BUILDING PERMIT ESCROW AGREEMENT Land Use Appiication#2012-3575 Orono Building Permit#2013-00005 AGREEMENT made this ;'�``�day of '-_..��!-�:.';�;.�';'f, 20'�, by and between the CITY OF ORONO, a Minnesota municipal corporation ("City")and Scott& Meiissa�Musqierd ("Owners"). Recitals 1. A buiiding permit application has been filed for a new sinqle famiiv home located at 4158 Hiqhwood Road, the ("Subject Property"), legally described as Lot 23 Hiqhwood Lake Minnetonka, Hennepin County Minnesota. 2. Owners request the City to review this application. 3. The City wiil commence its review of the appiication and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit$2,500 with the City. Ail accrued interest, if any, shafl be paid to the Cify to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (inciuding planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the plan. Eligibie expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow wiil also guarantee reimbursement to the City for ail out-of-pocket costs the City has incurred to assure that the work is compieted in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may aiso be used by the City to eliminafe any hazardous conditions associated with the work and to repair any damage to public property ar infrastructure fhat is caused by the work (including planning, engineering, or legal consultant review) associated with Land Use Application #2012-3575 & Orono Building Permit#2013-00005 if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCR01Al. After talking with the builder it is not the intent to remove the wall, only to fill over it where possible, so we will add a note to that effect. We will show some riprap at the end of the pipe outlet on the east side. The old house drained to the alley on the west and then the drainage came back onto the 4156 property farther down the hill towards the lake. With the tight lot and a couple of trees near the lot line it is tough to run a swale on the 4156 property. After talking with the builder we are proposing a gutter along the west side of the house in order to keep most of the water on this property. Would that be acceptable in light of the drainage patterns that presently exist? I still have concerns the pipe will be damaged by the installation of the retaining wall or the ground pressures from the wall can potentially crush the pipe. I will need to see additional documentation regarding to the structural integrity of the pipe with the wall being placed so close to the top of it. • A note was changed regarding the existing retaining wall along the east property line. The original note was "Stone retaining wall to be filled over", but it now says"stone retaining wall to be filled over or removed". If the intent is to remove the wall, the applicant will need temporary grading easements from the neighboring property because this work will impact their property. • I missed it on my first review, but the survey will need to address potential erosion caused by the installed drain tile. There will need to be some sort of energy dissipater at the end of the pipe to make sure it will not erode the existing slope down to the lake. • The grading on the west side of the property will need to be adjusted to maintain the drainage on the property. The proposed catch basin says the invert is 957.00 and with an 8" pipe that leaves less than 1' of cover from the top of the pipe to the bottom of the retaining wall (958.5). • There is an existing sanitary sewer line running along the lake side of the proposed house. This should be shown on the survey and any easements associated with the sanitary sewer line should also be shown. • Will there be any replacement of the existing retaining wall along the east side of the property? It appears a portion will be filled but it is unclear if any of the south part of the wall will be removed and replaced. This is especially true for where the proposed retaining wall will tie into the existing wall. Provide temporary lateral support for all walls until walls are adequately braced by permanent structure. Shore foundation walls retaining earth until floor framing and basement slab are in place. Use caution when operating equipment adjacent to foundation walls. GENERAL SOIL NOTES The structure has been designed using a presumptive load-bearing value of 2000 psf in accordance with Table R401.4.1 of the 2006 IRC on virgin soil or compacted granular fill for footings. Remove all top soil, uncompacted fill,or other poor soil from the construction area. Slope the site to drain away from the building. Install gutters and downspouts. Install drain tile. Backfill with granular soils. FOOTINGS/FOUNDATIONS All footings are to be formed. All stumps, roots and debris must be removed from the soil to a depth of at least 12" below the surface of the ground in the area occupied by the building. Footings shall be placed on virgin soil or compacted granular fill. Wall footings are cast-in-place concrete with continuous reinforcing placed 3"clear of bottom and 2"clear at top and sides. Brace laterally at roof top and bottom chords with blocking and strapping to adjacent trusses at each side of chimney for support in all directions. Sheath all sides full height with 5/8"plywood blocked at joints ar�d nailed with 6:12 nailing pattern. Notes represent a guideline only, on-site determination of exact blocking and framing systems to be determined by the contractor. PRECAST CONCRETE UNITS The design of all precast concrete units shall conform to ACI 318. Submit complete shop drawings to architect for approval,showing the erection plan, all bearing conditions, and anchorage details. Prestressed units to sustain the loads indicated in addition to alt other dead loads. Plank supplier shall design plank to support additional dead load from, but not limited to piping, ductwork, etc.. Coordinate with mechanical/electrical as required. Precast concrete walls shall be anchored to the foundation and to each other. The precast designer shall design the connections for fastening precast units to foundations, to each other, and to other supporting members. Floor plank shall be prestressed hollow-core slabs,proportioned for the loads noted on the drawings. Upon installation, plank shall be essentially past the effects of deformation due to creep and shall have camber not over 1/360 of the span. Such camber shall be uniform from plank to plank. All headers at openings in precast concrete shall be furnished by precast suppliers. Place mechanical openings not shown on plans between webs in precast concrete plank units. Do not drill holes into precast concrete plank without prior approval from plank supplier. Wet the surface of the precast plank to surface saturated dry condition and broom in portland cement slurry immediately prior to casting topping slab. A properly applied bonding agent is acceptable in lieu of the wet slurry provided it is installed in strict accordance to manufacturer's instruction.
