I have completed review of the revised plans. Following are my comments for your consideration.

1. Additional grading detail should be provided between the proposed building and the east property line to define a
swale that directs runoff north and south and not towards the adjacent existing building. Additional proposed spot
elevations should be indicated on the plans in the area between buildings to adequately define the swale.
2014-01228-4174 Highwood Road

I'm not seeing any real changes on these new plans from the original plans you reviewed. Just the survey datum was
updated as required. If this is ok as is then �et me know. If not as previously requested, then please be a little more
specific on what you are asking for so I can communicate that clearly to the builder. For example, are you asking for a
cross section detail?

This is the e-mail you sent me on 12/2/14, but the information in these PDF's doesn't also contain the proposed new
houses on it with the site & grading plan like your or original submission. Can you please send that to me. We are also
as you know, still waiting on the MCWD determination for the wetland and issuance of their Erosion Control Permit prior to
issuance of the building permit. I believe these are what's still required for our review to be completed and the permits to
be issued.
I have the building plan review completed for your projects and there are some comments that can be addressed as part
of the construction process.
The engineering review was also completed as well for the projects from the original submission materials. Some of this
will need to be addressed for the permit issuance. These comments are as follows:

The survey datum submitted on the Certificate of Survey prepared by Jonathan Faraci with Lake and Land Surveying, inc.
dated May 8, 2014 does not meet the City of Orono survey data requirements for property survey submission. The data
supplied by your contractor is based upon the Ramsey Co. Coord. System NAD83. The City of Orono requirements

await their review and determination on your information submittal before determining our ability to issue building permits,
provided all required wetland setbacks are met.
On 10/22/14 the City received a building permit application for new residences to be constructed at the above referenced
locations. Your applications are incomplete. The following items must be submitted or revised in order for your application
to be considered complete and for the plan review to continue:

1. Certificate of Survey. Please provide two copies of an updated, full size certificate of survey which meets all of
the City's survey standards indicating the location of the proposed structures, grading, wetlands, swales and
retaining walls (if any).
2. Wetlands. Based on information from the MCWD, there are non-classified wetlands within the subject
properties. This wetland appears is within 150 feet of the proposed project site improvements. Because Orono
City Code requires a 35-foot setback from any wetland for structures or hardcover (10 feet from an established
MCWD buffer), the location of the wetland must be indicated on the survey. Setbacks must be verified with
wetland delineation information as approved by the MCWD. For the level delineation requirements, please
coordinate with the MCWD directly at 952-471-0590 regarding your project.

A Leve/ 1 delineation may be depicted via a A Level 2 delineation shall include the exact
map and/or aerial photo overlay onto the surveyed boundarv of the wetland shown on the

3. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow fee and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the
City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control measures and storm water/grading & drainage
improvements prior to final approval of the site improvements. The required escrow amount for each project site is
$2,500. The escrow agreement is attached. Your company as the property owner must sign the escrow
agreement and submit a check total for$5,000. This may be presented at the time the building permit is ready for
issuance and pick up.

Just to let you know I've been working with the MCWD on these two building permits (4166 &4174). It appears that the
district may be calling for a delineation on these two properties. I'm still waiting to hear back on that from Courtney Hall.
Also, the 4166 property has an existing residence that will be demolished with the start of work. I'm assuming you want
the entrance rock in place before that begins, but there is an existing approach to the site. Please confirm that either way.

Please also keep in mind that this is going to be another neighborhood disruption situation with construction on two 50 ft.
lots. We will see how effectively this new builder in the community deals with this situation. We can only hope it will be

The survey datum submitted on the Certificate of Survey prepared by Jonathan Faraci with Lake and Land Surveying, Inc.
dated May 8, 2014 does not meet the City of Orono survey data requirements for property survey submission. The data
supplied by your contractor is based upon the Ramsey Co. Coord. System NAD83. The City of Orono requirements
indicate that existing and proposed contour elevations must be tied to Sea Level Datum as stated on Page 6 of the
Building Permit Application packet for new structures or additions in the City of Orono (for reference please see the same

The structure height meets our requirements for the number of stories and overall height.
It is my understanding that you have submitted a wetland delineation to the Minnehaha Creek Watershed District. We will
await their review and determination on your information submittal before determining our ability to issue building permits,
provided all required wetland setbacks are met.
On 10/22/14 the City received a building permit application for new residences to be constructed at the above referenced
locations. Your applications are incomplete. The following items must be submitted or revised in order for your application
to be considered complete and for the plan review to continue:
1. Certificate of Survey. Please provide two copies of an updated, full size certificate of survey which meets all of
the City's survey standards indicating the location of the proposed structures, grading, wetlands, swales and
retaining walls (if any).
2. Wetiands. Based on information from the MCWD, there are non-classified wetlands within the subject properties.
This wetland appears is within 150 feet of the proposed project site improvements. Because Orono City Code
requires a 35-foot setback from any wetland for structures or hardcover (10 feet from an established MCWD
buffer), the location of the wetland must be indicated on the survey. Setbacks must be verified with wetland
delineation information as approved by the MCWD. For the level delineation requirements, please coordinate
with the MCWD directly at 952-471-0590 regarding your project.

3. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow fee and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the
City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control measures and storm water/grading & drainage
improvements prior to final approval of the site improvements. The required escrow amount for each project site is
$2,500. The escrow agreement is attached. Your company as the property owner must sign the escrow
agreement and submit a check total for$5,000. This may be presented at the time the building permit is ready for
issuance and pick up.

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2014-01228
AGREEMENT made this day of , 2014, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")and CNC Construction, LLC ("Owners").
Recitals
1. A building permit application has been filed for property located at 4174 Highwood Rd. the
("Subject Property"), legally described as Lot 32, Highwood Lake Minnetonka.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-01228 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

AGREEMENT made tt�is�'Z day of��,201�, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")and CNC Constructi n, LLC("Owners'�.
R�Itals
1. A building permit apptication has been filed for property located at 4174 Hlghwood Rd. the
("Subject Property"),legally described as Lot 32, Highwood Lake Minnetanka
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$2,500 with the City. All accrued interest, if any,shall be paid to the City to
reimburse the Ciiy for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consuttant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for alt out-of-pocket costs the City has incurred to assure that the work is completed in
accordance witfi the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with bullding perrnit �201401228 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incuRed cosls, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bilL
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. Ciiy Staff shall review the terms of this escrow
agreement two fimes per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to retum the funds. Owner may also request the retease of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successiully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat.§§415.01 and 366.012.
