AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be perfortned according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
The applicant is responsible for assuring all required inspections aze

AGREEMENT made this ;'�``�day of '-_..��!-�:.';�;.�';'f, 20'�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Scott& Meiissa�Musqierd ("Owners").
Recitals
1. A buiiding permit application has been filed for a new sinqle famiiv home located at 4158
Hiqhwood Road, the ("Subject Property"), legally described as Lot 23 Hiqhwood Lake Minnetonka, Hennepin
County Minnesota.
2. Owners request the City to review this application.
3. The City wiil commence its review of the appiication and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. Ail accrued interest, if any, shafl be paid to the Cify to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (inciuding planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligibie expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow wiil also guarantee
reimbursement to the City for ail out-of-pocket costs the City has incurred to assure that the work is compieted in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may aiso be used by the City to eliminafe any hazardous conditions associated with the
work and to repair any damage to public property ar infrastructure fhat is caused by the work (including planning,
engineering, or legal consultant review) associated with Land Use Application #2012-3575 & Orono Building
Permit#2013-00005 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCR01Al. The Bala�ce on deposit in the escrow, if any, shall be returned to the

We will show a solid pvc sleeve under the wall rather than a draintile in that location.
After talking with the builder it is not the intent to remove the wall, only to fill over it where possible, so we will add a note
to that effect.
We will show some riprap at the end of the pipe outlet on the east side.
The old house drained to the alley on the west and then the drainage came back onto the 4156 property farther down the
hill towards the lake. With the tight lot and a couple of trees near the lot line it is tough to run a swale on the 4156
property. After talking with the builder we are proposing a gutter along the west side of the house in order to keep most of
the water on this property. Would that be acceptable in light of the drainage patterns that presently exist?

I have reviewed the new survey dated received 1/29/13 and have the following comments:
• The updated survey only lowered the invert for the pipe under the retaining wall by 0.5' meaning there will
only be just over 1' of cover from the top of pipe to the bottom of retaining wall. I still have concerns the pipe
will be damaged by the installation of the retaining wall or the ground pressures from the wall can potentially
crush the pipe. I will need to see additional documentation regarding to the structural integrity of the pipe with
the wall being placed so close to the top of it.
• A note was changed regarding the existing retaining wall along the east property line. The original note was
"Stone retaining wall to be filled over", but it now says"stone retaining wall to be filled over or removed". If the
intent is to remove the wall, the applicant will need temporary grading easements from the neighboring
property because this work will impact their property.
• I missed it on my first review, but the survey will need to address potential erosion caused by the installed drain
tile. There will need to be some sort of energy dissipater at the end of the pipe to make sure it will not erode
the existing slope down to the lake.
• The grading on the west side of the property will need to be adjusted to maintain the drainage on the property.

I have reviewed the survey for the proposed application for the new home at 4156 Highwood Rd and have the following
concerns:
• The draintile pipe under the proposed retaining wall on the east side of the house appears to not have adequate
cover over the pipe. The proposed catch basin says the invert is 957.00 and with an 8" pipe that leaves less than
1' of cover from the top of the pipe to the bottom of the retaining wall (958.5).
• There is an existing sanitary sewer line running along the lake side of the proposed house. This should be shown
on the survey and any easements associated with the sanitary sewer line should also be shown.
• Will there be any replacement of the existing retaining wall along the east side of the property? It appears a
portion will be filled but it is unclear if any of the south part of the wall will be removed and replaced. This is
especially true for where the proposed retaining wall will tie into the existing wall.

As requested,we have completed a structural review of the Highwood Road Residence at the proposed new residence
construction in Orono, Minnesota.
Background and Description
It is my understanding that the structure is being constructed as shown in the drawings AO through A7, dated 28
December 2012 and labeled Permit Set.
Per our conversation, MMY's scope of work includes the structural engineering of the new construction including the load
bearing 2x4 construction and MWFRS(main wind force resisting system).
Opinions and Recommendations
My calculations indicate this work is in accordance with the structural provisions of the 2007 Minnesota State Building
Code when constructed per the information shown in Appendix A—Structural Notes and Appendix B—Structural
Redlines.
Limiting Conditions:
The opinions and recommendations contained in this report are based on information provided by you,existing plans,
building codes,judgments regarding the structure based on past experience and industry standards, and calculations
performed based on this information. The work provided in the preparation of the report concerns the structural aspects

TEMPORARY BRACING
Contractor is responsible for bracing, without overstressing, all structural elements as required at all
stages of construction until completion of this project. Provide temporary lateral support for all walls until
walls are adequately braced by permanent structure. Shore foundation walls retaining earth until floor
framing and basement slab are in place. Use caution when operating equipment adjacent to foundation
walls.
GENERAL SOIL NOTES
The structure has been designed using a presumptive load-bearing value of 2000 psf in accordance with
Table R401.4.1 of the 2006 IRC on virgin soil or compacted granular fill for footings.
Remove all top soil, uncompacted fill,or other poor soil from the construction area.
Slope the site to drain away from the building.
Install gutters and downspouts.
Install drain tile.
Backfill with granular soils.
FOOTINGS/FOUNDATIONS
All footings are to be formed. All stumps, roots and debris must be removed from the soil to a depth of at
least 12" below the surface of the ground in the area occupied by the building. Footings shall be placed
on virgin soil or compacted granular fill.
Wall footings are cast-in-place concrete with continuous reinforcing placed 3"clear of bottom and 2"clear
at top and sides.
Wall footings are centered under walls and column footings under columns.
Wall footings shall be a minimum of 10"thick with a 4"projection each side of wall. Reinforce with 2 -#4
continuous bottom bars.
Column footings shall be a minimum of 12"thick, with plan dimensions as shown on drawing. Reinforce
with#4 bottom bars at 8"o.c. each way.
Provide 30 bar diameter lap at splices and full crossing lap at corners and intersections.Tie all reinforcing
in place. Set footing reinforcing on chairs or masonry brick to obtain 3"clearance from bottom of footing.
Maintain minimum frost depth of 42"for all exterior footings.
Top of footing shall be placed below the top of slabs on grade, or placed to maintain frost depth,
whichever is deeper.
Step footings in a uniform manner using a 2:1 horizontal to vertical slope.
Cast dowels in footing for foundation walls above. Dowels shall be the same quantity, size, and spacing
as the vertical wall reinforcing. Dowels shall be 30"long and extend to 3"clear of bottom of footing.
Contractor shall be responsible for implementing hot weather concrete requirements per ACI 305'and
cold weather concrete requirements per ACI 306.
Shore all foundation walls appropriately before backfilling and compacfing.
Foundations supporting wood shall extend at least 6"above the adjacent finished grade.
At foundation end walls,provide perpendicular full-height blocking at 24"o.c. in the first three joist spaces.
Glue and nail to joists and subfloor. Attach to sill plate with 2-USP MP5 clips or equal.
The contractor shall verify the location of all existing underground utilities and tanks prior to beginning
excavation.
CONCRETE
Provide ready-mixed concrete per ASTM C94. Portland cement shall be ASTM C150,Type I. Use only
one brand of cement throughout the work. Provide concrete aggregates meeting the requirements of
ASTM C33.
Maximum aggregate sjze shall be 3/4"for grade beams and slabs. Water shall be clean,free of
deleterious amounts of acids, alkalis,or organic materials, and shall be considered potable. Provide
admixtures to reduce water content, provide air-entrainment,or alter the quality of the concrete to meet
the job conditions.
All wall openings targer than 12"shall have 2-#5 at all sides extending 2'-0"beyond each edge of
opening with 2-#5 x 4'-0"diagonal bars at each corner of opening.

Wall reinforcing shall be continuous through columns and pilasters.
Provide full development and splice lengths per Concrete Reinforcing Steel Institute (CRSI) or ACI 318
requirements.
All concrete exposed to weather,freeze-thaw conditions or de-icing chemicals shall contain 5%-7°/a
entrained air.

SLABS ON GRADE

Construction and/or control joints shall be laid out in a rectangular pattern with long to short side ratio less
than or equal to 1.5 and with no re-entrant corners.
Control joints for slabs on grade shall be saw cut as soon as concrete can accept it without raveling

All control/construction joints shall be continuous and not staggered or offset.
Control joints shall be cleaned and sealed for curing purposes as soon as possible.

STRUCTURAL STEEL
All structural steel shall be designed, fabricated, and erected according to the specifications of the
American Institute of Steel Construction (A.I.S.C.) Latest Adoption.
Structural steel supplier shall supply all cap plates, bearing assemblies, base plates, stiffeners, splices,
and connections, and shall design same unless noted on drawings.
All welding shall match filler materials in accordance with the rules of the American Welding Society
(A.W.S.) Structural Welding Code, Latest Adoption. All welders shall be certified by the rules of the
American Welding Society.
Tighten anchor bolts and grout column base plates before installing steel beams.
Provide complete detailed shop drawings to the contractor for review and approval prior to fabrication.

DIMENSION LUMBER
Design assumes lumber is free of significant splits and checks, and contractor will visually inspect during
installation.
Sills and all other lumber in contact with concrete or masonry and within 8" of finished grade shall be
preservative treated wood.
Preservative treated wood shall be in accordance with the American Wood Protection Association,
Standard U1.
All lumber is to be grade stamped, which is to contain grading agency, mill number or name, grade of
lumber, species or species grouping or combination designation, rules under which graded, where
applicable, and condition of seasoning at time of manufacture.
All lumber shall be seasoned to a moisture content of 19% or less, with the indication of "S-Dry" on the
grade stamp.
All lumber shall be protected from the elements.
Sill plates to be bolted to foundation wall with 5/8" diameter anchor bolts at 4'-0" o.c. maximum. Bolts to
extend 13"minimum into solidly grouted foundation wall. Each siii plate to have a minimum of 2 bolts with
one bolt located not more than 12 inches or less than 4 1/2 inches from each end of the p►ate section.
Use 1/8"x 2"washers, slightly crushing plate.
Minimum nailing shall be in accordance with Table R602.3(1) of the 2006 1RC unless noted otherwise.
All walls shall have a single bottom plate and double top plate.
Exterior walls (load bearing and non load bearing) shail be:

Beams shall bear on a minimum of 3"along their length and fully along their width and have a minimum of
2 typical wall studs supporting them, unless noted otherwise.
Joists shall bear the full width of supporting members (stud wall, beams, etc.).
Provide solid vertical blocking at all joist spaces below wood columns. Provide matching columns to
foundation at lower levels below columns comprised of 3 or more studs.
All beams and joists not bearing on supporting members shall be framed with prefabricated joist hangers.
Beams or headers made of 2 - 2x's with 1/2" spacer shall be nailed together with 16d nails (.162" x 3 Yz")
at 16" o.c. along each edge,typical for each lumber ply
Spacing of bridging for joists shall not exceed 8'-0".
Double all joists under parallel partitions.
All plywood and OSB shall be installed per American Plywood Association standards, including the use of
construction adhesive for fastening to floor joists.
All fasteners and hangers in contact with treated lumber shall be G185 hot dipped galvanized or equal.
Lumber grading rules and wood species shall conform to Voluntary Product Standard PS 20-99 as
published by the Department of Commerce. Grading rules shall be by an agency certified by the Board of

WOOD TRUSSES
Responsibilities ot the contractor, building designer, truss manufacturer, and truss designer shall follow
the publication 'TPI 1-2002 National Design Standard for Metal Plate Connected Wood Truss
Construction."
Truss supplier shall notify SER of any proposed revisions to the layout indicated on this plan. Revisions
that affect the structural design will not be allowed without prior written approval by the SER.
Verify a�lowable bearing locations for girder trusses with SER prior to final design stage. Provide metal
bearing enhancers as necessary to uti�ize stud columns shown on plan.
Trusses shall be designed for top and bottom chord superimposed dead and live loads as indicated
above.
Truss supplier shall design trusses to support additional dead load from,but not limited to piping,
ductwork, etc. Coordinate with mechanical/electrical as required. General contractor to verify location
and magnitude of all such loads with truss supplier prior to fabrication of trusses.
Coordinate any draft stop locations and design trusses accordingly.
Live load deflection of roof trusses shall be limited to 1/240 of the span.
Live load deflection of floor trusses shall be limited to 1/480 of the span.
Design trusses for bearing as shown on drawings.
Truss configuration,pitch,overhang, etc.shall be indicated on the architectural drawings.
Spacing of roof trusses shall not exceed 24"o.c.
Spacing of floor trusses shall not exceed 19.2"o.c.
Lumber for wood trusses shall be in accordance with manufacturer's recommendations.
Truss manufacturer to provide girder trusses, hip jacks, and step-down trusses as required and designed
to support all superimposed loads. Provide hip-sets, dormers, and piggy-back trusses as required.
Truss manufacturer to specify if roof sheathing needs to be applied before placing "over-framing".
Provide metat framing anchors at truss bearing to mechanically fasten truss to bearing wall or supporting
member as shown in details.
Truss manufacturer shall provide truss to truss connection hangers.
Bridging, and bracing of truss compression and tension members, shall be installed in accordance with
the truss manufacturer's design and directions.
No cutting, notching, or modifications of trusses will be allowed without the manufacturer's written
approval.
Contractor shall provide permanent and temporary diagonal, lateral, and cross bracing in accordance with
the publication "BCSI 1-03 Building Component Safety Information, Guide to Good Practice for Handling,
Installing and Bracing of Metal Plate Connected Wood Trusses" by the Truss Plate Institute and Wood
Truss Council of America and as otherwise necessary.
Permanent bottom chord bracing and web bracing shall be located as shown on the truss drawings and
shall be minimum 2 x 4 with 2- 16d nails to end walls and trusses, lapping two truss spaces at splices.
WALL SHEATHING
Wall sheathing shall be minimum 15/32"thick APA rated panels, rated for spacing of supporting
members. A minimum 32/16 span rating is recommended.
Provide Exterior or Exposure 1 grade. Panels shall be continuous over two or more spans, and long
dimension of panel shall be either perpendicular or parallel to supports. Fasten wall sheathing with 8d
nails (.131"diameter x 2 1/2") spaced at 4" o.c. at supported edges and 8" o.c. at intermediate supports.
Leave an 1/8"gap at all end and edge joints to allow for expansion. Stagger end joints of panels. Refer
to plan and notes for any special shear walt nailing and bolting conditions. Gypsum sheathing to be a
minimum of 1/2"thick fastened with 6d cooler or wallboard nails at 7" o.c. to all framing members unless
noted otherwise.
ROOF SHEATHING
Roof sheathing shall be minimum 19/32"thick APA rated panels, rated for spacing of supporting
members. A minimum of 40/20 span rating is recommended. Provide panel clips, one between each
support, for supports spaced greater than 16"o.c.

Provide Exterior or Exposure 1 grade. Panels shall be continuous over two or more spans, and long
dimension of panel shall be perpendicular to supports. Fasten roof sheathing with 8d nails (.131"
diameter x 2 1/2") spaced at 4"o.c. at supported edges and 8"o.c. at intermediate supports. Leave an
1/8"gap at all end and edge joints to allow for expansion. Design of roof sheathing assumes that the roof
will be properly insulated and ventilated. Refer to APA publication N335N "Proper Installation of APA
Rated Sheathing for Roof Applications."
FLOOR SHEATHING
Floor sheathing shall be minimum 23/32"thick tongue and groove APA rated panels, rated for spacing of
supporting members. A minimum of 48/24 span rating is recommended. Provide Exposure 1 grade.
Panels shall be continuous over two or more spans, and long dimension of panel shall be perpendicular
to supports. Fasten sheathing with construction adhesive and 10d nails(.148"diameter x 3")spaced at
4"o.c. at supported edges and 8"o.c. at intermediate supports.
LVL WOOD MEMBERS
LVL members noted on drawings are engineered laminated veneer lumber as manufactured by the iLevel
-Weyerhaeuser Company. Alternate at contractor's option of equal design properties.
Sizes shown on plan are actual size.
CHIMNEY FRAMING
At chimney's higher than 3' measured from top of wood framing to top of highest contacting roof deck
elevation,the following general guidelines apply:
Frame with continuous 2 x 4 material from the top of the chimney to attic floor.
For discontinuous walls, provide triple plates bolted together at corners and Ca� 32"oc with sheathing
butted at center plate.
Provide (2) plates at top of chimney, lap these plates at corners.
Brace laterally at roof top and bottom chords with blocking and strapping to adjacent trusses at each side
of chimney for support in all directions.
Sheath all sides full height with 5/8"plywood blocked at joints ar�d nailed with 6:12 nailing pattern.
Notes represent a guideline only, on-site determination of exact blocking and framing systems to be
determined by the contractor.
PRECAST CONCRETE UNITS
The design of all precast concrete units shall conform to ACI 318.
Submit complete shop drawings to architect for approval,showing the erection plan, all bearing
conditions, and anchorage details.
Prestressed units to sustain the loads indicated in addition to alt other dead loads.
Plank supplier shall design plank to support additional dead load from, but not limited to
piping, ductwork, etc.. Coordinate with mechanical/electrical as required.
Precast concrete walls shall be anchored to the foundation and to each other.
The precast designer shall design the connections for fastening precast units to foundations, to each
other, and to other supporting members.
Floor plank shall be prestressed hollow-core slabs,proportioned for the loads noted on the drawings.
Upon installation, plank shall be essentially past the effects of deformation due to creep and shall have
camber not over 1/360 of the span. Such camber shall be uniform from plank to plank.
All headers at openings in precast concrete shall be furnished by precast suppliers.
Place mechanical openings not shown on plans between webs in precast concrete plank units.
Do not drill holes into precast concrete plank without prior approval from plank supplier.
Wet the surface of the precast plank to surface saturated dry condition and broom in portland cement
slurry immediately prior to casting topping slab. A properly applied bonding agent is acceptable in lieu of
the wet slurry provided it is installed in strict accordance to manufacturer's instruction.

AGREEMENT made this ;(� v'day of '�f3"��-f���X�, 20'�, by and between the CiTY OF ORONO,
a Minnesota municipal corporation("Cit�')and Scott& Meliss�/Musaierd ("Owners").
Recitals
1. A building permit application has been fi{ed for a new sinqle familv home located at 4156
Hi4hwood Road, the ("Subject Property"), legally described as Lot 23 Hiqhwood Lake Minnetonka, Hennepin
County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Co�temporaneously with the execution of this Esc►�ow
Agreement,the Owners shall deposit$2,500 with the City. AI�accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW.The purpose of the escxow is to guarantee reimbursement to the City
for al{ out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant rev'rew} ar will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for atl out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to elirninate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant raview) associated with Land Use Application #2012-3575 & Orono Building
Permit#2013-00005 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners da not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Orcier until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow accounf without further approvaf of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSiNG ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the

not grant pertnission for additional or related work which requires separate
