastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00725 8 #2011-00732 iF
compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shalf have the right to certify the unpaid balance to the
subje rty pursuant to Minn. Stat. §§415.01 and 366.012.

City Engineer,Jesse Struve, reviewed the as-built survey dated September 19, 2013 which was received in our office on
October 29, 2013. After visiting the site to review the as-built survey Struve observed stairs on the lakeside of the
home. The stairs were shown on the proposed survey, but not on the as-built.
The proposed survey also noted gravel was to be removed on the street side of the property near the wooden gate,
presumably to meet hardcover requirements. The gravel remains, but with the newly adopted hardcover ordinance the
hardcover calculations show the property is in compliance, therefore, no action is required.
Please have the survey updated to reflect the stairs. Once an updated survey is received and approved I can start the
escrow refund process.

for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00725 8 #2011-00732 if
compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills fo�incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subje rty pursuant to Minn. Stat. §§415.01 and 366.012.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. 1'his permit is for only the work described and does
not grant permission for additional or related work which requires sepazate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if conswction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
