RESOLUTION OF THE CITY COUNCIL \�2 ��, �' 6 �C � G~ . 7 NO. j�kESHo��' A RESOLUTION GRANTING VARIANCES FROM MUNICIPAL ZONING CODE SECTIONS 78-1279, 7&1288, 7&1680 $78-1700 AND A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-966, 78-967 8� 78-1286 FILE NO. 15-3725 WHEREAS, Douglas Smith and Roban Smith,a married couple(hereinafter"the Owners") are the owners of the properties located at 4167 Highwood Road, 4175 Highwood Road, and 4195 Highwood Road within the City of rono (hereinafter the "City") and legally described as: Lot 24, ighwood Lake Minnetonka 4167 Highwood Road); Lot 25, Highwood Lake Minnetpnka�75 Highwood Road); and Lots 26, 27, and 28, Highwood Lake Minnetonka and Lot 6, Orchard Beach (4195 Highwood Road) Hennepin County, Minnesota (hereinafter collectively the "Property°); and WHEREAS, the Owners have made application to the City of O�ono for a conditional use permit(hereinafter the"CUP°)pursuant to Orono Municipal Zoning Code Sections 78-966, 78-967 and 78-1286 to allow grading for construction of subterranean retaining walls and landscape plantings in conjunction with slope stabilization measures within 75 feet of the OHWL on the Property; and WHEREAS, the Owners have made application to the City of Orono for variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow new hardcover in conjunction with construction of subteRanean retaining walls within 75 feet of the OWHL of Tanager Lake where no hardcover is permitted; and WHEREAS, after due published mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on September 21, 2015 at which times all persons desiring to be heard conceming this application were given the opportunity to.speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: Page 1 of 7 ���0 C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL �`�� �.G~� No. 65 � 7 kESHO� FINDINGS 1. This application was reviewed as Zoning File number 15-3725. 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acres and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on September 21, 2015 and voted 6 for and 0 against on a motion to approve the conditional use permit and variance. The Planning Cornmission finds that the following factors support the granting of the request: a. The Property has 1.53 acres in area (or 66,646 square feet). b. The Property has approximately 320 feet of width at the OHWL. c. The project is residential in scope and scale and is compliant with the zoning code. d. The Property is adequately served by police, fire, roads, and stormwater management. e. The Property is provided with an adequate water supply and sewage disposal system; in the opinion of staff this criterion is met. f. The proposed use is not expected to generate excessive demand for public services at public cost. g. Development of the Property for residential use is compatible and consistent with the neighborhood and surrounding uses. h. The proposed use is compatible with the character of buildings and site improvements in the surrounding area. The proposed restoration of the slope and prevention of future erosion is compatible with the existing and future use of the properties. i. The project is not anticipated to result in undesirable views or sustained activity so as to disturb neighbors. The grading and sub-grade retaining walls within the 75-foot setback area will have no negative impact on surrounding lands. The project is not anticipated to result in a nuisance condition. k. The Owners have proposed vegetative screening over graded areas which will result in screening of the disturbed area from the lake in a natural manner. The installation of the sub-grade retaining walls and landscape plan will help to support the slope should help to improve water quality and prevent further erosion from the Property. I. The proposed grading for erosion repair and installation of the subgrade retaining walls will not change the intended residential use of the Property so there should be no change in the use and enjoyment of adjacent properties. m. This project is anticipated to result in no additional non-residential lighting or glare. n. The project is not anticipated to not be a detriment to the public health, public safety, or general welfare. o. The variance is in harmony with the general intent and purpose of the Ordinance. The repair and stabilization of the lake slope by mechanical means has no impact on the residential character of the Property. p. The variance to permit installation of subgrade retaining wails for repair of an eroded lake slope is consistent with the Comprehensive Plan. The improvement will not be visible once c�mpleted. q. The Owner has established that there are practical difficulties. r. The Owner proposes to use the Property in a reasonable manner not permitted by the official controls. s. The erosion damage on the slope was not caused by the Owners t. The variance will not alter the essential character of the locality. The repair and stabilization of the lake slope with the installation of subgrade walls has no impact on the residential character of the property and will not be visible above ground or from the lake. u. The Property has a steep slope that has been deteriorating for years. Many other properties aiong the lake shore have similar challenges. The conditions do not apply generally to other land or structures in the distriet in which the land is located. Many other properties along the lake shore have similar erosion concerns. w. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the Owners. x. The granting of the setback variance is necessary in order to preserve health and safety by preventing further erosion and damage to the lake slope on the Property. y. The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty. The variance is necessary in order to stop the current damage and prevent further erosion into the lake. 4. The Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Owners and the public, and the effect of the proposed variance and conditional use permit on the health, safety and welfare of the community. 5. The City Council �nds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council grants: a CUP pursuant to Orono Municipal Zoning Code Sections 78-966, 78-967 and 7&1286 to allow grading for construction of subterranean retaining walls and landscape plantings in conjunction with slope stabilization measures within 75 feet of the OHWL on the Property; and variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow new hardcover in conjunction with construction of subterranean retaining walls within 75 feet of the OWHL of Tanager Lake where no hardcover is permitted; subject to the following conditions: Page 4 of 7 �-o�o C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL � ti 65 � � �' G~ NO. j�kESHO�� 1. Council approval is based on the survey and plans submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed overall hardcover levels shall conform to the Tier 1 standards. 3. The Owners shall keep debris off of the public roadways. The noise resulting from the trucks and equipment moving the materiaf in and around the site shall be minimized to the extent possible. The grading project will be evaluated and monitored by the City Engineer, Minnehaha Creek Watershed District and planning staff so as to minimize nuisances during the project. 4. Compliance with all permitting requirements of the Minnehaha Creek Watershed District. 5. Compliance with ongoing recommendations of the City Engineer. 6. Authorities granted by this resolution run with the Property not with the Owners, but are permissive only and must be exercised by obtaining permits and commencing construction of said project within one year of the date of Council approval, or the approvals granted by this Resolution will expire on that date (October 12, 2016). 7. An as-built survey will be required upon completion of the project prior to refund of the administrative grading and building permit escrows. 8. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned Owners have read, understand and hereby agree to the terms of this resolution and on behalf of the Owners and the Owners' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the Property.
