Dear Mr. Halverson:
This letter is regarding the materials and debris stored at your property. On May 25, 2004,
City Staff performed a follow-up inspection at the above listed address to a Notice of Zoning
violation dated September 30, 2003. During this inspection it was noted that materials and
debris remain in exterior storage at the above address and specifically, the following
violations of City Code Section 58-1 (a) and 58-3 were noted.
1. Ford Tempo, inoperable 2. window air conditioner
3. full garbage cans and bagged garbage by road 4. ladders
5. shovels 6. rake
7. 2 car batteries 8. full garbage cans by house
9. bathtub 10. tires
11. full garbage bags on side of house 12.shingles/building supplies
piled in side yard of house
13. inoperable boat 14. pile of cement blocks
This letter will serve as your notice that the property must be brought into
compliance by June 7, 2004 in order to avoid legal action by the city. In order to
bring your property into compliance the above items must be removed from the
property by June 7, 2004. Please be advised, if you fail to correct the violations or
request an appeal hearing before the City Council prior to the deadline, the city will
correct the violations and the costs to do so will be assessed against your property
[cite: city code 58-1 (c)]. Those costs will be certified to the County Auditor and will
be collected in the same manner as special assessments against your property.

Sec. 58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant
of every occupied property to maintain the property in a neat, clean and presentable
manner free of any junk, debris, refuse, litter, dead trees, or noxious weeds, and to
remove all other public health or safety hazards from the property.
(c) Any violation of this section is declared to be a nuisance and a public safety
and welfare hazard, and upon seven days'written notice to the owner, as shown by
the records of the office of the county auditor, of private premises on which such
material is found or any conditions in violation of this code section exist, the city may
remove such matter or correct any conditions in violation, and certify the cost of such
removals or corrections as any other special assessment.
Sec. 58-3. Junk cars, furniture, household furnishings and appliances stored on
public or private property.
It is unlawful to park or store any unlicensed, unregistered or inoperable motor
vehicle lacking essential parts, household furnishings or appliances, or parts or
components, on any property,public or private, unless housed within a lawfully
erected building. Any violation of this section is declared to be a nuisance; and upon
seven days' written notice to the owner, as shown by the records in the office of the
county auditor, of private premises on which such material is found, the city may
remove the vehicle and certify the cost of such removal as any other special
assessment. For the purpose of this section, an inoperable motor vehicle shall be
defined as lacking parts essential to operation, including but not limited to wheels,
tires, motor, drive train, battery; or having two or more flat tires; or having the
interior, including the driver's position, used for storage in such a manner that no
person can operate the vehicle.

NOTICE OF ZONING VIOLATION

Conditions exist on the indicated property which constitute a violation of the following section(s)of the
Orono Zoning Ordinance:
SECTION 9.50. JUNK CARS, FURNITURE,HOUSEHOLD FURNISHINGSAND
APPLIANCES STORED ON PUBLIC OR PRIVATE PROPERTY.
It is unlawful to park or store any unlicenced, unregistered or inoperable motor�-ehicle lacking

hazards therefrom.,

SUBD. 2. Grass and Weeds. The owner or occupant of every lot or parcel shall rzgulazly
cut or otherwise maintain all grass and weeds thereon at a height of not more than six (6) inches.
SUBD.3. Any violation of this section is declared to be a nuisance and public safety and welfare
hazard and upon seven days written notice to the owner, as shown by the records of the office of
the County Auditor, of private premises on which such material is found or an�- conditions in
violation of this code section exist, the City may remove the same or correct an�- conditions in
violation, and certify the cost of such removals or corrections as any other special assessment.
Please take action to comply with the above ordinance requirement(s) by September 19,2003
A follow-up inspection will be made at that time to verify compliance. _

September 11, 2003 to get the property cleaned up. I conducted an inspection on
September 26, 2003 and the property was still in violation. Please get the property

Re; Hazardous Buildings
Dear Mr. Halverson,
The city has received complaints regarding the condition of the buildings on your
property at 4175 Highwood road in ORONO. An inspection revealed that the buildings
are in a state of collapse and need to be removed from the property.
You have a few options to deal with this issue. First you could hire a contractor
to obtain a demolition permit from the city and have the buildings torn down and
removed from the property. Second you could authorize the city to remove the buildings
and the cost would be charged against the real estate as a special assessment, except the
city may provide that the cost so assessed may be paid in not to exceed five equal annual
installments with an interest thereon, at eight percent per annum.
If you fail to take action the city will obtain a court order to cause the removal of
the buildings and the cost will be charged against the real estate as a special assessment.
Please contact me before October 15th 2007 to discuss how you wish to proceed.
If we do not hear from you the city will proceed with hazardous building action and cause
the removals.
